03-045 I' ORDINANCE NO. 03 - 0 q f: AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING ABANDONMENT OF A FLORIDA POWER AND LIGHT EASEMENT, (NO. 03-007) MORE PARTICULARLY DESCRIBED HEREIN, SUBJECT TO STAFF COMMENTS; AUTHORIZING EXECUTION 0 F A DISCLAIMER, WHICH SHALL BE RECORDED IN THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the agent for Boynton Commerce Center Lot 3B, Winston Lee of Winston Lee and Associates, Inc., is requesting the abandonment of a Florida Power and Light easement that runs through the north Yz of Section 32, Township 45 South, Range 43 West, lying West of the Seaboard Airline Railroad right -of-way and East of the Lake Worth Drainage District Canal E-4, subject to staff comments; and WHEREAS, comments have been solicited from the appropriate City Departments, and public hearings have been held before the City's Planning and Development Board, and the City Commission on the proposed abandonment; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA THAT: Section 1. The foregoing Whereas clauses are true and correct and incorporated herein by this reference. Section 2. The City Commission of the City of Boynton Beach, Florida, does hereby abandon a Florida Power and Light easement, subject to staff comments, and more particularly described as follows: The north Yi of Section 32, Township 45 South, Range 43 West, lying West of the Seaboard Airline Railroad right-of-way and East of the Lake Worth Drainage District E-4 Canal SUBJECT to restrictions, reservations and easements of record, Palm Beach County, Florida. Section 3. The City Manager is hereby authorized and directed to execute and deliver the attached Disclaimer and cause the same to be filed in the Public Records of Palm Beach County, Florida. Section 4. This Ordinance shall take effect immediately upon passage.
