AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, CONSOLIDATING
ALL EXISTING COMMUNITY REDEVELOPMENT
AGENCIES, AMENDING ORDINANCE NO. 89-11 AND
DECLARING THE CITY COMMISSION AS THE BOARD OF
COMMISSIONERS OF THE COMMUNITY REDEVELOPMENT
AGENCY FOR THE ALL COMMUNITY REDEVELOPMENT
AREAS; PROVIDING FOR THE DESIGNATION OF THE
CHAIRMAN AND VICE-CHAIRMAN OF THE BOARD OF
COMMISSIONERS OF THE COMMUNITY REDEVELOPMENT
AGENCY; PROVIDING FOR POWERS OF THE COMMUNITY
REDEVELOPMENT AGENCY; PROVIDING FOR SURVIVAL
AND CONSOLIDATION OF POWERS AND ACTIONS;
PROVIDING FOR THE DISCHARGE OF PREVIOUSLY
APPOINTED MEMBERS OF THE BO~D; PROVIDING FOR
AUTHORITY TO CREATE A COMMUNITY REDEVELOPMENT
ADVISORY BOARD; PROVIDING A CONFLICTS CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING
AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE
DATE; AND FOR OTHER PURPOSES.
WHEREAS, the City Commission of the City of Boynton Beach
has heretofore acted as the Community Redevelopment Agency for a
portion of those areas of the City designated for redevelopment
and generally referred to as the Community Development
Agency/Residential;'and
WHEREAS, by Ordinance No.89-11, the City Commission of the
city of Boynton Beach, Florida, created a Community Redevelopment
Agency/Commercial for that portion of the redevelopment area
referred to as the Central Business District of the City; and
WHEREAS, pursuant to Section 163.357, Florida Statutes, the
Legislature provides that the governing body of a municipality
may designate itself as the Commissioners of a Community
Redevelopment Agency; and
WHEREAS, the City Commission of the City of Boynton Beach,
Florida, .desires to exercise this alternative, for the entire
area designated for community redevelopment, including the
Central Business District; and
WHEREAS, the City cOmmission of the City of Boynton Beach
desires to consolidate the two Community Redevelopment Agencies
into one Community Redevelopment Agency;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA:

Section 1. Ordinance No. 89-11 adopted by the City
Commission on the 1st day of August, 1989, is hereby amended to
provide that the city Commission of the City of Boynton Beach,
Florida is hereby appointed and declared to be the Board of
Commissioners and the governing body of the Community
Redevelopment Agency for the entire Community Redevelopment Area.
Section 2. The Community Redevelopment Agency, shall
exercise its jurisdiction in all areas of the City which the City
has heretofore designated for redevelopment.
The Community Redevelopment Area is more particularly
described in Exhibit "A" which is attached to this Ordinance and
incorporated herein.
Section 3. The Mayor and the Vice-Mayor of the City of
Boynton Beach are hereby designated as Chairman and the Vice-
Chairman, respectively, of the Board of Commissioners of the
Community Redevelopment Agency.
Section 4. All administrative staff and any other staff
support for the Community Redevelopment Agency shall exclusively
be provided by the City of Boynton Beach Department of Community
Improvement under the direction and supervision of the City
Manager.
Section 5. All previous appointments to the Community
Redevelopment Agency for the Central Business District are hereby
vacated and those individuals who have heretofore held positions
are discharged from their duties and
on that Board
responsibilities.
Section 6.
The Community Redevelopment Agency shall have
all powers provided for or authorized by general or special laws
of the State of Florida as amended from time to time, including
not limited to the specific powers delineated in §163.370
Lda Statutes.
Section 7. All powers, duties, and responsibilities of
the Community Redevelopment Agency for the Central Business
District shall survive and be deemed merged and consolidated with
the powers, duties and responsibilities of the Community

Agency for Housing and Community Improvement. Ail
)revious actions of the Community Redevelopment Agency for the
31 Central Business District shall survive this consolidation unless
41 specifically revoked by the Community Redevelopment Agency.
5i Section 8. The city Commission may authorize the
6i creation of a Community Redevelopment Advisory Board to make non-
7i binding recommendations to the Commission on issues concerning
81 community redevelopment.
9i Section 9. That all ordinances or parts of ordinances in
10i conflict herewith be and the same are hereby repealed.
li Section 10. Should any section or provision of this
1~ ordinance or portion hereof, any paragraph, sentence, or word be
1~ declared by a court of competent jurisdiction to be invalid, such
14 decision shall not affect the remainder of this ordinance.
1~ Section 11. Authority is hereby granted to codify said
ordinance.
Section 12. This ordinance shall become effective
immediately upon passage.
