AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING CHAPTER 16 PARKS AND
RECREATION, ARTICLE II CITY PARKS &
BEACHES, SECTION 16-82 RAISING THE
RESIDENT TEMPORARY PARKING PERMIT FEES
OF RESIDENTS FROM $5.00 TO $7.00;
RAISING THE FEE FOR REPLACEMENT DECALS
FROM $3.00 TO $5.00; RAISING THE FEE
FROM $3.00 TO $5.00 FOR GUESTS STAYING
WITH RESIDENTS; PROVIDING A REPEALING
CLAUSE; PROVIDING A SAVINGS CLAUSE;
PROVIDING AUTHORITY TO CODIFY; PROVIDING
AN EFFECTIVE DATE AND FOR OTHER
PURPOSES.
NOW, THEREFORE, BE IT HF~RRY ORDAINED BY THE CITY
COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AS
FOLLOWS:
Section 1. That Chapter 16, Parks and Recreation,
Article II, City Parks & Beaches, Section 16-82 Policy No. 1
is amended by adding the words and figures in underlined
type and deleting the words and figures in struck-through
type, as follows:
Section 16-82. Rules, regulations controlling parking
of vehicles at municipal beach property located within the
Town of Ocean Ridge.
The City Manager is hereby directed to implement
subject procedures at the earliest possible date. (Said
regulations are set out below.)
POLICY NO. 1 PARKING PERMITS
Parking permits will be issued on an annual basis
(October 1 through September 30) with issuance beginning
September 1 each year to residents (see "definitions") of
the City of Boynton Beach, for a charge of Seven Dollars
($7.00) for the first decal issued to a resident vehicle,
upon satisfactory completing of appropriate application
forms. Applicants will be required to establish proof of
residence in the 'City of Boynton Beach (see "definitions")
and to present his official state motor vehicle tag
registration certificate.
When application is made for more than one permit, each
separate individual vehicle registration must be presented.
Residents who are not property owners must establish
residency by some suitable means, such as voter's
registration, executed lease, utility bills or other legal
document.
Permanent beach parking permit decals shall be issued
at a charge of ~ve-~a~s-~$~e~ Seven ($7.00) Dollars
only to residents owning, leasing, renting, occupying or
residing in real estate in the city for at least six (6)
months of each year. Temporary parking permits shall be
issued to residents owning, leasing, renting, occupying or
residing in the city for less than six (6) months at a
charge of ~ve-~a~s-~$~e8~ Seven ($7.00) Dollars. Proof
of six (6) months' residency, if property is not owned,
shall be established by lease agreements, rent receipts or
written lessor verification.
Lost or mutilated parking permits. In the event that
the vehicle to which the permanent decal was issued has been
sold or otherwise changed ownership and/or in the event a
properly issued parking decal is mutilated and can be
identified, such decal will be replaced for a charge of
~h~ee -~a~s -~$~r99~ Fi~e ($5.00) Dollars provided the
holder can return an identifiable portion of the mutilated
parking decal to the city. In the event the holder of a
lost or mutilated parking permit cannot provide an
identifiable portion or part of such parking decal, the
charge for a replacement decal will be the sum of ~e
~a~s-%$~88~ Seven ($7.00) Dollars. Lost decals will not
be replaced until after a thirty-day waiting period from the
date the decal is reported lost.
Section 2. That Chapter 16, Parks and Recreation,
Article II, City Parks & Beaches, Section 16-82, the first
two paragraphs of Policy No. 3 is amended by adding the
words and figures in underlined type and deleting the words
and figures in struck-through type, as follows:
POLICY NO. 3. TEMPORARY PARKING PERMITS
Temporary parking permits will be issued by the city in
accordance with Policy Numbers 1 and 2.
Residents: Residents who do not own property and who
lease, rent, or occupy living accommodations for less than
six (6) months of each year shall be issued a temporary
parking permit for a charge of ~ve-~a~s-~$5~88~ Seven
($7.00) Dollars which shall be valid for a maximum period of
six (6) months from the date the permit is issued.
Visitors: Guests staying with residents shall be
issued a temporary parking permit at a charge of ~h~ee
~a~s-~$~=88~ Five ($5.00) Dollars. Such permits shall be
valid for a maximum time period of four (4) consecutive
weeks.
Section 3. All ordinances or parts of ordinances in
conflict herewith, are hereby repealed.
Section 4. That should any section or provision of
this ordinance or portion thereof be declared by a court of
competent jurisdiction to be invalid such decision shall not
affect the remainder of this ordinance.
Section 5. Authority is hereby granted to codify
the provisions of this ordinance.
Section 6. This ordinance shall be come effective
immediately upon passage.
