O89-51ORDINANCE NO. 89-~-/ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, RELATED TO THE COASTAL TOWERS CONDOMINIUM APARTMENTS, LOCATED IN PARTS OF LOTS 53 AND 54 DEWEY'S SUBDIVISION, SAID LOCATION MORE PARTICULARLY DESCRIBED HEREIN EXEMPTING SAID CONDOMINIUM APARTMENTS FROM THE PROVISIONS OF APPENDIX A - ZONING, SECTION 11.1 NON-CONFORMING USES AND STRUCTURES, F. RECONSTRUCTION OR REMOVAL; PROVIDING A SEVERABILITY CLAUSE; AN EFFECTIVE DATE AND FOR OTHER PURPOSES. WHEREAS, the City Commission of the City of Boynton Beach wishes to exempt the Coastal Towers Condominium Apartments from the application of Appendix A - Zoning, Section ll.1 Non-conforming Uses and Structures F. Reconstruction or Removal, to permit said condominium apartments to be rebuilt, repaired or reconstructed if destroyed in excess of seventy (70%) percent of the valuation as determined by the Palm Beach County Property Appraiser; and W~RREAS, the City Commission of the City of Boynton Beach intends to permit such rebuilding should the need arise to the original specifications and height of said structures notwithstanding the 45 foot height limitation contained elsewhere in the Zoning Code, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. That the Coastal Towers Condominium Apartments are hereby exempt from the provisions of Appendix A - ZONING, Section 11.1 Non-conforming Uses and Structures F. RECONSTRUCTION OR REMOVAL. Section 2. The Coastal Towers Condominium Apartments are described for purposes of this Ordinance as: That part of Lots 53 and 54, Dewey's Subdivision, Boynton Beach, Palm Beach County, Florida, as recorded in Plat Book 1, Page 37, Public Records of Palm Beach-County, Florida, lying west of the west right of way line of the Intracoastal waterway as shown in Plat Book 17 on Page 12 A, and less the right of way of Ocean Avenue (State Road 804) as shown in Road Plat Book 2 on page 248, Public Records of Palm Beach County, Florida. Section 3. Should any section or provision of this ordinance or portion hereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this ordinance.
