Chief William Bingham and the Fire Department Color Guard presented the flag for the Pledge

A. Informational Items by Members of the City Commission
Commissioner McCray reported that City Manager Bressner, Commissioner McKoy, the Grant
Team, and he attended an Innovations Group Conference in Piano, Texas. He was grateful for
the experience and felt that the City of Boynton Beach should be commended for doing so
many things right.
Commissioner McKoy added that there were many educational workshops that they attended
during the conference and he was looking forward to implementing some of the ideas that they
learned for the betterment of the City.
Mayor Broening commented that the Innovations Group is a professional, municipal
organization. He agreed that Boynton Beach is a progressive City with lots of good ideas and
he thanked the two Commissioners for attending the conference.

a. "Code Enforcement Officers' Appreciation Week" - ~lune 2-7, 2003
Mayor Broening read the Code Enforcement Officers' Appreciation Week proclamation and
presented it to Scott Blasie, Code Compliance Administrator. Mayor Broening also thanked the
Code Compliance Board for the work that they do.
2. Sculpture Presentation by Firefighter 3 Paramedic Ray Altman
William Bingham, Fire Chief, said that 343 firefighters, hundreds of policemen, and thousands of
citizens lost their lives at the World Trade Center on September 11, 2001. Fire Chief Bingham
explained that Firefighter 3 Paramedic Ray Altman created a sculpture entitled "The First
Responder." It lets you see the impact of 9-11 through Ray's creative eyes and serves as a
memory to those lives lost on 9-11. It also reminds us that over 100 firefighters and hundreds
of other public servants die in the line of duty each year in the United States.
Ray Airman explained that he was on duty in Boynton Beach on September 11, 2001 when the
first plane hit the World Trade Center. As he and his coworkers watched the towers begin to
fall on T.V., there was conversation regarding building construction, fire behavior, medical
treatment, and technical rescue. These are the things firefighters talk about, but what they will
not speak of is the pain and the unspeakable number of people that perished that day.

Mr. Airman created this sculpture of the First Responder to manifest the things that firefighters
feel but cannot talk about. He hoped that when people looked at the sculpture they would see
the commitment and sometimes the ultimate sacrifice that is made. He dedicated this sculpture
to members of the fire service - his brothers and sisters and explained that it would be
displayed for the next two months in City Hall.
3. Presentation of donation to Laura Lassman, President of Play for T.T.M.E.
(Technology, Zmmediate Diagnosis, Mammography, Effective
Treatment), on behalf of The Links at Boynton Beach, the Ladies & Men's
Golf Associations, and the players
Dan Hager, Head Golf Professional, explained that this was the third year that the Golf Course
was involved in the breast cancer research fundraiser, and he presented a donation of $7,559
to Laura Lassman, President of Play for T.T.M.E.
Laura Lassman said that she and her husband lost their son on 9-:~1. She thanked all the
firemen and rescue workers who worked so tirelessly after 9-11. Ms. Lassman thanked the
Mayor, Commissioners, and everyone at the Links at Boynton Beach for their generous
contribution towards breast cancer research. She explained that last year Play for T.:[.M.E.
donated $1 million to breast cancer research. She said that they are a volunteer organization.
There are no salaries and 100% of this money goes to research
4. Presentation of Banner by 3eanne Heavilin, President, Greater Boynton
Beach Sister Cities, Tnc.
Jeanne Heavilin, President of the Greater Boynton Beach Sister Cities, Tnc., and Board members
presented the banner that was given to the delegation when they went to Qufu, China last
year. She gave an update on the Sisters Cities program in Boynton Beach. They formed a
steering committee and are exploring economic development, partnerships, and educational
and cultural exchanges to help our communities understand their cultural differences. They are
a not-for-profit Florida corporation. She introduced members of the Board. They are Chris
Francois, Bob Ensler, Diane Mower, .lim Williams, Stormet Norem, Dan DeCarlo, Dale Sugerman,
Anne Centi, and Mayor Broening. Ms. Heavilin reported that a delegation from Qufu visited
Boynton Beach and our delegation participated in a trade show there. She expressed her
appreciation for the support the City has shown for this program.
5. Recognition of Police Athletic League Track Team - State Championship
(7-14 Year Age Group)
Commissioner McCray was happy to recognize the members of the Boynton Beach Police
Athletic League 2003 Track & Field Team and Coach Clyde Harris. Tn May they participated in
the Florida Association of PAL State Championship track and field events in Jacksonville. During
the competition, they participated in 44 events and received 35 first place medals. The team
also won the first place trophy for team competition. This was the fourth year that they won
this competition.

