O90-26 AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
ABOLISHING THE CITY'S PLANNING ~'AND
ZONING BOARD; PROVIDING FOR A DELEGATION
OF POWERS AND DUTIES; PROVIDING FOR
DESIGNATION OF THE CITY COMMISSION AS
THE LOCAL PLANNING AGENCY; PROVIDING FOR
EVALUATION AND REVIEW; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEUERABILITY;
PROVIDING AUTHORITY TO CODIFY; PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
Beach, Florida, has determined that the functions of the
Planning and Zoning Board may be handled by the City
Commission without any detrimental effect on the processing
of development plans pending before this City;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The City's Planning and Zoning Board is
hereby abolished and its members discharged.
Section 2. All powers and duties heretofore vested
in the City's Planning and Zoning Board shall hereinafter-be
vested in the-City Commission.
Section 3. The City administration is directed to
prepare a ~omparative evaluation following the abolishment
of the Pl'anning and Zoning Board to determine the impact of
the abolishment of that Board and to present that evaluation
to the Commission six (6) months following the enactment of
this Ordinance.
Section 4. The City Commission of the City of
Boynton Beach, Florida is hereby designated as the City's
Local Planning Agency pursuant to Chapter 163.3174, Florida
Statutes.
Section 5. That all ordinances or parts of
ordinances in conflict herewith be and the same are hereby
repealed.
