Mayor Broening announced that the first regular City Commission meeting in November would
be held on November 5m, which is the day after the election.

a. City of Boynton Beach General Election - November 4, 2003
Mayor Broening announced that there would be a general election on Tuesday, November 4,
2003 to elect a Mayor and two Commissioners. A very important bond referendum will also be
on the ballot and he urged everyone to vote.
Presentation of $200,000 grant award for the development of Phase T of
the Southeast Neighborhood Park by State Representative Adam Hasner
and State Senator M. Mandy Dawson
John Wildner, Deputy Director of Recreation and Parks, explained that the City owns a 2.3-acre
piece of property in the southeast section of the City. For several years, the City has been
seeking funding to develop this parcel. The Recreation & Parks Department applied for a grant
with the Florida Recreation Development Assistance Program. With the assistance of both
Representative Hasner's office and Senator Dawson's office, they were successful in getting the
grant.

Representative Adam Hasner said that this was a $200,000 grant to provide a park in the
southeast portion of Boynton Beach. Tt will be a great improvement and he was glad to be a
part of it.

apologies for being late and reported that she was on her way.

Terrence Rothman, homeless, spoke regarding bullies. He said that their attitude is
prevalent in much of the male dominated professions. They are getting support for their
destructive rudeness from many public figures. He felt that there was a lot of bullying going on
that the public is not seeing. For example, the decision of Palm Beach County not to build
shelters for the homeless and destitute. Tt appears that the weakest are being used for political
reasons and this is not an appropriate attitude in a Christian society.
Mr. Rothman explained that because he is homeless, he carries a backpack containing his
belongings. Before he could enter the Commission Chambers tonight, two Police Officers
searched his backpack. He felt that was a form of bullying.
Elayne Russell announced that the League of Women Voters was having a Candidates Forum
on Monday, October 20th at 7:00 p.m. in the Commission Chambers. She urged everyone to
attend.
Mayor Broening recognized the presence of Senator Dawson who had arrived at the meeting.
Senator M. Mandy Dawson said that she was excited regarding the grant the City received
and said that her door is always open.
Shirley 3askiewicz, 1917 SW 13m Avenue, said that she attended the previous Commission
meeting and had some comments on things that were said. The Mayor had mentioned that in
1999, there was only $880,000 in income from the CRA. She said that the reason was because
the CRA area was very small at that time. With the efforts of the Visioning Committee, the area
was expanded.
Also, during the discussion regarding the Motorola property, City Manager Bressner mentioned
his concern regarding the roof blowing off (of City Hall). She expressed that same concern for
the 1TV property on Congress Avenue. She explained that the School Board had come to the
Commission for approval to expand four or five years ago. One of the contingencies of the
approval was that the property would be cleaned up. Tt was cleaned up but now it has reverted
to a worse condition that it ever was. There are abandoned portable classrooms there and it is
a blight on a beautiful street and should be cleaned up.
Ms..laskiewicz also requested that the Commission consider restoring the Old High School. She
suggested that it could be used to house the Police Department.
Herb Suss, Wood Fern Drive, said that at the last Library Board meeting, he was insulted by
a question that Alice Otis asked him. He said that it had nothing to do with Library Board
business. He requested a public apology.
Mayor Broening said that Mr. Suss was out of order and that this had nothing to do with
Commission business.
Debbie Lyl:le said she would defer her comments to the next Commission meeting because
she was hoping that the Union and the City were making some progress with negotiations and
she did not want to jeopardize that progress.

Proposed Ordinance No. 03 -048 Re: Amending Land
Development Regulations, Chapter 2, Zoning, Section 4.3 limiting the
distance a dock can extend into the canal to one-third (1/3) of the canal
width, to reduce the percentage to one-quarter (1/4) to coincide with
regulations of other agencies
City Attorney Cherof read Proposed Ordinance No. 03-048 by title only.
Bob Brown said that he checked with the Department of Environmental Protection, the South
Florida Water Management District, the Lake Worth Drainage District and the Army Corps of
Engineers. He understood that this 25% rule was just for guidance and was not etched in
concrete. Mr. Brown felt that the City would be making a mistake if it passed this ordinance.
Outside of grandfathering all docks, he thought that the City would be potentially violating other
people's private property rights. He requested that this item be tabled for two weeks so that
the City can obtain a statement from the other agencies specifying that there is a 25% rule.
Mr. Brown was also concerned because there is no definition of what a canal is. Without a
definition, he felt that there would be a problem with Code Enforcement or the Building
Department determining what a canal is.
He requested some exemptions. For instance, if an individual resides on a 100-foot lot with a
100-foot canal and buys a 70-foot Striker with a 25' beam, he would not have enough room for
the mooring pilings on the side. He suggested wording such as "25% on canals less than 100
feet wide or the beam of a vessel whichever is greater."
Mayor Broening believed that the reason they used the term waterway was because a
waterway is defined as being a navigable body of water. You could not bring in a 65' Hatteras
in most of the waterways in the City. He felt that some common sense must apply,
City Manager Bressner relayed Mr. Brown's concerns to the Building Department earlier today
and they contacted the Department of Environmental Protection and the Army Corps of
Engineers.
Don 3ohnson, Building Official, said that he had spoken with the Department of Environmental
Protection and the Army Corps of Engineers. This 25% is a distance that they use. It is not to
say that someone could not request a variance in some of the City's canals. He said that these

