Minutes 06-16-03 M:[NUTES OF THE AGENDA PREVIEW CONFERENCE HELD :IN CONFERENCE ROOM C, WEST W[NG, CITY HALL, BOYNTON BEACH, FLOR/DA ON MONDAY; JUNE 16~ 2003 AT 4:00 P.M. Present Gerald Broening, Mayor Mike Ferguson, Vice Mayor Mack McCray, Commissioner Carl McKoy, Commissioner Absent Ron Weiland, Commissioner Kurt Bressner, City Manager James Cherof, City Attorney Bonnie Glinski, Deputy City Clerk City Manager Bressner called the meeting to order at 4:00 p.m. An item regarding the Fourth of July festivities was added under Community and Special Events. Wayne Segal, Director of Media & Public Affairs, will announce this at the Commission meeting. IZX.C.2. Presentation of certificates to Boynton Beach Community High School Baseball Team City Manager Bressner explained that this is the varsity baseball team that went to the State finals. Mayor Broening, with the assistance of Commissioner McKoy, will present the certificates at the Commission meeting. regarding Museum Presentation by representatives of the Boynton Cultural Centre, [nc. two exceptional honors for Boynton Beach's Schoolhouse Children's City Manager Bressner announced that the Children's Museum received AAA recognition and an award from Parent/ng Plagazine as the outstanding children's museum in South Florida. V.B.4. Award the "THREE YEAR CONTRACT FOR F:[NANC~AL AUDIT~NG SERV:[CES,' RFP#061-1410-03/C1D to CALER~ DONTEN, LEV]NE, DRUKER, PORTER & VE:ZL, P.A. of West Palm Beach, Florida, for the fiscal years ended 9/30/03, 9/30/04, and 9/30/05 (Proposed Resolution) Commissioner McCray reported that one of the auditing companies called him and said that they were penalized for recommending an Afro-American company, Watts & Rice. Diane Reese, Finance Director, stated that this was not the case. She explained that if a company was not located within Palm Beach County, they were given a reduction in points. The bidding company itself was based in Palm Beach County. However, their subcontractor was not located within the County and two of the reviewers gave a 20% reduction for that. l~t had nothing to do with what kind of company it was. Meeting Minutes Agenda Preview Conference Borg,on =..==ch, Florida 3une 16. 2003 City Manager Bressner asked whether the specifications required that there be a deduction for a subcontractor being located outside of Palm Beach County. Ms. Reese explained that the issue of whether to deduct points for subcontractors was never addressed because they never had an auditor with a subcontractor. Commissioner McKoy did not feel that it was a fair process if they lost points for having a subcontractor outside of the County. Ms. Reese further explained that she prepared an analysis and even if there were no reductions, the company would not have come in as the top rated company. Commissioner McKoy inquired whether points are awarded for minorities. Ms. Reese answered "no." Commissioner McCray stated that he would pull this item from consent only if the company who had called him was present at the Commission meeting. Commissioner McKoy asked whether there were any other subcontractors out of the county for other bidders, and Ms. Reese responded that there were not. City Manager Bressner asked whether the bid specs require companies to identify themselves as a minority based enterprise. Ms. Reese responded that they are only asked to check off if they are a minority because the City keeps track of this for auditing purposes. Commissioner McKoy asked what it would require to include a component in RFP's that would give points for minority businesses. City Attorney Cherof replied that it would be a policy determination established by ordinance. V.C.IO. Proposed Resolution Re: Retaining South Technical High School (South Tech) in Boynton Beach and recommending it be approved as a conversion charter school It was the consensus of the Commission that Vice Mayor Ferguson would pull item C.10 to emphasize the importance of the proposed resolution. V.E.1. Boynton Hills (ZNCV 03-005), NW 3~ Court It was reported that the CRA recommended denial of this variance by a vote of 3 to 2. City Manager Bressner explained that the petitioners had requested a variation to allow them to build in an area that currently has a lot requirement of 7,500 square feet. They requested a significant variance to allow them to build on a lot with 4,379 square feet. The CRA was struggling with the magnitude of the variance and the potential for setting a precedent with other developments. Quintus Greene, Development Director, explained that the reason Henderson Tillman (CRA member) was so opposed to the variance was that if the City is trying to encourage certain standards, this would be undermining those efforts. City Manager Bressner said that the solution might be a land swap with the petitioners where the City would attempt to find a suitable piece of property for them. He recommended that this item be pulled for discussion. ~II.A. Project: Club Ovation (COUS 03-002) (TABLED ON $/20/03,) City Attorney Cherof noted that the owners of the shopping center have now consented to the request for conditional use. [X.A. Discussion of Marina Development Agreement (TABLED ON $/20/03,) City Manager Bressner explained that some progress has been made; however, it would be helpful to leave this item on the table. Dale Sugerman, Assistant City Manager, reported that the next meeting with all concerned parties was scheduled for June 23rd, :D(,E, Review and Discussion of Proposed City Commission Capital Project Priority Listing (Proposed Resolution) City Manager Bressner said that he would have more information tomorrow regarding the mail ballot. He explained that the Commission would need to decide what would go on the ballot and then whether to have a ballot referendum in October, a mail referendum in October, or a ballot referendum in November. X.E. Proposed Lease Agreement with Boynton Woman's Club (July :L5, 2003) City Manager Bressner said that they are making progress on the lease. An issue will be the insurance cost to cover the premises. There will be an appraisal to determine that cost and a report on the condition of the premises. Other Assistant City Manager Sugerman requested that an item be added for .luly 15th under Future Agenda l~tems to be entitled Grant Franchise Agreement Extension for Boynton Transit Advertising.
