AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING CHAPTER 5, BUILDING CODE,
SECTION 5-3 ADOPTION OF THE STANDARD
BUILDING BY ADOPTING THE STANDARD
BUILDING CODE, 1988 EDITION, TOGETHER
WITH UNIFORM MINIMUM PALM BEACH
COUNTYWIDE AMENDMENTS AS RECOMMENDED BY
THE BUILDING CODE ADVISORY BOARD OF PALM
BEACH COUNTY; PROVIDING A CONFLICTS
CLAUSE; A SEVERABILITY CLAUSE; AUTHORITY
TO CODIFY; AN EFFECTIVE DATE AND FOR
OTHER PURPOSES-
WI{EREAS, the City of Boynton Beach is mandated by Palm
Beach county to adopt the same basic construction codes as
all-municipalities in Palm Beach county; and
WREREAS, the Building code Advisory Board of Palm Beach
county has recommended the adoption of the 1988 standard
codes with uniform minimum countywide amendments-
NOW, THEREFORE, BE IT ORDAIn-ED BY ~ CITY COMMISSION
OF T~IECITYOF BOYI~TON BEACI{, FLORIDA:
Section 1. That Chapter 5 of the codified
ordinances of the City of Boynton beach, Florida, Building
code, Section 5-3 Amendment to Building code is hereby
amended to read as follows:
Sec. 5-3 Building code Adopted
The Standard Building code, 1988
Edition, together with the Model
countywide Amendments to the Standard
Building Code, 1988 Edition, including
Appendix B, C. F. H. I and R of the
Standard Building code, Appendix 1 and 2
of the Amendments to the Standard
Building Code, the Model Countywide
Administrative Code, 1988 Edition for
the Building, Electric, Gas, Mechanical
and plumbing codes, copies of which are
now on file in the office of the
Building official of the City, is hereby
adopted and established as the Uniform
Standard Building code of the City,
except that building permit fees shall
be as provided in Section 5-4 of this
code of ordinances.
Section 2. That the amendments listed in Section 1.
are attached hereto and made a part hereof by reference.
Section 3. Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4. Should any section or provision of this
ordinance or any portion hereof be declared by a Court of
competent jurisdiction to be invalid, such decision shall
not affect the remainder of this ordinance.
Section 5. Authority is hereby granted to codify said
ordinance.
Section 6. This ordinance shall become effective
immediately upon passage.

100 - INCORPORATION
The Model Countywide Administrative Code is hereby adopted by
reference and is incorporated as if herein, and is intended to provide
for the administrative aspects of the Standard Building Code and these
amendments thereto.
CHAPTER 2
DEFINITIONS
202 - DEFINITIONS
AGENCY - means same as apDlicable qoverninq body.
FLOOR GRADE - minimum floor qrade for residential buildinq to be twelve
(12) inches above sidewalk or crown of road qrade; commercial
industrial buildinq to be six (6) inches above the sidewalk or crown
road qrade, unless satisfaCtory drainaqe, natural, or mechanical i~
provided. Mandatory flood plain, Coastal Zone Protection Act of 1958,
So~th Florida Water Manaqement District elevation, or septic tank
requirements, whichever is hiqher, must be adhered to.
GOUERNING BODY
. - means same as Applicable Governinq Body.
MARQUEE - means a permanent roofed structure attached to and supported
bY the buildinq.

CLASSIFICATION OF BUILDING BY OCCUPANCY
403 - MIXED OCCUPANCY SEPARATION
403.~ -' SEPARATION BETWEEN TOWNHOUSES - Each townhouse shall be

rating. Plumbing, piping, ducts, electrical or other building services

2. . Such wall shall be continuous from the foundation to the
underside of the roof sheathing. The roof sheathing shall be of
honcombustible material or exterior grade fire retardant treated wood,
or one layer of 5/8 in Type X gypsum wallboard attached to the
underside of the roof decking, for not less than a 4 ft. width on each
side of such wall.
3. Each dwelling unit sharing such wall shall be designed and
constructed to maintain its strUctural integrity independent of the
unit on the opposite side of the wall.
EXCEPTION: Said wall may be penetrated by roof and floor
structural members provided that the fire resistance rating and
the structural integrity of the wall is maintained.
