WHEREAS, the City Commission of the City of Boynton beach, upon recommendation of staff, deems it to be in the best interests of the citizens of the City of Boynton Beach to authormze and direct staff to apply for Phase 6, Palm Beach County Roadway~Beautification Grant; and WHEREAS, this grant request is to continue landscape/irrigate the five (5) medians on Hypoluxo Road located between Congress Avenue and East to High Ridge Country Club entrance road, and requires a 50/50 match between the City of Boynton Beach and Palm Beach County in a yearly phasing program. Grants Advisory Committee Page 1 .of 8 Instructions 1. ROLE OF KEEP PALM BEACH COUNTY BEAUTIFUL AS GRANT ADMINISTRATORS: Since 1994, Keep Palm Beech County Beautiful, Inc. (formerly Beautiful Palm Beaches, Inc.), a 501(c)(3) non-profit, volunteer-based organization, has been designated by the Palm Beach County Board of County Commissioners (BCC) and the Metropolitan Planning Organization (MPO) as program coordinator to facilitate the administration of this annual grant application process. The purpose is to assist with the allocation of designated landscaping funds to beeutify state and county designated thoroughfares. The MPO is the agency that is responsible for allocation of Fiodda Dept. of Transportation (FDOT) funds for state transportation projects in Palm Beach County. KPBCB will conduct a meeting to answer questions about the grant application and process as stated in the enclosed cover letter. Attendance is not mandatory and is for assistance to applicants only. Please review the application carefully pdor to the meeting. The KPBCB Grants Advisory Committee is comprised of KPBCB Board Member volunteers who are professionals in the fields of landscape architecture, horticUlture, forestry, and engineering. 2. ORGANIZATIONAL BACKGROUND OF KEEP PALM BEACH COUNTY BEAUTIFUL: Beautiful Palm Beaches, Inc., a grass-roots volunteer-based organization formed in 1988, received certification in 1994 as Palm Beach County's affiliate of Keep America Beeutiful, Inc, and Keep Florida Beeutiful, Inc. The organization was renamed Keep Palm Beach County Beautiful, Inc. in early 1999. The non-profit organization is dedicated to facilitating public/private partnerships to improve the quality of life in Palm Beach County through environmental education programs and projects thai: CLEAN IT UP, FIX IT UP, and KEEP IT UP. One CLEAN IT UP project sponsored locally by KPBCB, is the "Great Amedcan Cleanup", which is conducted by Keep America Beautiful affiliates across the country in April. This volunteer cleanup event, coordinated by KPBCB with assistance from the Solid Waste Authority (SWA), has resulted in approximately ten million pounds of litter, trash and tires being collected by volunteers Over the past five yeers from Palm Beach County's roadways, parks, neighborhoods and waterways. KPBCB also coordinates Palm Beach County's participation in the Center for Madne Conservation's Flodda Coastal Cleanup each September. In 1995 and 1996, the organization jointly coordinated Project E.A.G.L.E. (Enhancing A Groat Living Environment) along with the Florida Game & Fresh Water Fish Commission to clean four recreational lakes. FIX IT UP projects includes the Palm Beech County Thoroughfare Beautification Grant program: The KEEP IT UP portion of KPBCB's mission is ensured through requirements for the continued maintenance of beautification projects. KPBCB also helps to KEEP IT UP through ongoing litter abatement programs: KPBCB initiated and facilitated the implementation of Palm Beach County's "Adopt-A-Highway" (state roads) and 'Adopt-A~Road" (county roads) programs, in 1995, KPBCB introduced the · Adopt, A-Street" program to the county's municipalities for local streets. In 1997, KPBCB took over administration of the Adopt-A-Shore program in Palm Beech County. KPBCB programs attempt to instil community pride and a sense of ownership to ensure effective long-term results. GRANT INFORMATION AND REQUIREMENTS: This application process is used to apply for state Metropolitan Planning Organization (MPO) matching grant funds and county Board of County Commissioners (BCC) matching grant funds. Distinctions in qualification criteria for the two types of funding are noted throughout. SOURCES OF FUNDING In 1994, Keep Palm Beach County Beautiful, Inc. (KPBCB) facilitated the budgeting of a new funding source through the Palm Beach County BCC (Board of County Commissioners) and the MPO (Metropolitan Planning Organization) to assist in 'the beautification of state and county thoroughfares throughout Palm Beach County. Since its inception, this grant program has enabled approximately $7 million in thoroughfare beautification projects to be implemented with leveraged funds. Applicants must be al: enter into grant contractual agreements and must meet requirements regarding insurance, maintenance, etc. GRANT AMOUNTS There is no pre-established maximum amount that may be requested; however, conservative requests may receive more favorable consideration. The total amount of grant funds available for this grant cycle was unavailable at the time of the pdnting of this application. MULTIPLE APPLICATIONS Applicants may submit multiple applications requesting grant funds for vadous projects, whether requesting state MPO or County BCC grant funding. However, Applicant must include a statement from Appl!cant's authorized executive officer that Applicant is prepared to immediately fund, implement,~ and maintain all projects submitted if grant funding is approved. ELIGIBLE I INELIGIBLE COSTS The guidelines below' correspond with the "Summary of Project Costs" charts within the application to be completed by Applicant: 1. Vegetation Materials (trees, shrubs, ground cover). State MPO and County BCC: eligible as either Applicant's grant request or match. 