Officer Bill Tome said that five years ago Coach Harris went to the competition with 20 kids and
won third place. Now, for the past four years, they are the Track & Field champions.
Coach Clyde Harris congratulated the team and presented certificates to members. A list of
members' names is marked Exhibit A and is on file in the Office of the City Clerk. He also noted
that one of the team members, a junior at Santaluces High School, is not only an outstanding
runner but also a scholar with a G.P.A. of 4.0, and she has been contacted by many colleges
including three ]:vy League universities.
Marshall Gage, Police Chief, said that Clyde Harris put in years of hard work to get the kids here
today and presented a plaque to Coach Harris.
Members of the team dedicated their trophy to Chief Gage.

Commissioner McCray moved to approve the consent agenda as amended. Commissioner
McKoy seconded the motion that carried unanimously.
D.1. New Alliance Haitian Church (NWSP 01-008), Hoadley Road (east
end) - Request for site plan approval for a one-story (240 seat) church on
a 1.9-acre parcel
Mayor Broening announced that there were approximately 28 cards with names of people
wishing to speak on this item. He requested that only those with new information speak
regarding this item.
Mike Rumpf, Planning & Zoning Director, explained that the applicant is proposing to construct
a 5,146 square foot church on this parcel. The property is located at the southern terminus of
Hoadley Road. The project would consist of a church, including a sanctuary, office space,
ancillary rooms, and classroom space. Also included are the 63 required parking spaces and
required perimeter and parking area landscaping. The structure is white with asphalt shingles.
There is no wall or monument signage proposed at this time. The Planning & Development
Board reviewed the original request and recommended approval including an additional
condition of approval that the City pay for the road improvements required for the project.
Due to the lack of detailed road plans, the City Commission last year directed this project back
to the Planning & Development Board to re-review the project with more detailed drawings of

the road to determine its actual impact and reconsider that as part of their reconsideration for
the project. The Planning & Development Board held that review and again made the
recommendation to approve the project with a modification to their recommendation regarding
the City providing the road improvements to basically sharing those improvements.
Alfred Daise, developer for the church, had no new information to provide. He said all of
the information was previously heard.
Mayor Broening explained that under the law, the owners of the property have a right to build a
church on this property. On the other hand, there is a question whether other residents of the
City should pay for improvements to the road. The Planning & Development Board
recommended that the City pay for the portion of the road up to the church's property line.
Mayor Broening said that if there were ancillary uses proposed, for instance day care, there
would be conditions associated with that. However, it was his understanding that there was no
use anticipated that would make this a conditional use. Mr. Daise stated this was correct.
.1elf Livergood, Public Works Director, explained that when staff was initially reviewing this
project last year, they were contemplating it based upon plans that were very inferior. The
Engineering Division needed a better document to determine what the impacts would be on the
neighborhood so they could determine what roadway improvements would be necessary from a
minimum perspective to support the additional traffic generated by the church on Hoadley
Road. Tn particular, they were evaluating Hoadley Road from a point south of Velaire Drive.
This portion of the roadway is not a standard width, which, typically, for residential streets is
22'. Staff recognizes that to fit a 22' wide roadway within a 30' right-of-way would be
extremely difficult. He explained that standards are just standards and not laws and they can
be deviated from.
In this case, staff asked the developer to evaluate a roadway improvement that would
approximate 20' in width. The roadway now varies in width, on average 14 to 15'. Therefore,
they are requesting an average of a 5' widening that will vary in certain locations. The existing
roadway meanders somewhat and ideally a new roadway would be straight. Most roadways are
on the centerline of the right-of-way. Most right-of-ways in residential areas of the City are 60'
or 70' in width. This particular street only has a 30' right-of-way. The existing roadway is
approximately 20' wide in the first portion of Hoadley Road (the right-of-way is 50' wide). The
right-of-way in the vicinity of the three existing residential properties then narrows to 30'. The
proposal is to place a 20' wide roadway that would be linear within the right-of-way.
They are proposing to place the easterly edge of the roadway adjacent to the private parcels
approximately 2.5' from the right-of-way line (their property line). They purposely did that to
leave 7.5' on the west right-of-way. The west right-of-way contains a masonry wall, seagrapes,
and trees. Staff realizes that this wall and landscaping provide a visual barrier between the
residential property and the commercial property to the west.
Staff feels that a 20' wide roadway would accommodate the church traffic. Seven trees in the
public right-of-way that were planted by the shopping center would have to be removed. One
power pole would need to be relocated to the easterly property line and that would be fairly

