O89-31 (2)ORDINANCE NO. 89-~/ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, STATING THE AGGREGATE MILLAGE RATE TO BE LEVIED AGAINST PROPERTY OWNERS WITHIN THE CITY FOR THE 1989-1990 FISCAL YEAR; PROVIDING THAT THE CITY MANAGER SHALL HAVE THE AUTHORITY TO ADJUST THE AGGREGATE MILLAGE RATE UPON RECEIPT OF THE FINAL TAX ROLL; PROVIDING FOR AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the City Charter of the City of Boynton Beach, Florida, and the Laws of Florida require an appropriation ordinance be passed by the City Commission of said municipality each year adopting the budget; and WHEREAS, Florida-Statutes 200.065(2)(d) requires that prior to the adoption of the final budget that an ordinance stating the aggregate millage rate proposed by the municipality be passed; and WHE~S, said ordinance must also state the percent of increase in property taxes adopted by the governing body; and WHEREAS, said aggregate millage rate must be adopted separately and before the budget of the community; and WHEREAS, the City of Boynton Beach, Florida, has followed the procedures as outlined in Florida Statutes 200.065; and WHEREAS, Florida Statutes 200.06~5)~ 'provides for a ministerial adjustment of the aggregate millage rate after receipt of the final tax roll. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYltTON BEACH, FLORIDA: Section 1: That the Proposed Tentative Aggregate Millage Rate for the 1989~-1990 Fiscal Year shall be 7.2821 (6.7443 for the General Fund, ~.0378 for the Publicity Fund and .5000 for the Capital Improvement Fund), plus .8311 for Voted Debt Service for a total Proposed Tentative Millage Levy of 7.9132 for the 1989-1990 Fiscal Year. Section 2: That said Millage Rate exceeds the computed roll-back rate by 2.34% percent. Section 3: That upon receipt of the final tax roll if said roll indicates that the certified taxable value within the district has decreased from the original tax roll presented to the City by the Property Appraiser's Office, that the City Manager shall within three (3) days make the ministerial adjustment to the aggregate millage rate to assure that the same amount of taxes shall be collected by the City. Said adjustment shall be reported to the Property Appraiser within three (3) days of receipt of the final tax roll. Section 4: That this Ordinance shall become effective upon its second reading and final passage. FIRST READING this day of September, 1989.
