O89-29 AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING THE CHARTER OF SAID CITY,
ARTICLE IV ADMINISTRATION, SECTION 49.
GENERAL PROVISIONS.; TO PROVIDE THAT THE
CITY MANAGER SHALL WORK AT THE PLEASURE
OF THE CITY COMMISSION; BY AMENDING
PROVISIONS DEALING WITH INTERFERENCE
WITH SAID ADMINISTRATION; BY DELETING
PROVISIONS IMPOSING PENALTIES; PROVIDING
A CONFLICTS CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING AUTHORITY
TO CODIFY; PROVIDING AN EFFECTIVE DATE
AND FOR OTHER PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That Article IV Administration. Section
49. General provisions, is hereby amended by adding the words
and figures shown in underlined type and by deleting the words
and figures shown in struck-through type as follows:
( a ) Administrative officers, departments and
agencies· The government of the City shall be carried on by
the Mayor and City C~Hwc~i-1- Commission~__w~_. They shall
appoint a City Manager r and City Attorney, who bot~ shall
serve at the .-leasure of th---~~Commission. There shall
also be a~ such other officers, departments and agencie~sas
may be established from time to time by ordinance to perform
such duties and receive such compensation as may be prescribed
by resolutions adopted by the City e~e~ Commission. All
other officers of the City shall be appointed by the City
ManagerCommission ' .subject to confirmation by the City
(b) Supervision by City Manager· Each department,
office and agency under the direction and supervision of the
City Manager shall be administered by an officer appointed by
and subject to the direction and supervision of the City
Manager. With the consent of G~i~ Commission_, the City
Manager may serve as the head of one or more such departments,
offices or agencies or may appoint one person as the head of
two or more of them or may combine the functions of any
offices specified in this charter which may be appointed by

Sect%on 2_ That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
Section 3._ Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or word
be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of this
ordinance.