agencies look at navigability and the two people he spoke to said that they would not allow a
variance to encroach more because they must look at these docks in both daylight and evening
hours.
Mr. Johnson explained that the City is trying to make this as user-friendly as possible. The
City's ordinance now states 1/3. He told about a citizen who expended a lot of money to get an
engineer and this design professional went out 1/3 per the City's current ordinance. The Army
Corps of Engineers and the Department of Environmental Protection turned him down because
of the 25% rule that they use. Then, additional money had to be expended to redesign the
dock. This new ordinance allows the City to stay in tune with other agencies. Tt also opens up
the navigable waterway because the docks would not go out 1/3.
Vice Mayor Ferguson asked whether it was possible to postpone this until October 21st.
City Manager Bressner felt that the issues that the City has been addressing have been whether
the ordinance creates a hardship and he does not believe that it does. Staff believes that the
existing docks will remain.
The other question raised by Mr. Brown concerned what the disposition of the Department of
Environmental Protection and the Army Corps of Engineers would be with respect to the 25%
rule versus the 33%. Their standard is 25% and our current standard is 33%, which is more
liberal. However, unfortunately, this has placed citizens in a regulatory twilight zone. The
purpose of this ordinance is to bring the City's regulations into conformance with the State
regulations. Protection for existing docks was built into this.

That special conditions and circumstances exist which are peculiar to the land, structures,
or buildings in the same zoning district.
Response: A special condition exists in that there is no lot adjacent to the property to the rear. The
lot backs up to a street right of way (name of street). A special condition also exists in that the
location of the existing family room is at the rear of the house and is the logical starting point for
a simple addition that will meet the owner's requirements.

Response: The lot and house where purchased by the apphcant in the existing condition and
neither configuration was created due to the action of the applicant.

Response: Typical houses constructed within the R1AA zoning district would normally be much
larger than the subject property which is a 2 bedroom I bath 1 car garage with approximately
1233 square feet of living area. With thc proposed addition of 871 square feet and consisting of
an expanded family room, a home office, and a master bedroom and bath the square footage is
increased to 2104 square feet. This proposed area is consistent with what could be expected of
any new home within the same zoning district.

2. It is staff's preference that the grassed area located in Southwest 30~ Avenue X
(east of the curbed divider) be removed, the area paved and striped for left
turn lane into the site. Show roadway improvements for S.W. 30th Avenue,
including signing and striping. All oak trees on the east edge need to be a
minimum of ten (10) feet off the property line so that they can be maintained
in the future.

3. Palm Beach County Health Department permits will be required for the X
water and sewer systems serving this project (CODE, Section 26-12).
4. Fire flow calculations will be required demonstrating the City Code X
requirement of 1,500 g.p.m, as stated in the LDR, Chapter 6, Article IV,

are signed and sealed by a design professional registered in the state of
Florida shall be submitted for review at the time of permit application.
10. Buildings three-stories or higher shall be equipped with an automatic X
sprinkler system per F.S. 553.895.

recorded prior to the issuance of a building permit on Parcel "A" since it
appears that the lot will be subdivided into two (2) separate lots. No replat
would be necessary.
18. If / when Parcel "B" is developed, the integrity of the "temporary turn- X
around" area shall be preserved. However, any changes to the "turn-around"
area would be reviewed and approved by staff.

19. The height (mid-point) of the decorative towers must be reduced by three (3) X
inches in order to comply with the maximum height of 45 feet in the M-1
zoning district.
20. The Palm Beach County Traffic Division has approved the project for 93,300 X
square feet of mini-warehouse. The site plan proposes a 95,588 square foot
building. Although minor in nature, a revised impact statement with the
matching building area would be required and must be approved by the
Traffic Division prior to the issuance of a building permit.
21. The use of the self-storage facility shall be limited to Chapter 2, Section O. 1.c X
of the Land Development Regulations. The storage bays shall not be used to
manufacture, fabricate or process service or repair vehicles, boats, small
engines or electrical equipment, or to conduct similar repair activities;
conduct garage sales or retail sales of any kind; or conduct any other
commercial or industrial activity on the site (Chapter 2, Section O. 1 .c.).
22. No vehicle or boat maintenance, or repair shall be permitted on-site (Chapter X
2, Section O. 1.).
23. On the landscape plan, ensure that the plant quantities match between the X
tabular data and the graphic illustration.
24. All project signage is subject to review and approval of the Planning & X
Development Board and City Commission. The cumulative area of all wall
signage must comply with Chapter 21, Article 4, Section C. In addition, on
the elevations, indicate the sign type, material, and letter colors. The colored
rendering shows that letter colors appear to match the roof color (cyan). Staff
recommends the same.
25. The base of the sign shall be enhanced with colorful groundcover plants and a X
minimum of two (2) shrubs. Staff recommends reducing the height of the
proposed freestanding monument sign from nine (9) feet - six (6) inches to
eight (8) feet. Also, clearly identify proposed sign area and show the site
address at the top of the monument sign (Chapter 21, Article 4, Section 5.B.).
Staff also recommends that the color of the monument sign's letters match the
letter color of the wall signs.
26. Staff recommends substituting the two (2) Gumbo Limbo trees proposed west X
of the building (along Congress Avenue) with two (2) Live Oak trees.
27. Staff recommends planting additional clusters of palm trees (single or double X
trunked and at least 12 feet in height) within the landscape strips along the
north, south, and west sides of the building in order to break up the great wall
expanse.
28. Staff recommends planting a row of colorful groundcover plants (outside of X
the proposed Redtip Cocoplum hedge) within the landscape strip adjacent to
