Amending Town CharterRESOLUi'ION
(A RESOLUTION AMENDING THE TOWN
CHARTER; PROVIDING FOR FIVE MEN-
BEES OF THE TOWN COMMISSION; AND
PROVIDING FOR A MUNICIPAL COURT. )
WHEREAS, at a Special Meeting of the Board of Town
Commissioners of the Town of Boynton, Florida, held on t~
13th day of April, A. D. 1937, the followin~ RESOLUTION was
passed and adopted.
"WHEREAS, the Charter of the Town of Boynton, in
Palm Beach County, Florida, embraced in Chapter 8918, of the
Laws of Florida, Special Acts of 1921, in the opinion of the
Town Commission of said Town has become inadequate for ~the
needs of said municipality; and,
WHEREAS, in the opinion of the Town Commission of
said Town it is deemed necessary, expedient and advisable
and to the best interests of the Town of Boynton, its inhab-
itants, citizens and taxpayers, that certain sections of the
said Charter of the Town of Boynton be amended to provide for
a Town Commission of five members, instead of three as now
provided for, prescribing the term of office of the members
of the Town Commission, their Jurisdiction, powers and the
manner in which they shall be nominated and elected; to pro-
vide for the election of two Commissioners; to prescribe the
time for the holding of general elections in said municipality;
to presdribe the qualifications of voters at such general
elections; to provide further and additional powers for said
municipality; to provide for a Municipal Court for said Town,
presided over by a Municipal Judge to be appointed by the
Town Commission, instead of the Mayor's Court presided over
by the Mayor as now provided for; to provide for an election
for the ratification or rejection of such amendments by the
qualified voters who are freeholders in said Town; and to
repeal all other laws or parts of laws relating to or affecting
said Town in conflict with such amendments;
NOW THEREFORE BE IT RESOLVED BY THE T0?JN COMMISSION
OF THE T0'~N OF BOYNTON, IN PALM BEACH COUNTY, FLORIDA;
That a special act to be entitled:
AN ACT TO Arc, END SECTIONS 5,6 and 8 OF ARTICLE 1;
SECTION l, OF ARTICLE III; SECTIONS 1, 2, 3 and 5
OF ARTICLE IV; AND SECTION I OF ARTICT.R V OF THE
CHARTER OF THE T0?~N OF BOYNTON, IN PALS{ BEACH
COUNTY, FLORIDA, EMBRACED IN CHAPTER 8918, OF THE
LAWS OF FLORIDA, SPECIAL ACTS OF 1921, THE SANE
BEING AN ACT ENTITLED "AN ACT TO ABOLISH THE
PRESENT MUNICIPAL GOVERNMENT O? THE TOWN OF BOYNTON,
IN PALM BEACH COUNTY, FLORIDA, TO CREATE AND
ESTABLISH A NEW MUNIOIPALITY TO BE KNOWN AS THE
TOWN OF BOYNTON, AND OFFICIAL ACTS THEREUNDEM;
AND FIX AND PROVIDE ITS TERRITORIAL LIMITS,
JURISDICTION ~ND POWERS, AND T~E JURISDICTION
AND POWERS OF ITS OFFICERS;" TO PROVIDE FOR A
TOWN COMMISSION OF FIVE MEMBERS, THEIR TERM OF
OFFICE, JURISDICTION, POWERS AND THE MANNER IN
WHICH THEY SHALL BE NOMINATED AND ELECTED;
PROVIDING FOR THE ELECTION ~F TWO COMMISSIONERS;
PRESCRIBING THE TIME FOR THE HOLDING OF GENERAL
ELECTIONS IN SAID MUNICIPALITY; PRESCRIBING THE
QUALIFICATIONS OF VOTERS AT SUCH GENERAL ELECTIONS;
TO PROVIDE FURTHER AND ADDITIONAL POWERS FOR SAID
MUNICIPALITY; TO PROVIDE FOR A MUNICIPAL COURT,
PRESCRIBING ITS ,~URISDICTION AND POV~ERS; PROVIDING
FOR THE RATIFICATION OR REJECTION OF SUCH AMENDMENTS
BY THE QUALIFIED VOTERS WHO ARE FREEHOLDERS IN SAID
MUNICIPALITY; AND TO REPEAL ALL OTHER LAWS OR PARTS
OF LAWS RELATING TO OR AFFECTING SAID TOWN IN CON-
FLICT WITH THIS ACT."
be prepared and submitted to the Legislature of the State of
Florida at its 1937 session for passage.
2. That notice of intention to apply to the Legislature
of the State of Florida at its 1937 session for the passage of
the special act as set forth in Section l, hereof, be published
in the Palm Beach Times, of West Palm Beach, Florida, one time
as provided by the Constitution and Laws of the State of Florida,
notwithstanding the fact that there shall be a referendum
attached to said special act.
3. That a copy of this Resolution shall be sent with
said special act to the Representatives from Palm Beach County,
Florida, as well as the State Senator representing Palm Beach
County, Florida, urging them to pass said special act.
4. That Wm. P. Somerville, a resident, citizen and
tax-payer of the Town of Boy, ton, Florida, be and he hereby is
appointed a Deputy Town Clerk of the Town of Boynton, Flo~ida,
for the purpose of typewriting said special act and taking same
when completed to Tallahassee, Florida, and presenting same to
the Representatives and State Senator representing Palm Beach
County, Florida, to introduce for ~ssage by the Legislature of
Florida at its 1937 session; and that Wm. P. Somerville be
paid a reasonable compensation for such services as well as
his expenses."

and,
WHEREAS, on April 22, 1937, a Mass Meeting was duly
held at the School Auditorium in the Town of Boynton, Florida,
at which were present approximately 12§ persons; and,
WHEREAS, accordin~ to report of the Recording
Secretary of said Mass Meeting, general disapproval was ex-
pressed respecting the propowed charter amendment now pending
before the Florida State Legislature; and,
WHEREAS, in response to motions duly made and
seconded, said proposed amendment, section by section as
presented, was overwhelmingly rejected; and,
WHEREAS, a petition in opposition to amendment of the
Charter of the Town of Boynton has been circulated and been
duly signed by a majority of the qualified Voters of the Town
of Boynton; and,
WHEREAS, the Commission of the Town of Boynton, in
consideration of the foregoing facts and information, are now
desirous of rescinding and annulling the said Resolution which
was passed by the Commission of the Town of BO~nton on the
l~th day of April, A. D. 1957. .....
THEREFORE, BE IT RESOLVED by the Board of Town
Comm~sioners of the Town of Boynton, Florida, that the said
Resolution which was passed on the 15th day of April, A. D.
1957, and which is hereinabove fully set forth, be and the
same is h~reby rescinded, annulled and held for naught. - ....
BE IT FURTHER RESOLVED that certified copies of this
RESOLUTION be forthwith forwarded to the Honorable Russell 0.
Morrow and the Honorable Paul Rardin and the Honorable John R.
Beacham, Representatives and Senator respectively for the County
of Palm Beach, State of Florida, with the request that they
withdraw House Bill No. 565, which is a bill providing for
amendment of the Charter of the Town of Boynton, Florida.
