O89-50ORDINANCE NO. 89-~-~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING APPENDIX A-ZONING, SECTION 11. SUPPLEMENTAL REGULATIONS, TO ALLOW FOR SEASONAL OUTDOOR RETAIL SALES SPONSORED BY NOT FOR PROFIT ORGANIZATIONS; PROVIDING THAT EACH AND EVERY OTHER PROVISION OF APPENDIX A-ZONING. NOT SPECIFICALLY HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE AND FOR OTHER PURPOSES. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OFT HE CITY OFBOY1TTON BEACH, FLORIDA: Section 1. That Appendix A-Zoning· Section 11. Supplemental Regulations. is hereby amended by creating a new sub-subsection N. Special seasonal sponsored outdoor retail sales, as follows: Special seasonal sponsored outdoor retail sales: Special seasonal outdoor retail sales sponsored by not for profit organizations shall be permitted in any non-residential zoning district, subject to the following regulations: The event is sponsored by a not for profit civic, religious, school or governmental organization. The sponsors secure an occupational license for the duration~ of the event, and comply with all other applicable codes and ordinances. Written approval must be secured from the owner of the property. Liability insurance which is sufficient to cover the liability for the event shall be the responsibility of the property owner and event sponsor. Adequate parking is provided for the event. Such event or combination of events shall not exceed a maximum duration of three (3) weeks per calendar year on any one parcel of land. However, a two (2) week extension may be provided, if conditions warrant. Permits for all temporary structures, lighting and signs must be secured. If a tent is used for the event, the tent shall be constructed of fire-retardant treated material and shall comply with the latest edition of the Southern Standard Building Code, as adopted by the City. Farmers' markets, flea markets, sales bazaars, swap shops, trading posts and the sale or display of used retail merchandise shall be prohibited. Section 2. That each and every other provision of Appendix A-Zoning. not specifically amended herein shall remain in full force and effect as previously enacted. Section 3. That all ordinances or parts of ordinances conflict herewith be and the same are hereby repealed. Section 4. Should any section or provision of this )rdinance or portion hereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this ordinance.