simple. The cost estimate for the road project, including tree removals, is $12,000-$15,000 on
the high end. Bids may come in lower.
The City Commission requested that people speaking regarding this item limit their comments
to three minutes.
Mr. Daise announced that only one person, the pastor, would be speaking for the church.
City Attorney Cherof swore in everyone who would be testifying.
Lucy Baker-Dickey, 1007 Coral Court, said there were many traMc accidents at Old
Boynton Road and she was concerned for safety. She was also concerned that property values
would be affected because of the noise from the church.
Kirk Orlovsky, 410 Hoadley Road, state certified building contractor, said that he had
previously written a letter to the Commission addressing road issues such as drainage, road
width, landscape buffers, and pedestrian traffic. He explained that he stated the urgency to
address all issues with Hoadley Road and provided a plan at a previous Commission meeting.
He could not see how everyone involved will benefit from what is being proposed. The right-of-
way is 10-30' narrower than ordinary. That is why extraordinary engineering is necessary.
Mr. Orlovsky said that his plan left the landscaping untouched and he wondered why it was
being eliminated now. His plan provided a 22' roadway, a sidewalk for pedestrian safety, and
drainage. There was reference made to address the drainage at a previous Commission
meeting and he wanted to know when that could be expected.
Mr. Orlovsky's house is directly north of the church property and on the proposed plan there are
20 parking spaces pointed at his house. He requested that the hedge material be planted at
the top of the north berm instead of on the property line, as the plans now show.
Anne Smith, 4 Velaire Drive, had a concern regarding how the church would impact the
neighborhood. Recently, there was a fire truck and an ambulance on the street and there was
no room for any other vehicle to get out if necessary..She felt that this project would create
too much congestion and traffic for the neighborhood.
Ted Lewis, 17 Velaire Drive, did not believe that 63 parking spaces were adequate for a
240-seat church. When the fire truck was on Velaire Drive, it took three tries to back out. He
would not have been able to get out of his house if he had needed to.
Kathy Silverio, 10 Velaire Drive, felt that the impact of this project must be taken into
account. The only reason the road upgrade is being addressed now is for the church. [f the
City pays for this upgrade, it would set a precedent. There are no other churches built on
dead-end streets.
Rod Silverio, 10 Velaire Drive, was concerned regarding the traffic and felt that the project
would back up traffic on Old Boynton Road when turning into Hoadley or Velaire.

Neil Kilburn, 19 Velaire Drive, felt that the project would create too much traffic.
William Petteruto, 14 Velaire Drive, was concerned regarding traffic safety on Old Boynton
Road. He felt that with the extra traffic exiting the church, it would be very difficult to turn
onto Old Boynton Road from Hoadley Road. Mr. Petteruto said that the County would not allow
a traffic signal at Hoadley Road because it was too close to another signal at Congress Avenue.
He also had concerns regarding the peace and quiet of the neighborhood. He noted that when
the shopping center was approved, the Commission had promised that there would be 50 trees
in the buffer zone and there are not near that many and now the City is talking about removing
some of the trees.
Mike Fitzpatrick, 175 SW 2nd Street, was concerned regarding the fairness issue. He did
not think that tax dollars should be used to upgrade the road as it would set a precedent.
Eric Peterson, 430 Hoadley Road, felt that this project would have a negative impact on the
neighborhood. They purchased their homes on Hoadley Road with the understanding that this
was an 18' wide, nonconforming road. The proposed road would only be beneficial for the
church and would require removing neighbors' plantings, irrigation, and mailboxes. Mr.
Peterson said that Boynton Beach is governed by Home Rule, which demands the participation
of each community. The citizens have attended various meetings and have shown why this
project should not be allowed.
Gene Seng, I Velaire Drive, lives on the corner of Hoadley Road and Velaire. He felt that
this project would have a negative impact on the neighborhood. He said that citizens of the
neighborhood have legal rights too. He hoped that the church could find a more suitable
property to build on.
Bill Newsome, 1254 Gondola Court, lives less than 50' from the proposed project, directly
across the canal. He was concerned regarding the noise and felt that he had a right to a quiet
neighborhood.
Reverend Dieugrand .lacques spoke for the many church parishioners in the audience. He
explained that over three years ago, the New Alliance Church bought the property on which to
build a church. The church is seven years old and has been renting space for their services.
Because of the growth of the church, they need a place of their own. They bought this piece of
property because they felt that it is a safe neighborhood and because City officials said that a
church could be built there. The Haitian people are ordinary, nice people who like to share.
The New Alliance Haitian Church is a church of America and a church of the City of Boynton
Beach. Reverend 3acques said they are not building a church for Haitians but for everyone who
wants to be saved. The church wants to serve the people and educate them.
Mr. Daise commented that the Commission needs to make a decision tonight. He said that all
the people here are residents of the City of Boynton Beach.
Tina Smith, 15 Velaire Drive, presented photographs that she took of churches in the City
where there are parking problems. They are marked Exhibit B and are on file in the City Clerk's