2. Installation: Labor & Planting Materials (mulch, planting backfill, stakes, etc.). State MPO and County BCC: eligible as either Applicant's grant request or match. 3. Irrigation System (labor & materials: square foot basis). State MPO and County BCC: supportive irrigation for the project landscaping is eligible as either Applicant's grant request or match, so long as the irrigation system does not exceed 75% of the Total Project Cost. Water by Truck During Installation (labor &materials). ' State MPO and County BCC: eligible as both grant request and Applicant's match. Authorized Sidewalk Cuts I Removal (labor & materials). State MPO: Where permitted by the regulatory authority has jurisdiction, expenses directly related to the cutting and remOval of portior~s of existing sidewalks for the spe, purpose of planting trees, etc. are eligible as either Applicant's grant request or match. State MI=O: eligible as either Applicant's grant request or match so long as they are a minor design element to enhance the landscaping (the combined total cost for tree grates, decorative paving, and landscape accent lighting may not exceed 40% of the total project cost). County BCC: not eligible as either Applicant's grant request or match. 7. Decorative Paving' (labor & materials). State MPO: eligible as either Applicant's grant request or match so long as they are a minor design element to enhance the landscaping (the combined total cost for ~ee grates, landscape pavers, and landscape accent lighting may not exceed 40% of the total project cost). Establishment Period Maintenance by Installing Landscape Contractor (labor and materials - maximum one year). State MPO: Maintenance costs for a maximum of one year after installation are eligible as Applicant's match or grant request when Applicant has a co~ntractual agreement with the installing landscape contractor to perform all maintenance / replacements as necessary dudng the establishment period. 11. Design Fees (maximum 10% of total project cost). State MPO: Design fees by the registered Landscape Architect of record are eligible as either'Applicant's grant request or match, not to exceed 10% of the total project cost. County BCC: Design fees are not eligible as Applicant's match or grant request. 12. Other (identify). State MPO and County BCC: Traffic control (maintenance of traffic) expenses directly related to the instal;aflon of the landscape beautification project, as well as utility connection fees or impact fees are eligible as Applicant's match, but not eligible as Applicant's grant request. Expenses related to any of these items shall be specifically identified under the "Other" section of the "Summary of Project Costs" chart. Miscellaneous: Costs for permits, construction administration, continuing annual maintenance after the establishment pedods described above and litter control are not eligible as Applicant's grant request or match. County BCC: All materials, labor, and establishment period maintenance costs (up to 6 months) itemized as a grant request or as Applicant's match (whether provided as in-kind services I materials or provided using other allowable grant sources or paid as cash by Applicant) must be costs related to 'softscape' landscape items such as vegetation, supportive irrigation; mulch, planting soil backfill, top soil, fertilizer, tree staking, etc. "Hardscape' items, (other than the previously desc4tbed provisions for tree grates, decorative paving, and landscape accent lighting), shall not be eligible as either Applicant's grant request or match for either State MPO or County BCC funding. This shall include the demolition or construction of item.s such as sidewalks, roadway curbs, fences, wells, fountains, sigr~age, etc. However, these "hardscape" items may be shown on applicant's construction documents only if clearly distinguished on plans and in budgets that they are not to be included as a part Of Applicant's grant request or match. The height of all fences or walls must be indicated on construction drawings. ~ .. Costs for site pre_p,a,,,ration, removal of exotic plants, clearing and grubbing, earth moving or fill (to raise grade level)~are not eligible as Applicant s grant'request or match for either State MPO or County BCC funding. The enhancement of older, existing landscape projects with additional landscaping is encouraged. GRANT MATCH I COST SHARING This grant requires a minimum 50% match by applicant. Favorable consideration is given in the evaluation process to applicants providing a match in excess of 50%. The following items qualify as allowable grant matches: The uses of in-kind services, including donated materials and labor, may be applied toward applicant's mat=h. Documentation of in-kind services will be required prior to reimbursement. County BCC grants match: depending on their specific requirements, municipal, state and federal funds can match county BCC grants. 