OF THE TOWN OF BOYNTON, PALM BEACH
COUNTY, FLORIDA, AUTHORIZING THE
MAYOR AND CLERK OF SAID T0~¥N TO
ISSUE NOTES IN PAYMENT OF CERTAIN
INDEBTEDNE S SES.
WHEREAS the Town of Boynton, Palm Beach County,
Florida, is indebted to its attorney, Newman T. Miller, in
the sum of $1,949.50 for services rendered as such attorney
in the validation of Refunding Bond Issue in the sum of
$389,900.0Q and
WHEREAS THE said Town is indebted to the said Miller for
services in the representation of said Town in the suit of
Divine -vs- Town of Bo~ton, being Common Law #V568, and
WHEREAS said Town is indebted to said Miller for services
rendered in the foreclosure of certain tax sale certificates,
delinquent taxes, and assessments, and
WHEREAS said amount now due and owi~_~g on said foreclosure,
in addition to the payment heretofore made, is in the sum
of $3,500.00, but that the payment heretofore made plus the
sum of $3,500.00 is not the full and complete fee allowed
under the statute for this service when completed, and is
not the full amount h'~tended to be charged, and
WHEREAS the sum of money due and owing as of this
date by said Tom~ to said Miller for services rendered is
an amount equal to $5,599.50, and
WHEREAS the Town is without available cash with which
to pay said fees or any material part thereof, and
WHE~EAS §~id Miller is willing to take promissory notes
si~ed by the To~n~ of Boynt~, by its Mayor,~ attested by
its Clerk, wi~h the Torch's seal affixed toeach of said notes,
THEREFORE BE IT RESOLVED that the Mayor of said to~,
H. D. Stevens, z~d the Clerk of said Town, J. P. Bowen, be
and they are each hereby authorized, for za~d on behalf of
said Town, to make, execute, and deliver to said Newman T.
Miller, fourteen (14) promissory notes; nine (9) ofsaid
notes to be in the principal sum of Five Hu~dred Dollars (500.00);
two (2) of said notes to be in the principal sum of Three
HUndred Dollars ($300.00); one(l) of said notes to be in the
principal sum of Two Hundred Dollars ($200.00)~ one of said
notes to be in the principal sum of ~e Hundred Forty Nine
and 50/100 Dollars ($149.50)~ and one of said notes to be
in the principal sum of One Hhundred Fifty Dollars ($150.00),
making a total of Five Thousand Five Hundred Ninety N1ue and
50/100 Dollars ($5,599.50)~ each of said notes to be dated
September 5th, A. D. 1934, and
BE IT FURTHER RESOLVED that said notes and each of them
shall draw interest at the rate of six (6) per cent, per a~um
from the date thereof until fully paid, interest payable
semi-al~'~ua lly.
AND BE IT FURTHER RESOLVED that said Mayor m~d the
said Clerk of said Tow~, as well as their successors in
office, shall be and they are e~ch hereby authorized,
empowered, and instructed to renew any one or more of said
notes from time to time, if not paid when due.
