BOYNTON.13 Chapter 13 LICENSES* Art. I. Occupational licenses, §§ 13 - 1 — 13 - 51 (3) Any person who does not qualify under Art. II. Garage Sales, § 13 - 52 — 13 - 58 *Editor's note - Ord. No. 94 - 15, § 1, adopted June 21, 1994, provided for the deletion of Art. I, In general, and Art. II, Co ntractors, substantive sections thereof being §§ 13 - 1 — 13 - 22 and 13 - 33 — 13.41, as derived from Ch. 15 of the 1958 Code and numerous ordinances (see the Code Comparative Table, beginning on page 2701). ARTICL E I. OCCUPATIONAL LICENSES Sec. 13 - 1. Purpose; imposition and levy of tax. The governing body of Boynton Beach hereby establishes the City of Boynton Beach Occupational License Code and levies an occupational license tax for the privilege of engaging i n or managing any business, profession or occupation within its juris - diction. The occupational license tax is levied on: (1) Any person who maintains a permanent business location or branch office within the municipality, for the privilege of engaging in or managing any business within its jurisdiction. (2) Any person who maintains a permanent business location or branch office within the municipality, for the privilege of engaging in or managing any profession or occupa - tion within its jurisdiction. b u s i n e s s o r e n g a g e s i n a n y o c c u p a t i o n o r p r o f e s s i o n i n e d b y S e c (Ord. Definitions. o f For the purpose of this chapter, the following words shall have the meaning ascribed to them in this A section, unless the context requires otherwise: r t Ci ty. The City of Boynton Beach Florida, its i City Manager, or such officers, employees or depart c - ments designated by the City Manager to act on l behalf of the city. e City Manager. 1 The term City Manager shall mean that person holding the position of City Ma nager of the City of Boynton Beach, Florida or o his/her designee. f Classification. t Classification means the method by which a business or group of businesses is identi h - fied by size or type, or both. e Contractor. U A contractor shall mean any person whose work is defined in F.S. 489.105(a) through (p), n plus those exceptions as specified in Chapter 13, i Boynton Beach Code of Ordinances. t e Fiscal year d . Fiscal year means October 1 of a calendar year to September 30 of the following calendar year. S t Inventory. a Inventory shall mean those items commonly referred to as goods, wares and merchan t - dise which are held for sale, rental, or lease to others e in the ordinary course of business. s Number of workers. C The number of workers shall be determined by the total num o ber of paychecks n s 1 1998 S - 8 Boynton Beach Code 2 issued for all full time and part time workers, (2) Product vending machines: Machines nonprofessionals, subcontractors, contract workers, consultants, principals, and partners who worked for the business, occupation or profession during the previous calendar year. A new business shall be based on the number of workers as of opening day who are entitled to receive paychecks. All principals and partners in the business shall be deemed as workers and be included in the calculations. Occ upational License Administrator. The employee of the city designated by the City Manager as the person responsible for the operations of the division of the city which processes the issuance of occupational licenses. Person. Person shall mean an indivi dual, firm, partnership, joint adventure, syndicate, or other group or combination acting as a unit, association, corporation, estate, trust, business trust, trustee, executor, administrator, receiver, or other fiduciary, and includes the plural as well as the singular. Professional. A professional shall mean any person engaged in any business, occupation or profession who is required to maintain an active and valid State of Florida license, permit, or certificate from any of the state agencies or the Fl orida Bar. Specialty contractor. A specialty contractor shall mean any person whose work is limited to a particular phase of construction, and whose scope is limited to a subset of the activities in F.S. 489.105(a) through (p), plus those exceptions as specified in Chapter 13, Boynton Beach Code of Ordinances. Used car lot. Any business location within the municipal limits of the city engaged in the wholesale or retail sale of secondhand or used automobiles or other type of used motor vehicles. Vend ing or other coin - operated machines. Vending machines shall be classified as follows: (1) Amusement vending machines: Machines such as pinball and video games, pool tables, amusement rides, and the like. i m i t e d t (3) o Service vending machines: Devices such as , s o f t d r i n k s , j o u r n a l s , f o o d p r o d u c t s , a n d t h e a c h i (Ord . Conflict with statute. l The regulation of occupational licenses shall be a in accordance with this chapter and with Chapter u 205.013 - 205.1973, Florida Statutes. In the event of n any conflict d between this Occupational License Code and Florida Statutes, TITLE XIV. This includes rental property four units or less, including single family residential rentals, condominiums, and mobile homes. Licenses are issued for a period of st twelve months, from October 1 th to the following September 30 . They must be renewed annually. To avoid renewal late fees, rental license fees are payable by st th October 1 . After January 30 , late renewals require a Code Compliance (interior and exterior) inspection of the property. Whenever a rental property is sold or otherwise changes ownership, the new owner must do the following: (1) Apply for a new rental license; (2) Schedule an inspection of the rental wi th the Code Compliance Division. If the inspection process should reveal Zoning, Building, Housing or Fire Code violations, they must be corrected and a re - inspection made by the appropriate department. The owner is given adequate time to correct any vi olations. All violations must be corrected before occupancy will be approved. An owner may change his or her designation of a resident by notifying the city in writing of the name, address, and local telephone number of the person designated by the owner to replace the previous resident agent. Any notice of violation or legal proce ss which has been delivered or served upon the previous resident agent prior to the receipt of the city of notice of change of the resident agent shall be deemed effective service. It shall be the sole responsibility of the owner to appoint a reliable res ident agent and to inform the resident agent of his correct mailing address. Provision for unlisted businesses or occupations. The city may hereinafter classify and issue occupational licenses for businesses or occupations not specifically listed herein. The city shall establish a classificati on for new businesses or occupations in accordance with the United States Standard Industrial Classification of Establishments (SIC).
