A RESOLUTION CONCERNING REQUEST OR PERMISSION
TO CONSTRUCT ,OPERATE, AND ],.LqINTAIN A CANAL
FOR NA~JIGATION PURPOSEB OVER AND ACROSS CER-
TAIi~ PORTIONf~ OF PULLiC STREETS AND HIGHWAYS:
LOOATED II~ THE TO~dN OF BOYNTON.
~¥HERiAS, it appears to this Commission that the
benefit and amvantages to be received by the people of this
Town from and/on account of the construction, operation
and maintenance by the 0nite~ States of said intracoastal
waterway are such., as to cause this Commission to grant the
permission thus requested;
NOW, THEREFORE, BE IT ~ESOLVED by the Tova'~ Com-
mission of the Town of Eoynton, Florida, as follows;
1. That perpetual permission and license is h~reby
given the Unite~ States of America, its officers, agents,
servants and contractors to enter upon, excavate, cut away
and remove any anm all of sai~ above mescribea tracts of lsa'~d
as may be required at any time for the construction and
maintenanc~ of said intracoastal waterway or any enlargement
thereof and to m~ntain the portion so excavated and the
channel thoroby created as a part of the navigable ~aters
of the United States; and the further perpetual right
and easement to enter upon, occupy and use any portion of
said tracts of land not so cut away and co~,vertod into
public navigable waters as aforesaid, for the deposit of
dredgea material and "or such other purposes as may be noed-
ful in the preservation and maintenanco of said intracoastal
waterway.
LE IT FUR~ER RESOLVED that permission and license
is hereby given the United States to deposit dred?ed material
upon such portions of the public streets and highways aajacent
to the above described parcels as may by the United States Dis-
trict Engineers be deemed necessary o~ useful to the United States
in the construction and ~.~intonance of the aforesaid waterway;
BE IT FUR'~:.IER RESOLVED that the Mayor for
and on behalf of this Commission be and he is hereby authorized
to execute such deeds, easements or other written instruments
as shall be necessary and proper to grant and convey said par-
cels, easemsnts and privile~es unto the United States of Ameri-
ca, and the Town Clerk of the: Town be and he is hereby
authorized and directed to attest the execution of such instru-
ments and to affix the seal of the Town of ~oynton, Florida
thereto.
