'A RESOLUTION BY THE TOWN OF BOYNTON,
PALM BEACH COUNTY, FLORIDA, AUTHORIZING
AND EMPOWERING THE MAYOR AND CLERK OF
SAID TOWN TO MAKE, EXECUTE AND DkT, IVER
GOOD AND SUFFICIENT SPECIAL WARRANTY
DEEDS TO PROPERTY OWNED BY SAID
MUNICIPALITY UNDER CERTAIN CONDITIONS
AND PROVISIONS.
WHEREAS the Town of Boynton, a municipal corporation
organized and existing under and by virtue of the laws of the
State of Florida, located in Palm Beach County, Florida, has,
under Chapter 108~8, General Laws of the State of Florida,
1931, in Equity Suit No. 11,653, filed in the Circuit Court
of Palm Beach County, Florida, foreclosed each and all of the
properties named and described in the report of sale by the
Special Master named by the above styled Court in said suit,
and
~'~LEREAS as a result of such foreclosure and sale of
said property the said Town of Boynton is the owner of each
and all of said properties save and except the following describe~
property;
That tract of land marked on W. S. Shepard's plat
of the subdivision of Sam Brown Jr's subdivision of
the South Half of fractional Section Fifteen (18),
Township 48 South, Range 43 East. Said plat being
on record in Palm Beach Land Records in Book 8,
Page 8, and the land hereby described being marked on
said plat "Reserves", lying East of Lot 1, Block 2,
and extending to Lake Worth, and being 146.7 feet
North and South, and 400 feet East and West, more
or less, extending to Lake Worth, with all r~parian
rights, in Boynton, Palm Beach County, Florida,
by Master's deed made, signed, and executed by Shelby Buford,
as Special Master in Chancery in said cause under date of
July 16th, 1935, and
WHEREAS said Town of Boynton by and through its
proper officers has good and lawful right to sell said prop-
erty or any part thereof, and
WHEREAS it is contemplated from time to time there
will be purchasers seeking the opportunity of buying and
purchasing all or some portion of said property, and
WHEREAS the opportunity has been offered to said
Town to sell certain portions of said property,
THEREFORE BE IT RESOLVED by the Commissioners of the
Town of Boynton, Palm Beach County, Florida, in session assembled,
that the Mayor and Clerk of said Town shall be and they are
each hereby authorized and empowered to make, execute, and
deliver special warranty deeds to all or any part of said
property to such person, persons, firm, partnership or cor-
poration as may seek to purchase same, at and for a price of
not less than the
amount owin~ to said Town for taxes, tax
sale certificates, and/or special assessments, plus any and
all costs and expenses thereon, PROVIDED, HOWEVER, that no
sale shall be made at a less price than herein provided,
without the further consent of the Board of Commissioners of
said Town of Boynton. PROVIDED FURTHER that in each such
sale, each deed shall contain among other things the following
language: "Subject, however, to all unpaid State and County
taxes and to any Federal income tax lien of record Subject
also to building restrictions of record." '
BE IT FURTHER RESOLVED that the said Mayor and the
said Clerk may accept as payment for said property or any
part thereof, in lieu of cash, any valid, past due, negotiable
written obligation of said Town, at the full face value plus
interest of said obligation; PROVIDED, HOWEVER, that any taxes
due and owing to said Town for the year 1934 shall be payable
in cash.
BE IT FURTHER RESOLVED that any and all sales
heretofore made by said Town for which deed or deeds have
been heretofore made and executed by the Mayor and Clerk of
said Town, if any there be, shall be and they are in each
instance hereby specifically approved and confirmed, and
held to be in all respects the act of said Town of Boynton.
BE IT FURTHER RESOLVED that this Resolution shall
be signed by the Mayor and Commissioners, and attested by
the Town Clerk of said Town, and be placed on record in the
office of the Clerk of the Circuit Court of Palm Beach County,
Florida.