Office. She felt that the Commission should consider the traffic and parking problems. She said
that the impact on Velaire Drive was never addressed.
Commissioner McCray said that everyone agreed that they have a right to build a church. The
May 15, 2003 staff report states that this project meets the Palm Beach County Traffic
Performance Standards. The report also states that staff recommends approval contingent
upon all conditions of approval and asserts that the cost of improvements should be borne by
the developer and not paid for by the City.
Commissioner Weiland's concern was for safety. He asked what the width of a vehicle rescue
truck or a fire truck was. He was concerned that the City might be liable if there was not
enough room for two vehicles on the street. He felt that the seven trees would need to be
replaced. He was also concerned with on-street parking Commissioner Weiland wanted the
City to be protected from liability and the neighbors not to lose their landscaping buffer.
William Bingham, Fire Chief, stated that the width of both the fire trucks and rescue vehicles is
8'6" but with the wide mirrors, 10' would be needed for clearance. They previously had some
concerns with the width of the road as well as the load bearing capacity; however, they were
satisfied with the engineering reports that were provided.
Vice Mayor Ferguson felt that the only issue tonight is to determine who is going to pay for the
south portion of the road.
Commissioner McKoy felt that the issue is traffic safety and to ensure that the road is usable for
everyone.
Mayor Broening commented that the City has an obligation to enforce ordinances and the
ordinance does allow a church in an R-l-AA zoned area. His concern is City residents paying for
improvements that should be paid by the applicant. He was concerned that the City previously
fell short of its promise for landscaping between the shopping center and the residences. He
did not want the City to pay for any improvements to Hoadley Road. He would like the City to
put the money into improvements that would shield the shopping center and provide improved
appearance, improved safety, and access for all properties on Hoadley Road. He was in favor

Commissioner Weiland did not know whether the City should be responsible for the landscaping
since the shopping center was originally supposed to install that.
Mayor Broening understood but felt that the City has a moral obligation and he was willing to
donate some of his discretionary funds towards this. He thought the best agreement was when
both sides walk away feeling a little bit cheated. He reiterated that he thought the site plan
should be approved, the road be conditionally approved based upon reengineering of it, and the
City participate in some extensive landscaping of the existing roadway.
Alice Otis, 203 SW 13t~ Street, felt that even though the zoning permits a church, it is not a
suitable property and would have a tremendous impact on the neighborhood. She thought that
the church should find an alternative location.

Herb Suss, resident of Boynton Beach, felt that ~he P.A.L. program was a wonderful
program sponsored by the Police Department. He was pleased with the sculpture presented
earlier and thought that the City's golf course was great. He was proud to be a citizen of
Boynton Beach.
Sister Lorraine Ryan, a community health nurse and certified associate addiction
professional who works at 145 NE 4t" Avenue, said that she participated in the Heart of
Boynton process and worked with PATCH since 2001. She wanted the citizens in the Heart of
Boynton area to have their desire for affordable housing honored. She suggested that
affordable housing could possibly be tied in with Phase T so that developers would have to build
a certain number of affordable housing units. She also would like to have a community friendly
person available at the Wilson Center to answer questions and dispel anxiety of the residents in
that area. She also hoped that the Commission would do everything possible to preserve the
Everglades and prevent commercial development west of the turnpike.
Brian Edwards, 629 NE 9th Avenue, thanked the Commission for the progress at the
l~ntracoastal Park site and for all the good things going on in the City. He complimented the
volunteer boards and the CRA. He felt that the fire assessment fee and the stormwater utility
fee rate increase were necessary for the well being of the citizens of Boynton Beach. He
praised the Commission for being forward thinking. He suggested that the Commission devise
a strategic plan that earmarks dollars for projects that the City will need in the future. A copy

Dick Hudson, Senior Planner, gave a brief presentation regarding the project that is located at
the southwest corner of Ocean Avenue and Federal Highway and extends south to S.E. 2nd
Avenue and west to SE 4th Street. This is a small-scale land use amendment and, therefore,
would be adopted by the City prior to being sent to the Florida Department of Community
Affairs for their review. Staff found that the project meets the criteria in the Comprehensive
Plan. zt also meets the directives of the Federal Highway Corridor Community Redevelopment
Plan.

