CALL TO ORDER
Mayor Weiner called the Special City Commission Meeting to order
at 6:38 p.m.
1. ReceiDt of Nominating Petitions for March 10, 1992 General
Election
City Clerk Sue Kruse reported that in accordance with Section
2-42 of the City of Boynton Beach Code of Ordinances, the
following candidates have qualified for the March 10, 1992 elec-
tion:
District II
Lillian R. Artis
Oris W. Walker
Robert J. Walshak
District IV
David Scott Floering
Lynne Matson
Ail of the candidates have complied with the requirements.
MOtion
vice Mayor Harmening moved to accept the five candidates nomi-
nating petitions. Commissioner Aguila seconded the motion which
carried 5-0.
Proclamation of General Election
Mayor Weiner read the Proclamation of General Election. It was
announced that the Proclamation contains a list of the names and
addresses of the Polling Places in each Precinct. The voting
hours are between 7:00 a.m. and 7:00 p.m. on March 10, 1992.

Commissioner Matson raised a question regarding the Proclamation.
She pointed out that when the decision was made to amend the City
Charter, there was to be a stipulation that the person reside in
the District for a period of at least one year. In reading the
Proclamation, that stipulation was not evident. Commissioner
Aguila and Vice Mayor Harmening agreed.
Attorney Cherof explained that the Ordinance language does cover
the stipulation and read from the Ordinance as follows: "...so
long as the individual selected to fill the vacancy has resided
in the same District from which the original Commission member
resided for a period of not less than one year" and "A can-
didate must reside within the boundaries of said District for a
period of not less than one year prior to filing for office."
After hearing Mr. Cherof's clarification, it was agreed by the
members of the Commission that this language covers either
filling a vacancy or running for the first time.
Vice Mayor Harmening also stated his objection to the candidates
having to pay $130.50 to the State of Florida.

Beautification Grant ADDltcation to FDOT for Boynton Beach
Boulevard
Motion
Commissioner Aguila moved to remove Resolution No. R92-25 from
the table. Commissioner Matson seconded the motion which carried
5-0.
Commissioner Aguila stated he is comfortable going fOrward with
this.
City Manager Miller said the title page will be redone and sub-
mitted with the Resolution to the FDOT.
Motion
vice Mayor Harmening moved to adopt Proposed Resolution R92-25.
Commissioner Matson seconded the motion which carried 5-0.
