(A RESOLUTION LY THE MAYOR AND EOARD
OF TO~'6~ COMMISSIONERS OF THE TOWN OF
BOYNTON, PALM BEACH COUNTY, FLORIDA,
AUTHORIZING AND DIRECTING THE PAIQgENT
OF CERTAIN ATTORNEY' S tDEES TO SE PAIR
PA?TLY IN TAXES)
WHEREAS , the Tow~'~ Co~mniss~oners of the Town of Boynton,
Florida, at a regular metting thereof held on the 6th of October,
1931, did employ Shclby Buford as its solicitor and a',torney to
foreclose certain special assessments liens held by the said Tow~
of Eoynton against certain lots and parcels of land in Beverly
Hills, an addition to said Town of Boynton.
WHEREAS, FURTHER, the compensation fixed as attorney's
fees for his services was agreem upon at t~n percent of the amount
of principal and intorcst of ss id assessments so foreclosed upon
and cost, aha which sum was agreed to be pa~d and accepted
in payment of such taxes and assessments as such attorney might
de s igna t e.
~qEREAS, FURTHER, The Circuit Court of Palm Leach
County, Florida, by its Final Decre~ in said foreclosure suit,
dated January 11,1932, ordered the sale of the said properties
for said assessments, which said sales have been made.
And f rther, said ~ecree set the fees of the said attorney at
Two Thousand One tlundred Three and 21/lO0 ($2,103.21 ) Dollars,
for which the Town of Lo~a~ton is in receipt of a bill therefor.
NOW, THEREFOR E, EE IT RESOLVED That upon the payment
in cash by the said Shelby Eufo ,d of that portion of taxes
leviea for bond services, the Tax Collector is authorized and
instructed to issue, to Shelby Luford, tax receipts upon such
property as the said Shelby Buford might desiderate within the Town
of Boynton to the extent of Two ~ihousand One Hundred Three and
21/100 ($2,103.Sl) Dollars.
BE IT FURTHER RESOLVED, That at such times as there is
sufficient monies in the general treasury of the Town of Bo?fnton
to pay the interest and sinking fund, such amounts as were
levied for bond service, as shown by the tax levies on such
properties as might be designated by the said Shelby Buford, then
and in that event, the Tax Collector shall issue said tax receipts
without requiring tho said Shelby Euford to pay that pertain
levied for interest and sin~.ing fund in cash, and thereafter
transfer from the general treasury such amounts as might be
~'meded to pay said interest and sinking fund account, such sums
as levied for that purpose, as is represented by the tax receipts
issued hereunder.
It being the purpose and intent of this resolution to
require the pa~n.nent in cash of that portion levied for bond service
until and at such time as there might be sufficient monies in the
general treasury available for the payment of such respective
amounts levied for bond service or interest and sinkin~ ~und.
PROVIDED ALf~AYf~. That saic~ Shelby huford shall deliver
to said To~m, master's deed, deeding the property described in
sai~ decree, to the To~m o~ [oynton, before any adjustments or
pay~',~ents are made hereunder.