With regard to concurrency, the Palm Beach County Traffic Division removed the conditions that
were originally included in the staff report. Secondly, since the staff report went out, the Palm
Beach County Planning Division did a preliminary objection to the amendment based on the
impacts to the 2020 highway network. However, their objection was removed today. Copies of
the letters from the Palm Beach County Traffic Division and the Palm Beach County Planning
Division are marked Exhibits D and E and are on file in the City Clerk's Office. The Project
meets all other concurrency and will help develop the critical mass needed to revitalize the
downtown. Staff recommends approval.
Nancy Graham introduced the partners for this project and she expressed her team's
appreciation for the way the City worked with them. City staff was very accommodating and
was great to work with.
IVls. Graham entered into the record letters from Palm Beach County Commissioner Jeff Koons
and the School of the Arts Foundation acknowledging the donation of trees. These letters are
marked Exhibit F and Exhibit G and are on file in the Office of the City Clerk.
Ms. Graham said they reviewed all conditions of approval and there are no objections. One of
those conditions, #28, was removed per the letter from the Palm Beach County Traffic Division.
Lee Wische, 1302 SW 18~ Street~ said it was a dream for 30 years of seeing a downtown
being formed. He felt that this was a great project and, along with others, will make a vibrant
center to live, work, and visit.

Dick Hudson, Senior Planner, explained that this was a staff initiated land use amendment and
rezoning. There are two parcels that total 4.22 acres. He reviewed the land uses surrounding
the property. Both parcels were dedicated to public use in the late 1970s. The smaller parcel
was developed for the City water storage tank. The larger parcel was dedicated for recreational
purposes; however, because of its size and elongated shape, it was not developed.
Mr. Hudson said that the rapid population growth in recent years made the expansion of the
City's Fire Rescue Department necessary. Also, the corresponding increase of the 911 calls and
traffic congestion result in increased emergency response time. Decreasing this response time
is paramount. There will be noise impacts but those can be minimized and must be weighed
against speedy response times and the value of human life.
This site has several advantages for a fire station. It is more centrally located within the station
#2 response zone and has more direct access to T-95. The existing station #2 is located on a
very small parcel and was built in 1972. At that time, there was no consideration for dual
gender staffing or for ADA concerns. Expansion of the existing building with a second story
would be possible, but there would be a problem of limited parking and the housing of reserve
fire equipment. Staff recommends approval of both the land use amendment and the rezoning.
Bill Bingham, Fire Chief, wanted to address some concerns that were brought up at the
Planning & Development Board meeting last week. One area of concern was access thru Quail
Run. He explained that the Fire Department would not use SW 26th Street as an access route
to other areas. The only time they would be in the Quail Run development would be if they
were responding to a call within that development or working on zone familiarization or working
with fire hydrants. He said that there were not 300-400 calls into the Village of Golf as was
represented at the Planning & Development Board meeting. There were actually 65 calls in
2002.
The second area of concern was noise. They can run silent with proper signalization and with
good traffic light preemption until they get to the main intersection.
The last issue was the issue of fire trucks having to make a U-turn to get back out to Congress
Avenue. They originally were going to put a curb cut east of the SW 26th Street and Woolbright
Road intersection. However, after visiting the site with Public Works Director Jeff Livergood. it
was decided that it would be best to access right onto Woolbright Road at SW 26t~ Street with a
full signalization light.

City Attorney Cherof swore in everyone who would be testifying.
Steve Dunbar, 42 Tara Lakes Drive E., said that he had the highest respect for firemen.
However, he does not want a fire station in his back yard and felt that it would be more
practical to remodel existing fire station #2. At the current fire station, they make a right turn
to go north on Congress Avenue. At the proposed location, fire trucks would need to make two
left turns to go north on Congress Avenue. He was concerned that it might increase response
time.
Mike Friedland, :330 NE 26th Avenue, felt that existing fire station #2 is no longer adequate.
He believed that the Commission should accept the recommendation of the Fire Chief and City
staff and he urged the Commission to approve this item.
Commissioner McCray inquired what would happen to the existing station.
City Manager Bressner explained that the property was appraised at approximately $150,000.
There are some alternative uses for that property (e.g., a secure document storage facility for
archival records). The rear door of the station is less than 30' from homes so the least active
use for the property would be the best. Also, the building is not hurricane proof. Staff is
considering a number of options and will return to the Commission with a proposal.

within the easement in the foreseeable future. According to Chapter 7.S,
Article L Section 18.1, the public utilities has the authority to remove any
trees that interfere with utility services, either in utility easements or public
rights-of-way.

