Approve TEMPORARY CUSTODIAL SUPPORT utilizing the City's Bid "ANNUAL BID FOR TEMPORARY LABOR SERVICES" from Tandem Staffing, with an estimated expenditure of $13,000 bringing the Bid's total estimated expenditure to $23,000 I Colmmissioner Denahan questioned whether or not this bid related to the Public Audience discussion at the last meeting. The City is A ad the the Co Mr question was raised about whether not this contract covered the median or landscaping. · Sugerman pointed out that he and Commissioner Weiland met with Mr. Wildner for the rpose of having the contractors revisit the specifications and standards of the median- dscaping contract. This agenda item does not indicate whether or not that issue would be Jressed. In addition, Mr. Sugerman noted that this would be an extension of the contract. If City wants to change the specifications and the work to be done in the medians, extending contract would not accomplish that. nmissioner Weiland wants to know what changes are involved that would warrant the Jitional funds. orney Cherof pointed out that this change order would be a 34% increase over the bid ount. That might warrant consideration regarding letting the contract expire for the purpose rebidding it. Hawkins said he would investigate this issue. Renew the bid for "ANNUAL SUPPLY OF HYDROGEN PEROXIDE" to Vulcan Chemical Technologies, Inc. with an estimated annual expenditure of $200,000 MEET?NG M?NUTES AGENDA PREVIEW CONFERENCE BOYNTON BEACH, FLOR.iDA NOVEMBER 29~ 1999 There were no questions regarding this item· :It is a renewal at the existing price. A~orney Cherof said a revised letter will be necessary and the Attorney's Office will take care of thins. Proposed Resolution No. R99-161 Re: Approving a Construction Surety Escrow Agreement between the City of Boynton Beach and EB Developers, Inc., and Kodsi & Eisenstein, P.A., (Escrow Agents) for the construction of Knuth Road 4 MEET~'NG M'rNUTES AGENDA PREV']:EW CONFERENCE BOYNTON BEACH, FLOP~DA NOVEMBER 29, 1999 D. Ratification of Planning & Development Board Action: Nancy Byrne reported that the Public Hearing item for Lowe's must be the first item to be addressed because if it is not approved, nothing else can move forward. Attorney Cherof advised the Commission that they would need a motion to pull ~[tems D.1, D.2, D.3, D.4, D.7 and D.8 from the Consent Agenda. They would be addressed after the Public Hearing. Lowe's Home Center (Number of Signs) - Southwest corner of T-95 and Woolbright Road - Request for relief from Chapter 21 Signs, Article TV, Section 2(B) which limits a single use to one (:L) site sign to allow the erection of two (2) site signs Lowe's Home Center (Pole Sign Height) - Southwest corner of 1-95 and Woolbright Road - Request relief from Chapter 21, Signs, Article IV, Section 2(B) which limits maximum sign height to 20 feet to allow for erection of a 49 foot high pole sign A~orney Cherof advised that there was an issue regarding this request. Mayor Broening advised that the applicant is supposed to present this item to the Commission at the meeting. A~orney Cherof advised that there isn't much room for deviation because of the way the notice w~s pUblished. That notice was published as a variance for height. Lowe's Home Center - Southwest corner of 1-95 and Woolbright Road - Request for relief from the City of Boynton Beach Land Development Regulations, Chapter 23, Article 11.(A)(7) which limits the maximum number of driveways along a single street to two (2), to allow a total of three (3) driveways Lowe's Home Center - Southwest corner of 1-95 and Woolbright Road - Request for a height exception in accordance with the City of Boynton Beach Land Development Regulations, Chapter 2, Zoning, Section 4.F.1 to allow a five (5) foot increase from the maximum forty-five (45) foot height limit, or a 50 foot high roof feature at project entrance Carsrud - Southwest corner of NE 7th Street and NE 8th Avenue - Request relief from Chapter 2, Zoning, Section 5(D)(2)(a) requiring a minimum side (corner lot) setback of 25 feet, to allow a 10 foot side setback variance, or a side setback of 15 feet to construct a single-family dwelling M~ Hawkins reported that the Planning & Development Board denied Item #5. Ms. Byrne said this request was denied because there wasn't significant hardship and granting the variance would have impact on the adjacent properties. MEETTNG MTNUTES AGENDA PREVZEW CONFERENCE B(~YNTON BEACH, FLORIDA 6. NOVEMBER 29, 1999 Carsrud - Southwest corner of NE 7th Street and NE 8th Avenue - Request relief from Chapter 2, Zoning, Section 5(D)(2)(a) requiring a minimum rear setback of 25 feet, to allow a 10 foot rear setback variance, or a rear setback of 15 feet to construct a single-family dwelling Tl~e Planning & Development Board approved Item #6 because it is to the rear of the property arid presents much less aesthetic impact on adjacent properties. I I Attorney Cherof advised that he did not see where either of these two requests supports a h~rdship, and knowing that, they both should be denied. What was presented to the Planning &Development Board did not establish a hardship. The applicant must establish a hardship arid the hardship must be that the property cannot be developed. meg Cherof recommended that the applicant be contacted and advised that he should be prepared to make a presentation about the hardship issue. WI W, A~ th~ len Ms. Byrne said the property owner is committed to building on this lot, Commissioner ;iland said he would have to change his floor plan if he wants to build. :orney Cherof said the granting of variances should be as limited as possible since this is in CRA area. Authorize the Utility Director to proceed with a $12,000 repair of the Deep Injection Well MEETZNG MZNUTES AGENDA PREVZEW CONFERENCE BOYNTON BEACH,, FLOR.I:DA NOVEMBER 29~ 1999 Mr. Sugerman reported that this summer, leakage was found in the deep injection well. This goes down 3,600' into the ground. There are two ways to fix the problem. We could attempt t~ patch the leak at a cost of $12,000. We have a permit to do this work. Tf this doesn't work, v~ will have to pull the casing out until we get to the hole. We could then repair it and put it ack in place. That could cost $750,000. Although staff is hoping the "quick" fix will work, they wbuld like authorization for both types of repairs in the event the "quick" fix does not work. Attorney Cherof inquired whether there might be a product deficiency from the original installer o, could pressure have caused the hole? Mr. Sugerman advised that they are not sure, but thiey are alluding to the hole being caused by thunderstorms. Hr. Sugerman said he would investigate this further. Mw. Sugerman wanted the Commission to be aware of the fact that the "quick" fix would be a~empted at a cost of $12,000. However, if that does not work, the more expensive repair wguld be required. Tf the more expensive project were required, we would award a contract. Therefore, it would go back to Commission for award of that contract. lin V. Mr Ce sai ;cussion ensued about the wording of the agenda item and Attorney Cherof recommended 'ninating all wording after "$12,000". Approve the application of Mr. Crichett, President of Palm Beach Tours and Transportation, Tnc., for a Certificate of Public Convenience and Necessity :.
