A RESOLUTION OF THE CITY OF BOYNTON
BEACH, FLORIDA ASSESSING THE COSTS OF
ABATEMENT OF CERTAIN NUISANCES
AGAINST THE OWNERS OF THE PROPERTIES
INVOLVED; PROVIDING FOR AN
ADDITIONAL ADMINISTRATIVE FEE PRIOR
TO RECORDATION OF LIENS; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Manager or his designated representative, acting on behalf
>f the City, has pursuant to Section 10-5 of the Code of Ordinances of the City of
Boynton Beach, found and determined that the condition of certain property or parcels of
[and as hereinafter described violate Section 10-2 and 10-3 of said Code by reason of the
:xistence of excessive growth of weeds, grass, vegetation or other noxious plants or other
)ffensive substance detrimental to the health and welfare of the residents of the City,
:hereby constituting a nuisance; and
WHEREAS, the owners of the parcel(s) of property hereinafter described were
:luly notified in accordance with Section 10-5 of the City Code of Ordinances and were
:equired to abate the nuisance; AND
WHEREAS, said nuisance was not abated as required; and,
WHEREAS, pursuant to, and in accordance with the procedure set forth in
Zhapter 10 of the Code of Ordinances of the City of Boynton Beach, the City abated said
misance; and
WHEREAS, the property owners were then invoiced by the Finance Department
>n two occasions, with no response. /he bills were then were forwarded to a collection
~gency in an effort to recoup these costs, which efforts were also unsuccessful. On July
11, 2003, all of the property owners listed in the attached Exhibit "A" were sent letters
>ffering them an opportunity to remit within 30 days in order to avoid incurring a lien on
:heir property; and
WHEREAS, the City Manager or his authorized representative has made a report
>f costs actually incurred by the City and abatement of said nuisance as to the property(s)
involved, which is described in Exhibit "A" attached to this Resolution; and
WHEREAS, upon passage of this Resolution, the property owners will be
~'urnished with a copy of this Resolution, and given one more opportunity to remit all
costs associated with the abatement in full within 30 days of the passage of the
Resolution, before transmittal to the County for recordation of Liens; and

WHEREAS, at the time of recordation of Liens in the Public Records of Palm
Beach County, the City Clerk's o ~ce will add an additional administrative fee in the
mount of $30.00 to each Lien; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
tF THE CITY OF BOYNTON BEACH, FLORIDA AS FOLLOWS:
Section 1: Each Whereas clause set forth above is true and correct and
~corporated herein by this reference.
Section 2: The amount of costs incurred by the City and the abatement of the
~bove-described nuisance as to the parcels of land, owned and indicated to wit:
SEE ATTACHED COMPOSITE EXHIBIT "A"
(Charges cover Invoices dated October 2000 through December 2001)
Subject amount is hereby assessed as liens against said parcels of land as
indicated, plus an additional administrative charge of $30.00 for each
Lien. Liens shall be of equal dignity with the taxes therefrom for the year
2000 and 2001, depending on invoice date, and shall be enforced and
collected in like manner pursuant to applicable provisions of law. In the
event collection proceedings are necessary, the property owner shall pay
all costs of the proceedings, including reasonable attorneys fees.
Section 3. This Resolution shall become effective immediately upon passage.