data that address the following issues [Section 3107.1.2, Chapter 31 of the
2001 Florida Building Code]:
a) The design professional-of-record for the project shall add the
following text to the site data. "The proposed finish floor elevation

applicable to the building site, as determined by the South Florida
Water Management District's surface water management construction
development regulations."
b) From the FIRM map, identify in the site data the title of the flood zone
that the building is located within. Where applicable, specify the base

plans.
c) Identify the floor elevation that the design professional has established
for the building within the footprint of the building that is shown on
the drawings titled site plan, floor plan and paving/ drainage (civil
plans).
18. On the drawing titled site plan, identify and label the symbol that represents X
the property line.
19. At time of permit review, provide a completed and executed City of Boynton X
Beach Unity of Title form. The form shall describe all lots, parcels or tracts
combined as one lot. A copy of the recorded deed with legal descriptions, of
each property that is being unified, is required to be submitted to process the
form. The property owner that is identified on each deed shall match.
20. At time of permit review, submit signed and sealed working drawings of the X
proposed construction.
21. Add to each building that is depicted on the site plan drawing a labeled X
symbol that identifies the location of the proposed handicap accessible units.
Add to the drawing the calculations that were used to identify the minimum
number of required units. Also, state the code section that is applicable to the
computations. Show and label the same units on the applicable floor plan
drawings. Compliance with regulations specified in the Fair Housing Act is

24 CFR 100.205).

3. All utility easements shall be shown on the site plan and landscape plans (as X
well as the Water and Sewer Plans) so that we may determine which trees
may interfere with utilities. In general, palm trees will be the only tree
species allowed within utility easements. Canopy trees may be planted
outside of the easement so that roots and branches will not impact those
utilities within the easement in the foreseeable future. The LDR, Chapter 7.5,
Article I, Section 18.1 gives public utilities the authority to remove any trees
that interfere with utility services, either in utility easements or public fights-
of-way.
4. Fire flow calculations will be required demonstrating the City Code X
requirement of 1,500 g.p.m, as stated in the LDR, Chapter 6, Article IV,
Section 16, or the requirement imposed by insurance underwriters, whichever
is greater (CODE, Section 26-16(b)).

shall be an unobstructed cross-visibility at a level between 2.5 feet and 6 feet
above the pavement (Chapter 7.5, Article II, Section 5.H.)
8. Proposed landscaping in the southeast comer of the development conflicts X
with access to the existing lift station. Place a 12 foot wide drive from SW
19th Ave. to the southeast side of the lift station. This will require relocation
of the proposed Live Oak. The driveway shall be six (6) inches thick
concrete, on an eight (8) inch thick limerock or shellrock base and a 12 inch
thick stabilized subgrade (see Utilities Engineering Design Handbook,
Typical Lift Station Site Plan Drawing S-20 and S-21) and shall include a
turn-around/street termination complying (City Standard Drawing B-98003.)
9. Indicate by note the ownership of the off-site drainage system and provide X
approval to tie into said system.
10. The minimum pipe size is 15 inches in diameter (Chapter 6, Article IV, X
Section 5.A.2.a.). At the time of permitting, revise the storm sewer pipe size
(listed as 12 inches west side of site) to 15 inches in diameter.
11. Full drainage plans in accordance with the Chapter 6, Article IV, Section 5 X
will be required at the time of permitting.
12. Prior to the issuance of a building permit, provide a hold-harmless agreement X
for the six (6)-foot privacy fences that are proposed at the rear of each
townhouse unit. Provide a copy of the hold-harmless agreement to the
Engineering Division and to the Planning & Zoning Division.
13. Paving, drainage and site details as shown on Sheet C-2 will be reviewed for X
constructability at the time of construction permit application. All
engineering construction details shall be in accordance with the Land
Development Regulations and applicable City of Boynton Beach Standard
Drawings and will be reviewed for constructability at the time of construction
permit application.
14. Prior to the issuance of a building permit, revise driveway to lift station to an X
"L" shape to allow full access to lift station. Remove / relocate Live Oak and
pull back hedge.

