O01-19ORV ANCE 01-iq AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 13-20. SPECIAL EVENTS; PROVIDING FOR CLARIFICATION OF REGULATIONS AND STREAMLINING OF THE APPLICATION PROCESS; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. WHEREAS, the City Commission, by Ordinance No. 098-37, passed and adopted a Special Events Ordinance, which was intended to establish regulations and procedures Special Events; and WHEREAS, staff has now had ample opportunity to review this policy, and has several amendments to further clarify regulations and to further streamline the for applicants; and WHEREAS, the City Commission, upon recommendation from staff, has that it is in the best interest of the citizens and residents to amend Section 13-20; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. That Section 13-20. Special Events is hereby amended by adding the and figures in underlined type, and by deleting the words and figures in struck-through )e, as follows: Sec. 13-20. Special Events 1. Permits for Special Events. shall be unlawful to organize, conduct or participate in any special event on the streets of City... 2. Definition. A "Special Event" shall mean any meeting, activity, gathering, or group of persons, or vehicles, or a combination thereof, having a common purpose, design or goal any public or private facility, street, sidewalk, alley, park or other place or building the special event substantially inhibits the usual flow of pedestrian or vehicular traffic which occupies any public area or building and preempts use by the general public. (b) The use or construction of platforms, chairs or other equipment may be or restricted by the Leisure Service~ Recreation Department and/or the City if such would result in permanent damage to City property or constitute a hazard to safety. Sces Recreation Department and/or City Manager, all permits necessary to conduct the special event shall be obtained and thereof provided to the City not less than fourteen (14) days prior to the first day of the Section 2. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 4. Should any section or provision of this ordinance or portion any paragraph, sentence or word be declared by a court of competent urisdicfion to be invalid, such decision shall not affect the remainder of this Section 5.
