04-017 2_ ORDINANCE NO. 04-~ / 7 2 AN ORDINANCE OF THE CITY OF 3 BOYNTON BEACH, FLORIDA, 4 REGARDING THE APPLICATION OF 5 EDWARD EATMAN m, AMENDING 6 ORDINANCE 02-013 OF SAID CITY BY 7 REZONING A PARCEL OF LAND MORE 8 PARTICULARLY DESCRIBED HEREIN, 9 FROM C-2 (NEIGHBORHOOD 2_0 COMMERCIAL) TO R-1-A (SINGLE 2_1 FAMILY RESn)ENTIAL); PROV DINH 2_2 FOR CONFLICTS, SEVERABrLrr¥ AND 3 AN EFF CTIV DATE. 14 :15 WHEREAS, the City Commission of the City of Boynton Beach, Florida has 2_ 6 adopted Ordinance No. 02-013, in which a Revised Zoning Map was adopted for said 2- 7 City; and 18 WHEREAS, Edward Eatman ~I owner of the property more particularly :1_ 9 described hereinafter, has heretofore filed a Petition, through his agent, Don Stacks, 20 >ursuant to Section 9 of Appendix A-Zoning, of the Code of Ordinances, City of 2 2_ Ioynton Beach, Florida, for the purpose of rezoning a tract of land consisting of 22 approximately 0.11 acres, said land being more particularly described hereinafter, 23 from C-2 (Neighborhood Commercial) to R-1-A (Single Family Residential); and 24 WItEREAS~ the City Commission conducted a public heating and heard 25 testimony and received evidence which the Commission finds supports a rezoning for 26 the property hereinafter described; and 27 WHEREAS, the City Commission finds that the proposed rezoning is 28 consistent with an amendment to the Land Use which was contemporaneously 29 considered and approved at the public heating heretofore referenced; and S:\CA\OrdinancesLPlanningXRezoningXRezoning - 503 North Seacrest.doc '1 WHEREAS, the City Commission deems it in the best interests of the 2 nhabitants of said City to amend the aforesaid Revised Zoning Map as hereinafter 3 ;et forth. 6 NOW, THEREFORE, BE IT ORDAINED BY THE CITY 5 COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: 6 Section 1. The foregoing Whereas clauses are true and correct and 7 incorporated herein by this reference. 8 Section 2. The following described land, located in the City of Boynton Beach, 9 Florida as set forth as follows: ]-0 3-1 Lot 147, Block B, BOYNTON HILLS, according to the Plat 12 thereof, as recorded in Plat Book 4, Page 51, of the Public 3_3 Records of PALM BEACH County, Florida. 14 55 :[ 6 ,e and the same is hereby rezoned from c-2 (Neighborhood Commercial) to R-1-A (Single 3_7 ~amily Residential). A location map is attached hereto as Exhibit "A" and made a part of 3- 8 tis Ordinance by reference. ]_9 Section 3: That the aforesaid Revised Zoning Map of the City shall be amended 2 0 ccordingly. 2 3- Section 4: All ordinances or parts of ordinances in conflict herewith are 2 2 hereby repealed. 2 3 Section 6: Should any section or provision of this Ordinance or any portion 2 zl ~ereof be declared by a court of competent jurisdiction to be invalid, such decision shall 2 5 ot affect the remainder of this Ordinance. 2 6 Section 7.