'County BCC funds from sources other than allocated mad program funds may be used as Applicant's match. However, in no case shall county BCC grant funds from this program and state MPO grant funds from this program match each other. State MPO grants match: depending on their specific requirements, municipal, county, and federal funds can match state MPO grants. However, in no case shall county. BCC grant funds from this program and state MPO grant from this program match each other.* MAINTENANCE Applicant must provide (or arrange for another entity to provide) a commitment for the perpetual care of installed landscape projects dudng and after the contractors warranty period. LITTER CONTROL In addition to the perpetual maintenance of the landscaping, successful Applicants, in accepting the grant, shall become entirely responsible for perpetual litter control of the entire project area on an as-needed basis. Application package shall include a description of Applicant's litter control plan including budgeting for staff labor (or plans for volunteer labor), plus related expenses for trash disposal and supplies including bags, gloves, safety vests, etc. As this obligation of successful grant recipients greatly exceeds the commitment of participating volunteer groups in FDOT's Adopt-A-Highway program and Palm Beach County's Adopt-A-Road program, existing or future participants in'these adopting programs shall be considered as an assist, but not a replacement, for Applicant's obligation. All labor for the litter control effort, whether paid or volunteer, shall comply with all safety standards of FDOT and Palm Beach County. Please be aware that volunteers are restricted by these standards (i.e. minimum age of volunteers, access to medians, etc.) "TREES ONLY" PROGRAM In January 1996, the BCC approved the installation and maintenance of trees in designated roadway medians in unincorporated areas by Palm Beach County. Such bees will be installed under a.separate program, referred to as the "Trees Only" program, which is unrelated to this grant program administered by KPBCB. If enhanced landscaping in addition to trees is desired, this constitutes a project that may apply through KPBCB's grant process. In this case, applicant must maintain the entire landscape area (including any previous-landscaping). If applicant's project is on a County thoroughfare in . unincorporate~l PBC, contact PBC Engineering at (561) 684-4030 for complete details regarding maintenance obligations'~--'~ for additional information on the separate tree planting program. UTILITIES To be eligible, it is required that all grant applicafi*ons include letters of approval on letterhead from all utility companies whose underground or overhead lines are located in planting areas. Letters shall be insufficient unless they demonstrate that the utility has reviewed AppScant's final planting plan, species selecUon, maintenance schedule, etc. and has no objec~ons to the projecL Utility letters must refer to the issue or revision date of the plans that they have reviewed. For FPL approval, contact M ark Heffiey of the FPL Vegetation Management Dept. at (561) 640-2246. If letters from utility companies are not received in time for inclusion in the completed grant application package, the application must provide documentation of phone.calls or meetings with utility company staff (include dates and names with tYdes of utility representatives). This documentation shall indicate that the utility has granted conceptual approval of the project, and the utility contact shall be copied on the documentation letter. SCHEDULE AND PROCEDURE, Grant applications are due as noted in the enclosed cover letter. After the review process is corn pleted by the KPBCB Grants Advisory Committee and their recommendatiOns are approved by the full KPBCB Board of Directors, KPBCB antici pates presentation of its recommendations to the BCC and MPO in the fall of this year. All applicants will be notified of approval status immediately afterward by KPBCB. Applicants approved to receive grant funds will then be required to enter into a reimbursable Grant Agreement con~=act which is administered and processed directly by the appropriate granting agency (Palm Beach County or the Flodda Department of Transportation), with the exception noted below. Applicants may contact the appropriate granting agency regarding their proposed Schedule for preparation of grant agreements for successful applicants and the availability of funds. Any applicant relinquishing grant funds for failure to perform according to this schedule will have future applications for grant funding penalized dudng the evaluation process. It is suggested that grant applications include a resolution from Applicant demonstrating commitment to proceed with the prompt implementation and maintenance of the project if grant funds are