PLANNING AND ZONING
Comments:
23. A re-plat will be required, subject to review and approval of the Engineering X
Division of Public Works. Abandonment and rededication of any easements
can occur during the platting process. This will be required prior to the
issuance of a land development permit.
24. Prior to the issuance of a building permit, obtain an affirmative Concurrency X
Determination from the School District of Palm Beach County.
25. A traffic study was sent to the Palm Beach County Traffic Division for their X
review and approval (for concurrency requirements). The Traffic Division
reports the following:
"Although the project generates less than 200 daily trips, it's impact on the
first directly accessed links, which are part of the County Major Thoroughfare
Network, must be evaluated. The build-out date must be provided".
Prior to the issuance of a building permit, the Palm Beach County Traffic
Division must approve the traffic study.
26. Place a note on the site plan (sheet A-1.0) indicating that the screen enclosure X
frames will be of white aluminum material.
27. Place a note on the site plan (sheet A-1.0) that the Entrance Wall color(s) will X
match the proposed building color(s).
28. Provide a copy of the hold-harmless agreement for the fences to be placed in X
the rear yard within the Utility Easement.
29. Each project development sign can be no more than 32 square feet in area or X
six (6) feet in height (Chapter 21, Article IV, Section I.E.).
30. Ensure that all the proposed plant quantities correspond between what is X
shown on sheet L-1 and the plant list on sheet L-2.
31. A signature tree (such as a Yellow Elder, Tibouchina Granulosa, or X
Bouganvillea is required at both sides of each project entrance/exit. The

signature trees must have six (6) feet of clear trunk if placed within the safe-
sight triangle (Chapter 7.5, Article 2, Section 5.N.). Alternative plant material

requirement) will be subject to the City Landscaper/Environmentalist review
and approval.
32. Fifty percent (50%) of all site landscape materials must be native species X
(Chapter 7.5, Article II, Section 5.P). On the landscape plan plant list (sheet
LP-1), indicate by asterisk, the native species to ensure that at least 50% of
landscape material is native. Separate and indicate the proposed plant
material into the following categories: Shade Trees, Palm Trees, Shrubs /
Hedges, and Groundcover. Please tabulate the amount of native material in
each plant category.

Statement of special conditions, hardships or reasons justifying the
requested exception or variance. Respond to the six (6) questions below
(A-F).
A. That special conditions and circumstances exist which are
peculiar to the land, structure or building involved and which are not
applicable to other lands, structures or buildings in the same zoning
district.
We bought our house from a previous owner. At the time we had 1 child.
The main house has 2 bedrooms and 2 baths. The previous owner laid the
patio at the 20-foot setback. If we could extend an addition to the
patio this would give us enough room to add an addition that would make
room for our future family members (a new baby on the way!). This would
not be an addition across the entire back of the house. It would be on
one side of the house measuring 22 feet, 10 inches across the back of
the house. The yard is completely fenced in with a hedge around it.
This blocks the views of our neighbors from us and us from them.
B. That the special conditions and circumstances do not result
from the actions of the applicant;
Again we did not build this house and have tried to find other ways to
deal with this, besides having to sell our home and move (and we love
our neighborhood)!
C. That granting the variance requested will not confer on the
applicant with any special privilege that is denied by this Ordinance
to other lands, buildings or structures in the same zoning district;
There are many other homes in the neighborhood that do not have the
same setback restrictions. I also have letters of support from
surrounding neighbors in regards to our planned addition.
D. That literal interpretation of the provisions of this chapter
would deprive the applicant of rights commonly enjoyed by other
properties in the same zoning district under the terms of the Ordinance
and would work unnecessary and undue hardship on the applicant;
Again, there are many other homes in the neighborhood that do not have
the same setback restrictions. I had the city clerk's office pull all
of the variances granted in the Chapel Hill neighborhood and many have
been granted over the years.
EXHIBIT "B"
E. That the variance granted is the minimum variance that will
make possible the reasonable use of land, building or structure;
I have spoke to an architect and we tried to figure all of our options.
The way the house is laid out we would be able to build the addition
with only needing to obtain a 5-foot variance to make a comfortable
bedroom and bathroom for our new baby and future children. I feel this
would accommodate our family after the birth of our second child and
any there after for many years to come. We are a young couple and would
like for our children to grow up in this home.
F. That the granting of the variance will be in harmony with the
general intent and purpose of this chapter and that such variance will
not be injurious to the area involved or otherwise detrimental to the
public welfare.
The yard is fully private because of the fence covered by the hedge.
The addition would blend with the rest of the house, and would make it
both look attractive from the outside and be functional on the inside.
Again other homes is the same area were not required the same setbacks.

