Adoption Meeting Minutes Regular City Commission Bovnton Beach, Flpri~l~ April 1, 2003 Motion Commissioner McCray moved that the two ordinances concerning Beck's Towing be moved up on the agenda immediately prior to the presentations. Motion was seconded by Vice Mayor Ferguson and carried unanimously. Motion Vice Mayor Ferguson moved to approve the agenda as amended. McCray seconded the motion that carried unanimously. Commissioner II. OTHER: A. Tnformational Ttems by Members of the City Commission Vice Mayor Ferguson said that since the City changed the Comprehensive Plan to allow a 150-foot height limit, there are many developers coming into the City. He thought that we should receive some incentives from them before the site plans come to the Commission. He was concerned regarding the infrastructure that needs to be in place as the downtown and the Marina projects come on line. Specifically, he was concerned regarding utilities, parking, the Library, traffic, the beach, the Senior Center, the Art Center, and police and fire services. He suggested that the developers donate some parking to the City. The City could then derive some income from it, not by charging the public, but perhaps from valet parking or from parking needed for festivals. He would like to earmark that income for housing, by subsidizing a few of the apartments downtown and by financing some of the residential development in the Heart of Boynton area. III. ANNOUNCEMENTS, PRESENTATIONS: COMMUNITY & SPECIAL EVENTS, & A. Announcements: Provide status report on supplies for Company D (Delta Demons) of 2nd Battalion, 327th Infantry Regiment of 101st Airborne Division, United States Army City Manager Bressner explained that the City recently adopted Company D of the 2nd Battalion. This military unit is currently deployed in [raq. City Manager Bressner reported that we have 56 care packages ready to be mailed. He announced that an anonymous donor, sitting in the audience tonight, donated $1,000 to defray shipping costs and he thanked the donor. He thanked all the citizens for their support. XII.B.3. City Attorney Cherof read proposed Ordinance No. 03-013 by title only. Motion Vice Mayor Ferguson moved to approve proposed Ordinance No. 03-013. Commissioner McCray seconded the motion. International Building Safety Week - April 6-12, 2003 Mayor Broening paraphrased the above proclamation and proclaimed April 6-12, 2003 as International Building Safety Week. b. Arbor Day - April 25, 2003 3 Meeting Minutes Regular City Commission Bovnton Beach, Florida April 1, 2003 Mayor Broening paraphrased the above proclamation and proclaimed April 25th as Arbor Day. c. Boynton Bay Apartments - Tribute Mayor Broening paraphrased the above tribute to Boynton Bay Apartments. He explained that this is a privately run enterprise and serves as a model. :It is a high quality community. d. National Library Week - April 6-12, 2003 Mayor Broening read the National Library Week proclamation. Valerie Pleasanton, Chair of the Library Board, said that the Library is not only a place to read a book, but a resource for writing a thesis, preparing a resume, or finding the latest child care information. Maryann Tara, President of the Friends of the Boynton Beach City Library, said that libraries have always been places for education, self-help, and life-long learning. Today, they provide computers, ]:nternet access, and databases. Virginia Farace, Finance Director, presented mementos to the Commission. e. Fair Housing Month - April 2003 Mayor Broening paraphrased the above proclamation and proclaimed April as Fair Housing Month. f. Month of the Young Child - April 2003 Mayor Broening paraphrased the above proclamation and proclaimed April 2003 as the Month of the Young Child. g. Parents' and Children's Day Mayor Broening paraphrased the above proclamation and proclaimed April 6, 2003 as Parents' and Children's Day. 2. Presentation to Boynton Beach Community High School Boys Basketball Team 4 Meeting Minutes Regular City Commission Bovnton Beach, FIQrida April 1, 2003 City Manager Bressner announced that the basketball team was this year's district champions, conference champions, regional champions, and state runner-up. He congratulated the team. Commissioner McKoy said that he traveled on the City chartered bus to both games and commended the community on how they supported the team. He was very proud of the team and the cheerleaders. Mayor Broening was very proud of the people who went up on the bus and of the team on the field. He thought they demonstrated a lot of class. City Manager Bressner presented certificates to coaches. He also presented a plaque to the school. their donation of the plaque. members of the team and their He thanked Manhattan Trophy for The members of the team were: Horace Glenn, Dionte Perry, Brian Macon, Dave Noel, Johnny Stephene, Donald Orelus, Baxter Grisby, Pernell Davis, Richard Koonce, Gary Bryant, Alvin Reddick, Lester Alexander, Fritz Jean, Jacob Bell, and Tristan Wade. The coaches were: Brad Flaig, Kirk Howie, Brian Coe, Drew Quinn, and Marcus Singleton. Dr. Walter Cornnell, Principal of Boynton Beach Community High School, thanked the City for recognizing the athletes. He said that the team included students in good standing and students