Minutes 10-26-92MINUTES OF THE SPECIAL CITY COMMISSION MEETING HELD IN COMMISSION CHAMBERS, CITY HALL, BOYNTON BEACH, FLORIDA, ON MONDAY, OCTOBER 26, 1992, AT 5:30 P, M, PRESENT Arline Weiner, Mayor Lynne Matson, Vice Mayor Jose Aguila, Commissioner Edward Harmening, Commissioner Robert Walshak, Commissioner J. Scott Miller, City Manager James Cherof, City Attorney Shannon Burkett, Deputy City Clerk CALL TO ORDER Mayor Weiner called this special meeting to order at 5:30 P. M. to consider salary adjustments for employees for Fiscal Year 1992/93. City Manager Miller stated that the City imposed a contract through the provi- sions of F. S. 447 with the International Brotherhood of Firemen and Oilers {IBF&O) for 2% effective October 1, 1992 and 2% effective March 1, 1993 for Fiscal Year 1992/93. Earlier this year, the City Commission adopted a pay scale resolution and approved a 3% across the board increase for all General Employees {all employees not represented by a collective bargaining agreement, that being the IBF&O, Police Officers, Police Sergeants, Police Lieutenants, and Fire- fighters}. The City Manager's Office is recommending that the City Commission consider making a salary adjustment for the General Employees. City Manager Miller stated that the 2% and 2%, averaged out over the five and seven month period for Fiscal Year 1992/93, comes to about 3.18%. To equal that 3.18% and give the General Employees the same monetary remuneration percentage wise, since theGeneral Employees received a 3% pay raise October 1, 1992 and have been receiving that 3% since that time, City Manager Miller feels it unfair to roll them back to 2% and then propose to give them 2% effective March 1, 1993. He does not feel that the IBF&O should be making more than the General Employees. Therefore, to equalize the General Employees, he proposed to keep them at the 3%, which was effective October 1, 1992, and then give them an increase of .21% effective March 4, 1993. That would equate to an average of 3.18% for the twelve month period in Fiscal Year 1992/93 and would bring them in line with what was imposed on the IBF&O contract for the same Fiscal Year. City Manager Miller stated that the City has a collective bargaining agreement already signed and ratified with the Police Sergeants and Police Lieutenants and is still in negotiations with the Police Officers and the Firefighters. Right now he is looking at salary adjustments for the General Employees for Fiscal Year 1992/93. Motion Commissioner Harmening moved to instruct the City Manager that if the Sergeants and Lieutenants desire to reopen their contracts, that the City offer them a .21% increase {if that is the precise number}, effective March, 1993, and that they not be penalized for settling early. Commissioner Walshak seconded the motion. She explained that the City does not have this money at the present time, nor does the City know what the revenue source will be. She said this is a full percent over the 3% she originally agreed to. She stated that this Commission is mandating that the next Commission find funds for this money, without iden- tifying a revenue stream and withoUt knowing what the revenue stream will be. It seemed to her that since the City Commission had to raise taxes to get to the 3% this year, this Commission will be starting from a disadvantage next year. She hoped the Commission will be able to do what it set out to do without having to lay off more people or without having to raise taxes again in this City. A roll call vote was polled by Deputy City Clerk Shannon Burkett. The motion carried 4-1. Mayor Weiner cast the dissenting vote. Ho~ton Commissioner Harmening moved that the City Manager award the General Employees of the City, specifically those who are not part of a bargaining unit, the same as the IBF&O, as far as salary is concerned. Vice Mayor Matson seconded the motion. City Manager Miller explained that the contract consummated with the IBF&O gave them 2% effective October 1, 1992 and 2% effective March 1, 1993. Therefore, come October 1, 1993, they will be making 4% more than what they made October 1, 1992. However, that same analysis does not compare with the General Employees because they made 3% effective October 1, 1992. Come March 1, 1993, they will get .21%, which means that they will be making 3.21% for the Fiscal Year and, therefore, we would need to bring them up to 4.0% in October. Commissioner Harmening withdrew his motion. Vice Mayor Matson withdrew her second. Commissioner Harmening moved to let the Finance Department compute the differen- tial so that the General Employees receive precisely the same amount of money at the appropriate time as the IBF&O. Commissioner Walshak seconded the motion. City Attorney Cherof asked if it was the intent of that motion that at the end of the Fiscal Year the General Employees who are not part of the IBF&O are in parity with the IBF&O members. Commissioner Harmening said that was correct, and in addition to that, it should be structured in such a manner so it falls within that March time frame so they receive the same benefit at the same time. City Manager Miller advised that Commissioner Harmening's motion giving the General Employees the .21% effective March 1, 1993 was a good motion and will actually equal the IBF&O imparity for Fiscal Year 1992/93. Commissioner Harmening said that motion still stands. Vice Mayor Matson said her second still stands. A roll call vote was polled by Deputy City Clerk Shannon Burkett. The motion carried 4-1. Mayor Weiner cast the dissenting vote. MINUTES - SPECIAL CITY COHMISSION MEETING BOYNTON BEACH, FLORIDA OCTOBER 26, 1992 Commissioner Harmening stated for the record that he was never in favor of more than 3% and this 1% simply is $170,000 at the beginning of next Fiscal Year, which he did not feel that the governing body of this City at this point in time should obligate the future City Con~nission to absorb.
