O90-09ORDINANCE NO .. 90- ~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA AMENDING ARTICLE X. PARKING LOTS. SECTION 5-141. DEFINITIONS; PROVIDING THAT EACH AND EVERY OTHER TERM AND PROVISION OF ARTICLE X. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AUTHORITY TO CODIFY; PROVIDING AN ~EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the City Commission of the City of Boynton Beach has reviewed Article X, Section 5-141 of the City Zoning Code and has determined that an amendment thereto is necessary; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. Article X. Parking Lots. Section 5-141 of the Code of Ordinances, City of Boynton Beach, Florida, is hereby amended by adding the words and figures in underlined type, as follows: Section 5-141. "Definitions" (i) Parking lot: Any outdoor?or partially enclosed or enclosed space, plot, yard or any portion thereof, which is utilized for the parking or storage of vehicles upon which two (2) or more parking stalls are constructed. Parking facilities designed for detached single-family homes, duplex units, with a maximum of four (4) parking stalls are exempted from this definition. This exemption shall not be construed to apply to multifamily units that do not contain garages. Section 2. Each and every other provision of Article X. Parking Lots. Section 5-141. Code of Ordinances of the City of Boynton Beach, Florida, shall remain in full force and effect as previously enacted. Section 3. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 4. Should any section or provision of this ordinance or portion hereof, any paragraph, sentence, or invalid, such decision shall not affect the remainder of thiS ordinance. Section 5. Authority is hereby granted to codify said ordinance. Section 6. This ordinance shall become effective immediately upon passage. FIRST READING this / day of _~~ 1990. I propose a change to Our Parking Lot Ordinance whereby paved lots Which are not utilized for Vehicular parking are not c!assif-ied as parking lots. A strict reading of the ent code would demand that any paved lot, which is not utilized for ting purposes, maintain wheel stops, striping and other code related ~irements. other remedy to 100% maintenance would be to strip the asphalt and ~rlying shell rock and sod or seed the site.
