AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA AMENDING LAND DEVELOPMENT
REGULATIONS, CHAPTER 2 "ZONING", SECTION 6.C.
TO ALLOW MINOR AUTO REPAIR AS CONDITIONAL
USES IN STAND-ALONE BULDINGS WITHIIN
COMMERCIAL MASTER PLANS IN THE C-3 ZONING
DISTRICT; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND AN EFFECTIVE
DATE.
WHEREAS, the City Commission, upon recommendation of the Planning and
)evelopment Board and the Community Redevelopment Agency, does deem it appropriate
md in the best interests of the citizens and residents of the City of Boynton Beach, to amend
he Land Development Regulations of the City of Boynton Beach to allow minor auto repair
ts conditional uses in stand-alone buildings within commercial master plans in the C~3
:oning district;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
I'HE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The foregoing whereas clause is true and correct and is now ratified and
onfirmed by the City Commission.
Section 2. Chapter 2. "Zoning", Section 6.C.l.cc of the Land Development
',egulations of the City of Boynton Beach Code of Ordinances is hereby amended by adding
~e words and figures in underlined type, and by deleting the words and figures in struck-
~rough type, as follows:
Section 6. C. 1.cc(2) On sites of greater than five (5) acres and less than seventy-five
(75) acres, all such uses shall be located either (i) in a shopping center and within the
principal building of the shopping center or (ii) within a commercial master plan in
which event such building may be free standing;"
Section 3. Each and every other provision of the Land Development Regulations
ot herein specifically amended, shall remain in full force and effect as originally adopted.
Section 4. All laws and ordinances applying to the City of Boynton Beach in
onflict with any provisions of this ordinance are hereby repealed.
Section 5. Should any section or provision of this Ordinance or any portion
~ereof be declared by a court of competent jurisdiction to be invalid, such decision shall not
ffect the remainder of this Ordinance.
Section 6. Authority is hereby given to codify this Ordinance.