approved. The application must note if the proposed project can or cannot proceed if lass than the requested amount of funding is allocated. FDOT GRANT AGREEMENTS Please note that the Flodda Dept. of Transportation may only enter into Grant Agreements with governmental agencies. Therefore, although non-governmental applicants are encouraged to apply, the local governing agency (municipality or Palm Beach County), is required to become a party to the Grant Agreement process. This requirement may delay the implementation of such projects. Such Applicants may wish to solicit a letter of endorsement and intended cooperation from the local governing agency to be inctuded as a part of the application package. PAYMENT OF GRANT FUNDS Grant funds are paid on a reimbursable basis after project installation. A cerlfficafion of completion by the Landscape Architect of record is required for reimbursement from the granting agency. State MPO: Projects installed (or portion thereof] pdor to written authorization from FDOT will be ineligible for reimbursement. County BCC: Projects installed (or portion thereof) prior to written notification by KPBCB of fund allocation by the BCC will be ineligible for reimbursement. PROJECT MONITORING ProjeCt monitoring may indude periodic in.specfions and a post-audit by the granting agency. Following certification of acceptance by the granting agency, care and maintenance of the project will be subject to monitoring. KPBCB reserves the right tO comment to the BCC or MPO ! FDOT should project be observed to have poor installation and ! or maintenance. METRIC REQUIREMENTS Plans are no longer always required by FDOT to be designed using metdc measurements if the project is associated with a FDOT state road construction project as opposed to a stand-alone landscape project. Please consult FDOT regarding specific project requirements, as well as FDOT's transition back to English measurements initiated in October 1998. MULCH AND COMPOST SPECIFICATIONS Although the use of mulch is encouraged, Cypress mulch is prohibited on all stata-funded projects, with the exception of Cypress Grade B mulch as a by-product from milling of wood planks, etc. Altematives to Cypress mulch such as. recycled mulch, eucalyptus mulch, and melaleuca mulch are also encouraged for County-funded projects. KPBCB strongly encourages and will favorably consider the specification of a compost product for project installation and maintenance programs for grant projects. The Solid Waste Authority of Palm Beach County (SWA), produces a compost product from wastewater rasiduals and yard waste which may be available at no charge for certain types of projects. SWA's compost is recommended for use as planting soil backfill when mixed well with native soils (25% - 50% compost), and also provides good mulch cover. PROJECT REVISIONS Landscape planting plans that are submitted as a part of the application package must be 100% complete. Applicant's drawings and application package shall serve as a basis for approval for grant funding. Therefore, after the award of the grant, any revisions, other than for the following reasons, may be regarded as a SUBSTANTIAL CHANGE: KEEP PALM BEACH COUNTY BEAUTIFUL, INC, 1920 Palm Beach Lakes Blvd., Suite 210, West Palm Beach, FL 33409 TEL $61/686-6646 FAX 561/686-6642 Page 7 of 8 Instructions 1. Revisions to incorporate suggest[ens from KPBCB as a result of the grant application review process. 2. Projects re-phasing as a direct result of receipt of fewer grant dollars than requested under this grant program, ~..~ 3. Minor changes in design required by Palm Beach County or the Florida Dept. of Transportation during the permitting process. (Conceptual permitting before submitting grant application package is encouraged.) 4, Documented unavailability of specified plant materials at time of installation. 5. Modifications necessary due to unexpected underground field conditions. (Plans must document known underground utilities.) In any of the above situations, KPBCB plus the granting agency (BCC or MPO / FDOT) must be notified in writing by the proiect's Landscape Architect, of Applicant's desire to modify the approved application package. The request must dearly summarize proposed revisions, include revised construction drawings, and indicate all appropriate revisions to cost estimates for installation and maintenance. BCC or MPO / FDOT reserve the right to review any revisions to the landscape planting plans submitted subsequent to this application and make a determination whether such revisions constitute a SUBSTANTIAL CHANGE to the plans upon which the recommendation for grant funding allocation was based. Applicant's allocated funds will be subject to being relinquished if a SUBSTANTIAL CHANGE is so determined and such SUBSTANTIAL CHANGE does not have pdor written approval from both KPBCB and the granting agency. Submitted landscape planting plans must be 100% complete. Submission of irrigation plans is not a requirement with grant applications. However, landscape plans must note a guarantee that 100% irrigation 'will be provided by the applicant via an underground irrigation system, unless planting concept uses a totally xeric (drought