First, I simply want to say thank you for the progress being made at the Intra-
coastal Park site. It appears to really be moving along.
I want to also thank this Commission and the Staff for all the good that's going
on throughout the City. I know you're responsible for some of the not so good
too, but we all know that some of us that live within the City share some of that
burden with you. And even though some of us leave here some times so
frustrated we coUld spit - I think that's the sign of a healthy City and it keeps
things balanced.
Our volunteer boards never cease to amaze me, nor does the forward thinking
CRA that we should all be very proud of and the progress they're bring before
you.
By virtue of the above comments, I obviously appreciate the job you're doing
and even though I may disagree with each of you some of the time, as you
sometimes disagree with me when I speak about a particular issue - I wanted to
go on record tonight with a thought along the lines of a strategic plan for long
term financial sovereignty.
As much as many may disagree, I think two of the most controversial decisions
this commission has made in recent history - has probably been or will be the
most beneficial to the City as a whole. The Fire Assessment Fee and the Storm
Water UtiliW Fee Rate Increase. Yes - they were meant to be temporary and
serve a specific purpose and they will.
These actions were bold, well thought out, but most importantly - were
necessary for the safety, security and well being of all the citizens of Boynton
Beach. It's easy to say somebody should have done something years ago to
prevent it, but they did not. You did, regardless of which side of the fence you
were on and in my opinion you should be proud for being a part of what good
will come of these actions.
The five-year capital improvement plan was a great initiative and the
continuance to be forward thinking even beyond is important. In fact, I can't
imagine any Commission that will come behind you, ever being able to not be in
a forward thinking mode. Vision 20/20 was great - you've raised the bar!
My point - as unpopular as it might be, I would like for this commission to take
another bold step to prevent the initial surprise and disruption of the above
mentioned increases by taking measures now to "put money in the bank" for
issues that will surely come our way in the future. A five-year plan puts some of
that in place, but lets face it, the money seems to always come up short.
There's always somebody in the crowd that can do it better - right! Until they
get where you are now! I think you are the ones to do it right...
As the increases above for the fire and utilities will end over time, in quick
order. I suggest to you or recommend that now is the time to figure out a plan
by way of staff and public input, to continue to use on a long term base, by line
item, a fee, maybe not as much, but a fee for those areas that we can easily
foresee now as being something that will need repaired or replaced in the
future.
I don't have all the answers and I know you and others are working hard on
building a tax base that everyone hopes will eliminate these types of needs.
Guess what, so is everyone else on the planet. I think as the City grows, the
need obviously will grow and the tax base will be good and probably meet us
about half way. That's positive thanks to you - but what about the other half?.
It's my befief that ff you lay out an honest, fo~ard thinking strategic plan that
ear marks dollars for out year projects - Citizens are going to be a great deal
more accepting to investing in the future over and above a monthly bill - then to
surprise them again in five to seven years with additional multi-million dollar
projects that we knew about today! You're predecessors did some good things,
but in this case they made some mistakes. Let's learn from them.
Yes - some will not be happy anytime, but that's why you get paid the big
bucks. And overall - a few dollars of investment a month now or as a follow-on
to the current increases once they expire, would be a great deal better than
getting hit hard on several fronts during a weak economy. Everyone wins...

Boynton Road. I am writing to request you vote to disapprove a proposed Church at the end
of Hoadtey Road which I understand is on the agenda for tonight's meeting. The traffic
volume on Old Boynton Road is at capacity already and I believe the addition of a Church
would be detrimental to our City and particularly to our neighborhood. I have spoken
personally with many of the 50+ homeowners on Venetian Isle, and not one of them supports

Dear Commissioner,
My letter of May 29, 2003 regarding the cost of sidewalks at my new home seems to
have been received some not as I intended. It was meant as satire, but I guess I am no threat to
Frank Cerabino.
I do not want the money for the sidewalk in front of my house. What I want is the same
rules applied to the Hoadley Road church as they were to me. As they were to Loews and every
other developer.
My observation is the implications of racism, concern for the poor, and regarding
churches essentially the same as public service agencies has obscured the basic facts of this case.
If the recommendation of the Planning and Development Board to go against staff
recommendation is upheld it will be a financial disaster for the City. It sets a strong precedent
for every future building project to shift the cost of infrastructure upgrades to the City.
ffyou give these tax dollars to this Church, how can you "just say no" to the next one?
The First Baptist Church looks like they are getting ready to build their giant auditorium. For
something that size there are going to have to be traffic upgrade issues costing much more than
Hoadley Road~ How many of my tax dollars will they get?
And how can you stop at just churches? Literally everything built is at stake.
Another fairness issue that rankles is tax dollars will be given to people who are primarily
building here became land is too expensive in Broward County. They will never pay a dime in
taxes became they are a church, yet taxpayers who have lived here for decades do not get the
same upgrades. There must be at least fifty miles of missing sidewalks and ten miles of sub
standard roads and alleys, ffyou vote against staff recommendation it will really open up the
flood gates of resentment and cries of"What about me?'