who will be in the first graduating class at the school. City Manager Bressner announced that there would be a picnic at Veterans Park to honor the team on April 12m from 11:00 a.m. to 2:00 p.m. Paul Raffa from McDonald's Restaurant announced that Dave Noel was nominated to McDonald's All American Basketball Team. City Manager Bressner recognized Mike Leeds, Athletic Director at Boynton Beach Community High School, and thanked him for his collaboration with the City. IV. Commissioner B.2. Authorize the Library Director to negotiate a contract with the #1 ranked architect/engineering consultant, Schenkel and Schultz Architects, Inc. of West Palm Beach, FL, to provide architectural/engineering services for the Library Expansion/Remodel Herb Suss felt that it was imperative that the Commission moves forward with the architectural services and provides Library services to all the citizens. Mike Friedland spoke in favor of this item. The Library expansion is needed and he urged the Commission to approve it. Maryanne Tara spoke for the Friends of the Library. She requested that the Commission approve the negotiations so that they can complete the plans by December 2003 and secure the State grant. She felt that the Library expansion is desperately needed. Brian Edwards, 629 NE 9th Avenue, was in favor of the expansion and supported the project. Beverly Agee, 832 SW 33rd Place, thanked Commissioner McCray for her reappointment to the Education Advisory Board. She supported the Library expansion and thought that the statement of any city's worth is its Library. Valerie Pleasanton, 235 SW 13m Avenue, felt that it was important that this City act as a team. Several years ago, when the Visioning process began, the Library expansion was one of the issues. They previously had a plan to build out west but found that it would be more cost effective to expand at the present site. Ms. Farace worked years on this. :If the Commission does not vote to go ahead immediately, we will lose the $500,000 State grant. She thought that the Commission should let the negotiations begin and then decide on how to fund the project. 11 Meeting Minutes Regular City Commission Bovnton Beach, FIQridp April 1, 200,~ Warren Timm, questioned why there was no maximum amount stated for the negotiations. City Attorney Cherof explained that there is no set maximum amount. ]It will be negotiated and then the contract will return to the City Commission for approval or disapproval. Commissioner McCray asked staff whether we would be ready by December 23rd if we authorize negotiations tonight. Ms. Farace was hopeful that the contract would be back to the Commission in two weeks and that the deadline of December 23rd could be met. Motion Commissioner McCray moved to approve item B.2. motion that carried unanimously. Vice Mayor Ferguson seconded the City Attorney Cherof requested another motion from the Commission to accept the ranking that the Committee gave the applicants. Motion Commissioner McCray moved that the rankings be accepted. seconded the motion that carried unanimously. Vice Mayor Ferguson C.11. Proposed Resolution No. R03-057 Re: Building Division Fee Schedule Modification to the existing Vice Mayor Ferguson was not in favor of the increase in the minimum permit fee from $35 to $50, the increase in the reinspection fee from $25 to $40, or the increase in the Building Board of Adjustment & Appeals fee from $100 to $200. He had no problem with the remaining fees. Motion Vice Mayor Ferguson moved to approve all but those three fees. City Attorney Cherof suggested that the Commission make a motion to approve the agenda item and then make a second motion to amend the approval to reflect the fees Vice Mayor Ferguson suggested. Motion Vice Mayor Ferguson moved to approve item C.11. motion that carried unanimously. Commissioner McKoy seconded the 12 Meeting Minutes Regular City Commission Bovnt0n Beach, Florida April 1, 200,~ Motion Vice Mayor Ferguson moved to amend the approval to keep the minimum permit fee at $35, raise the reinspection fee from $25 to $35, and keep the Building Board of Adjustment & Appeals fee at its present level of $100. Don Johnson, Building Official, explained that they conducted a survey of the surrounding municipalities and obtained the following information: Municipality North Palm Beach Greenacres Delray Beach Highland Beach Wellington West Palm Beach Palm Beach County Minimum Permit Fee Reinspection Fee $40 $40 $40 $40 $41.90 plus $20.35 $25 for each inspection $35 $5o $5o $5o $51 $30 $5o $45 He explained that they used a fence permit as an example of a minimum fee permit and when they calculated staff's salary for the intake procedure, review, issuance of permit, inspection, and preparation for scanning, the typical amount was $47.25 so they rounded it off to $50 for a minimum permit fee. Regarding the Building Board of Adjustment & Appeals fee, they calculated staff time to assemble the Board, process the application, set up the Commission Chambers and meet with the person who challenges the code and the cost was approximately $189. Mayor Broening commended Mr. ~lohnson and his professional staff. He recently went through the permitting process for a reroof and feels that it was money well spent. He would suggest a roll back to the actual cost. Mr. 3ohnson said that the calculations for a minimum permit were based on a fence permit; however, a roofing permit would require more than one inspection. City Manager Bressner asked Mr. Johnson what the actual cost of a reinspection is and Mr. 3ohnson responded $40. City Manager Bressner reported that the cost of service for permits was more than revenues and tax dollars were subsidizing permit holders. The Building Division should be self-sustaining. Commissioner McCray seconded the motion to amend the approval. 