tolerant) plant palette; is tolerant to harsh road conditions; and uses mulch and planting backfill of native soils. Submission of irrigation plans with application package is encouraged (although not required) to show the pmjecfs readiness to move forward and therefore improve its chances for recommendation. If non- xeric planting is proposed, irrigation plans will be required by the permitting agencies. Since "xeriscape" design groups plants by the level of water needed, many pants utilized in a "xeriscape' theme are not totally drought tolerant, so require some irrigation. Totally xeric (drought tolerant) plantings are difficult to sustain in highly trafficked urban streetscapes and will be carefully evaluated. A certification of completion by the Landscape Architect of record must be provided with the reque~st for reimbursement from the granting agency. Minimum requirements for plant stocks is Flodda Grade No. I or better and must be so specified on plans, as per Department of Plant Industries Grades & Standards (February 1998 edition). All plant species must be rated no greater than "slightly susceptible" to contagious diseases (such as lethal yellowing) by current accepted industry research literature. Applicant must document authorization to plant and maintain the project if the project is property owned or controlled by a~ entity other than the applicant. Ms. Willis: Pursuant to my conversation with Kevin Hallahan, the following proposal outlines the services to be provided by Kilday & Associates, Inc. in preparing final landscape plans for submittal to Palm Beach County Land Development Division, Department of Engineering and Public Works. This proposal includes planting plans for a total of eight (8) medians (_+3,500 L.F.) in the area described above, a streetscape.planting program including special pavers, planting specifications for' use by contractors, a cost estimate, and other services as described below. SCOPE OF SERVICES Kilday & Associates, Inc. will provide the following services on this project: One site visit to verify field conditions on site and in the vicinity of the project and inventorY the existing plant material to evaluate if certain species are allowable in locations within the clear sight zones as required by the Palm Beach COunty Streetscape Standards Manual. Preparation of base plans, resolution of base plan issues and general coordination of site details with the City, the County, and the project engineer,. 3. Preparation of a plant list and planting details and specifications for use by the landscape contractor. 7. Coordination meetings with City and County staff as necessary. This proposal does not include preparing of the irrigation design drawings. We have' contacted Dick Harrison, an irrigation consultant with whom we have worked with in the past, to solicit a proposal for this work. He Will forward a proposal to you directly. He estimates that his fee will be approximately $1,500.00. This proposal also does not' include assembly of landscape bid packages, assistance with bidding, or contractor selection, or field observation of landscape installation. We would be happy to provide these, or other services not included in the Scope of Services, at our hourly billing rates which are found below under the Additional Work portion of this proposal. TIME SCHEDULE Upon authorization by the client to begin landscape design, Kilday & Associates, Inc. will provide finalized landscape plans, details, and specifiCations within ten (10) business days. The above schedule assumes that Kilday & Associates, Inc. will be furnished with all necessary information and roadway plans by the client and notified in a timely manner of any changes. PAST DUE ACCOUNTS Outstanding accounts are considered past due after thirty (30) days from the date of the invoice and are subject to a 1.5% service charge on the unpaid balance. We shall have a lien on all of your documents, property or money in our possession for the payment of all sums due to us from you under the terms of this agreement. In the event it is necessary to institute suit against you for the collection of fees and advances due to us by you, you will pay, in addition to any judgement for such fees and advances, all costs and expenses necessitated thereby, including reasonable attorney's fees for the suit. Furthermore, in the event of any lawsuit as a result of'any provision hereof or the interpretation hereof or otherwise or in any way arising out of our professional relationship, if we shall be the prevailing party, then we shall be entitled to collect from you all costs and expenses necessitated by us in such litigation, including reasonable attorney's fees. ORIGINAL DRAWINGS Original drawings prepared by Kilday & Associates, Inc. shall remain the property of the same. However, reproducible copies of these drawings will be provided at cost upon the client's request. TERMINATION OF CONTRACT In the event that the client wishes to abandon the project prior to the fulfillment of those items listed under "Scope of Services," Kilday & Associates, Inc. shall, be reimbursed for all time spent on the project up to and including the day we are notified in writing to stop work.
