A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA,
AUTHORIZING THE CITY MANAGER TO EXECUTE
THE CONSULT ANT AGREEMENT BETWEEN THE
CITY OF BOYNTON BEACH AND THE RMPK
GROUP, TO INCLUDE ADDITIONAL SERVICES FOR
THE REWRITING OF THE LAND DEVELOPMENT
REGULATIONS, BASED ON BID #065-2414-0/KR;
AND PROVIDING AN EFFECTNE DATE.
WHEREAS, the City Commission upon recommendation from staff, deems it
appropriate to approve the change order for the Consultant Agreement for the Rewriting
of Land Development Regulations, contract #065-2414-02/KR, between the City and The
IRMPK Group, to include additional services not included in the original contract and a
'twelve (12) month extension for completion ofthe project;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1.
The City Commission of the City of Boynton Beach, Florida does
hereby authorize and direct the City Manager and City Clerk to approve the Contract
Agreement between the City of Boynton Beach and The RMPK Group, to include
additional services for the Rewriting of the Land Development Regulations, in the
amount of $56,000 and providing for a twelve (12) month extension of time to complete
the project, based on Bid #065-2414-02/KR.
Section 2.
This Resolution shall become effective immediately upon passage.

ADDENDUM NO.1 TO AGREEMENT BETWEEN CITY OF BOYNTON BEACH AND
THE RMPK GROUP, INC., DATED SEPTEMBER 17, 2002.
THIS ADDENDlTM, dated the ~ day of A~SI , 2003, is entered into
between the CITY OF BOYNTON BEACH, hereinafter refe~d to as "CITY", and THE RMPK
GROUP, INC., hereinafter referred to as "Consultant", in consideration of the mutual benefits,
terms, and conditions hereinafter specified, and shall constitute part of the Consulting Agreement
for Rewriting of Land Development Regulations for the City of Boynton Beach between the City
and Consultant, dated September 17, 2002.
WHEREAS, in 2002, the City released a Request for Proposals on the "Rewriting of
Land Development Regulations for the City of Boynton Beach", RFP #065-2414-021KR; and

Resolution R02-158, authorizing the proper City officials to enter into a Consulting Agreement
with Consultant to rewrite the Land Development Regulations of the City; and
WHEREAS, since the parties entered into the Consulting Agreement to furnish the
subject services, it has been dele~m;ned that the scope of services should be expanded; and
WHEREAS, City staff has recommended a..'1...1 the Consultant agrees that the Consulting
Agreement be amended to expand the scope of services.
NOW, THEREF'ORE, BOTH PARTIES AGREE AS FOLLOWS:
Section 1. That the Scope of Services as identified in Exhibit "A" of the Consulting
Agreement is hereby expanded to add the following:
1. Create new planned redevelopment district zoning to expand opportunities far
beyond traditional zoning systems;
2. Rewriting of entire Code to utilize and correspond with the Model Land
Development Code;
3. Incorporation of legal review and final draft codification; and
4. Meeting, scheduling, and notification services as needed.
Section 2.

That Paragraph 4.a. of the Consulting Agreement is hereby amended as

"B" attached hereto, provided that the total amount of payment to Consultant shall

Section 3. That the Exhibit "B", PAYMENT TO CONSULTANT, of the Consulting
Agreement is hereby amended to state as follows:

PAYMENT TO CONSULTANT
Budget and Timetable:
The budget for rewriting of the Land Development Regulations is a fixed fee of
$120,500.00, plus an additional $5,500.00 for contin!!encies. The contract period shall
not exceed twelve (12) months from the date of Addendum No. I.
The Consultant will be required to provide written status reports on or before. the 30th of

Section 4. In all other respects the original Agreement between the parties dated
September 17, 2002, and all amendments thereto are hereby ratified, reaffirmed and shall remain
in full force and effect as provided by their terms.
Section 5. Each person signing this Addendum on behalf of either party individually
wanants that he or she has full legal power to execute this Addendum on behalf of the party for
whom he or she is signing, and to bind and obligate such party with respect to all provisions
contained in this Addendum.
