O90-29 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 ORDINANCE NO. 90-~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 13, OCCUPATIONAL LICENSES; PROVIDING FOR APPLICABILITY; PROVIDING FOR REGISTRATION AND REGULATORY FEES; PROVIDING FOR APPLICATION FEES; PROVIDING FOR REINSPECTION FEES; PROVIDING PROCEDURES FOR ISSUANCE; PROVIDING FOR EXEMPTIONS; PROVIDING FOR NEW CATEGORIES OF OCCUPATIONAL LICENSES AND FEES THEREFORE; PROVIDING FOR INCREASED FEES FOR CERTAIN EXISTING CATEGORIES OF OCCUPATIONAL LICENSES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; WHEREAS, the City Commission last adjusted Occupational License Fees in 1985; and WHEREAS, the current Occupational License Fees do not include fees for certain categories of business activity currently operating in the City; and WHEREAS, Occupational License Fees levied at graduated or per unit rates are lower than Occupational License Fees levied on such activities in surrounding municipalities; and WHEREAS, the City Commission finds, based upon an administrative study of Occupational License Fees in surrounding municipalities that the additional categories and increases set forth in this Ordinance are reasonable and customary fees; and WHEREAS, the City Commission, based upon recommendations of the administration, desires to make other substantive amendments to the Occupational License provisions of the City Code; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. Chapter 13, Article I, Section 13-1 of the City Code is amended to read as follows: Section 13-1. Page 1 of 8 occupation engaged in or managing any business, profession, or occupation within the City hav~ng-a bus~ness-kocat~on-or-braneh-w~th~n-the-C~ty7 in the respective amounts set forth in Section 13-22 of this Code. The amount of such tax specified shall be on the basis of one (1) year. The Occupational License authorized herein does not mean any fee or license paid to any Board, Commission, or officer for permits, registration, examination, or inspection. Section 2. Chapter 13, Article I, Section 13-2 (reserved) is amended to provide new language as follows: Section 13-2. Registration and Regulation. (a) Reserved. Contractors who are holders of a valid Countywide Municipal Contractor's License, in addition to a Palm Beach County Occupational License, shall be required to register, show proof .of the Countywide MuniciDal License and pay a registration fee of $2.00. Contractors who are not holders of a valid Countywide Municipal Contractor's License shall be allowed to register and the fee schedule shall be set forth as follows: See Exhibit "A" (c) Nothing contained in this Chapter shall prohibit the City from charging and collecting regulatory fees as permitted by Chapter 166.221, Florida Statutes. (d) Nothing contained in this Chapter shall relieve a business, profession or occupation operating from a residential location within the City from complying with the City's home occupational license requirements Section 3. Chapter 13, Article I, Section 13-3(a) of the City Code is amended to read as follows: Section 13-3(a) Before the City shall be required to issue a license for engaging in or carrying on any of the businesses or professions or occupations specified and set forth herein, it shall be the duty of the applicant to file an application with the City, such application to be on a ~-~he form prescribed ~e~e~ by the City~ CODING: Words in s~e~-~h~e~h type are deletion from existing law; Words in underscore type are additions. Section 4. Chapter 13, Article I, Section 13-3 is amended to add subsection (c) as follows: (c) Each new application for occupational license shall be accompanied by a initial and one time application filinq fee in the amount of $40.00, which shall cover the initial inspections and review undertaken by the Building Department. In the event an application is denied due to failed inspections, the application may be reconsidered followinq reinspection by the City. The applicant shall pay a $10.00 reinspection fee to the City in such cases. Section 5. Chapter 13, Article I, Section 13-4 of the the required tax and conditions required for City Code is amended to read as follows: Section 13-4. Issuance. (a) Upon payment of compliance with all issuance of a license, the City Buildinq Official or his designee e~y-~ shall issue to the person paying the same, a license e~%y-~~. The issuance of licenses pursuant to'section 13-22(492) is not intended to repeal, abrogate or impair any additional requirements imposed upon rentals by any community association, homeowners' association or condominium association which is authorized under state law. Whenever a license cannot be issued at the time the application for same is made, the City Buildinq Official or his desiqnee shall issue a receipt to the applicant for the money paid in advance, subject to the followinq condition: Such receipt shall not be construed as the approval of the City License Officer for the issuance of a license; nor shall it entitle or authorize the applicant to open or maintain any business contrary to the provisions of this Ordinance. Section 6. Chapter 13, Article I, Section 13-10 of the City Code is amended to read as follows: Section 13-10. on variable knowledge. Each applicant subject to the requirements of this section shall be required to execute an Affidavit in a form prescribed by the City updating the information upon which the license fee is calculated when requested to do so by the City. Such form shall be completed, executed and returned to the City within fifteen (1~5) business days followinq receipt of request from the City. Section 7. Chapter 13, Article I, Section 13-18(a) of the City Code is amended to read as follows: Section 13-18(a). Exemptions. Disabled veterans of the Spanish-American War, World War I, World War II, and the Korean War, or the Vietnam Conflict all confirmed cripples, blind, deaf and dumb persons and invalids physically incapable of manual labor, widows with minor dependents and persons sixty-five (65) years of age or older, shall be allowed the same exemptions as such persons are now or shall hereafter be entitled to by.law in connection with state and county licenses. Section 9. Chapter 13, Article I, Section 13-22 of the City Code is amended to include the following new categories of businesses requiring Occupational licenses and the fee for such license: See Exhibit "B" Section 10. City Code is amended following existing occupational licenses: See Exhibit "C" Section 11. Registrations in entirety.