13 Meeting Minutes Regular City Commission Bovnton Bepch, FIQrida April 1, 2003 Mayor Broening felt that the Iow minimum permit fee was an incentive for people to get permits to fix up their property. On the other hand, federal and state money is dwindling so he had a dilemma. Vote The motion to amend the approval carried unanimously. VI. CODE COMPLIANCE & LEGAL SEI'FLEMENTS: None VII. PUBLIC AUDIENCE: INDIVIDUAL SPEAKERS PRESENTATIONS WILL BE LIMITED TO 3-MINUTE Terrence Rothman, homeless, spoke regarding the war in Iraq and requested that the City fund a position for a peace worker at $3,600 per year. Bob Brown said that two weeks ago he understood that the City Manager offered to have the trash by his property picked up. It appears that the Public Works Department and the City Manager believe that his environmental permit does not allow him to clear the road right-of-way. He stated that his permit of September :[0, 2001 allowed him to clear this right-of-way. The Public Works Department picked up one pile of debris and he thanked the City. There is still one pile on the east side by the road right-of-way. Public Works informed him that he would be responsible for the remainder of the debris so he contracted with a firm to haul away the trash. He asked for clarification whether he could proceed with his environmental permit to clear the road right-of-way. Brian Edwards, 629 N.E. 9th Avenue, spoke regarding the stormwater project. He said that after five years of working on the drainage project, it only took 15 minutes for one man to talk the Commission into tabling this eminent domain issue. At the next Commission meeting, neighbors will be here in full force to ask for the Commission's support of the eminent domain, as they are ready for the stormwater project to get underway. Lori Wilkinson, 2458 SW Cranbrook Drive, spoke on behalf of the Advisory Board on Children & Youth. Last week, the Board took a field trip to Club 505, which is a teen center on Federal Highway in Delray Beach. She thanked Commissioner McKoy for joining them. Their facilities include seven or eight computers networked to the Internet, a lounge area with a TV and VCR, pool tables, ping-pong tables, board games, and basketball courts. The club was packed and was very well run. UNFINISHED BUSINESS: Commissioner McCray announced that he requested a six-month evaluation of City Manager Bressner. He also said that elected officials are administrators and do not need to receive clearance to go into any department. He was perturbed with staff because they think they can tell Commissioners what to do. As a policy maker of the City, Commissioner McCray wanted to be treated with respect. Mayor Broening responded that, according to the Charter and a long-standing policy, the City Manager and the City Attorney are the only members of City staff that the Commission is authorized to have contact with. City Commissioners cannot make demands of departments except through the City Manager or the City Attorney. Regarding the City Manager's appraisal, Mayor Broening said that he does not wait a year to appraise someone. There is constant feedback on a day-to-day basis. He wrote a letter to City Manager Bressner, dated February 24, 2003, expressing confidence in our staff and he requested that it be entered into the public record. Box 310 Boynton Beach, Florida 33425 Dear Mr. Bressner: It gives me great pleasure to announce that Janet Prainito, CMC, City Clerk of the City of Boynton Beach, Florida, has been accepted into the IIMC Master Municipal Clerk Academy. The Master Municipal Clerk Academy Program encourages Municipal Clerks to continue their professional growth and development. The program honors and salutes continued high-level achievement beyond the attainment of the prestigious Certified Municipal Clerk award. It is not easy to obtain entry into the Academy. Candidates must complete graduate work at IIMC approved municipal clerks institutes or prove similar advanced educational attainment. Professional participation must also be demonstrated such as leadership in professional associations, committee work, conference attendance and professional writings and achievements. There are four levels of membership in the Academy: entrance, first, second and third levels. Academy Members need to apply for membership in each continuing level every two to four years in order to remain active. Upon completion of all four Academy levels, members will be granted the Master Municipal Clerk (MMC) designation. From IIMC's 10,300 active membership records, only 1,425 Municipal Clerks have reached this goal. I cannot express my enthusiasm too greatly for this milestone that Ms. Prainito has reached in her career.
