10 BEACH, FLORIDA, ACKNOWLEDING THE
11 i DEDICATED PUBLIC ACCESS TO THE
12 I INTRACOASTAL WATERWAY AND
13 I CONFIRMING CONTINUED PUBLIC
14 OWNERSHIP OF PROPERTY LYING IN
15 I SECTION 15, TOWNSHIP 45, SOUTH, RANGE 43

16 i EAST, AND DESCRIBED AS THE 4.2 NORTH
17 I AND SOUTH WALKWAYS AS PLATTED IN
18 I PLAT BOOK 8, PAGE 57, OF THE PUBLIC
19 RECORDS OF PALM BEACH COUNTY,
20 FLORIDA; AND PROVIDING AN EFFECTIVE
21 DATE.

23 WHEREAS, the City Commission of the City of Boynton Beach considered a
24 request for vacation/abandonment of the lands (walkways) described in Exhibit "A"
25 attached hereto; and

26 i WHEREAS, the residents of the Lakeside Gardens Community have
27 demonstrated that the lands (walkways) described in Exhibit "A" and Exhibit "B" have
28 been utilized for their intended purpose as access to the Intracoastal Waterway; and
29 WHEREAS, the residents of the Lakeside Gardens Community have
30 demonstrated that the lands (walkways) described in Exhibit "A" and Exhibit "B" have
31 been maintained by the residents of the Lakeside Gardens Community; and
32 WHEREAS, the City Commission of the City of Boynton Bach denied the
33 request for vacation/abandonment of the publicly owned lands (walkways) and has
34 determined a public need is served and has validated the public access to the Intracoastal
35 Waterway.

1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION

2 I OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:

3 I Section 1. Each Whereas clause set forth above is hereby ratified as being true
4 I and correct and incorporated herein by this reference.
5 Section 2. The City Commission of the City of Boynton Beach acknowledges
I
6 the continued public use of the property in Exhibit "A" for access to the Intracoastal
7 Waterway.
8 Section 3. The City Commission of the City of Boynton Beach confirms the
9 public ownership of the property described in Exhibit "A".
10 Section 4. The City Clerk shall forward a copy of this Resolution to the Clerk
11 of Courts for recording in the public records for Palm Beach County.
12 Section 5. This Resolution shall take effect immediately upon passage.
