Minutes 10-01-04MINUTES OF THE CITY COMMISSION AGENDA PREVIEW CONFERENCE HELD IN THE COMMISSION CHAMBERS, CITY HALL, BOYNTON BEACH ON FRIDAY, OCTOBER 1, 2004 AT 10:00 A.M. Present Jerry Taylor, Mayor Mike Ferguson, Vice Mayor Bob Ensler, Commissioner Mack McCray, Commissioner Carl McKoy, Commissioner Kurt Bressner, City Manager Janet Prainito, City Clerk James Cherof, City Attorney CALL TO ORDER Mayor Taylor called the meeting to order at 10:02 a.m. and announced that Father Sam Zebron was unable to do the invocation because the meeting was changed to Monday. Commissioner McCray offered to do the invocation. City Attorney Cherof announced that he would like to add an item under XII.D., in regard to PBA Memorandum of Understanding. II-OTHER: A. Informational Items by Members of the City Commission: · Commissioner McCray requested from departments a list of all the homes in District Two that were affected by the storm. Vice Mayor Ferguson reported an incident at the train tracks. He noted that two trains passed through the City last Thursday resulting in a one hour and twenty minute wait. If anyone on the east side of the City needed emergency services, Fire Rescue would not have reached them. Ill-ANNOUNCEMENTS, COMMUNITY & SPECIAL EVENTS & PRESENTATIONS: A. Announcements: Mayor Taylor announced that the Regular City Commission Meeting will be held on Monday, OCTOBER 4, 2004 @ 6:30 P.M. allow the Commission to participate in activities related to Police Accreditation. Minutes Agenda Preview Conference Boynton Beach, Florida October 1, 2004 VI-CONSENT AGENDA: C,2, Proposed Resolution No. R04-176 Re: Approving a revised fee structure for Boynton Beach Memorial Park and Sara Simms Memorial Gardens Commissioner McCray noted that he would pull this item at Monday's Commission meeting for public input. Authorize the City Manager to work with the Boynton Cultural Centre, Inc. who is requesting the opportunity to define, develop and design use for and operate the Old High School in partnership with the City Mayor Taylor announced that he would like to pull this item for discussion. He said the people downtown would like a see a state of the art Civic Center, which would become a major attraction in the City. The old high school should be demolished and some elements of the old high school could be incorporated into the new Civic Center. The Madsen Center could be demolished and a floor in the new Civic Center could be set aside for those programs. Also, a floor could be devoted to the Children's Museum. Mayor Taylor said the Center should be special and should draw people from downtown and all over. He noted that the Boynton Cultural Centre wanted to work with the City in refurbishing the Old High School. They would like to offer more museum activities for older children that required more room and in which Mayor Taylor was in favor of doing. City Manager Bressner said the public has a special interest in the Old High School because it is close to City Hall. Commissioner McCray inquired about the cost to clean up the Old High School building. City Manager Bressner responded that he would get the price from Risk Management. J. Authorize repair to private property due to utility system damage This item was added to the Consent Agenda as Item J. City Attorney Cherof recommended following past practice of the City by denying the claim to private property since the damages were not caused by negligence of the City. Direct the Occupational License staff to extend the Occupational License renewal deadline to October 31, 2004, without application penalty This item was added to the Consent Agenda as Item K. 2 Minutes Agenda Preview Conference Boynton Beach, Florida October 1, 2004 City Manager Bressner responded that the reason was location related. He needed a decision with the Board of EOC, to track changes in voting precinct and track any population that District #3 has. He said with all of District #2 they should see a difference. XII.4 Proposed Ordinance No. 04-078 Re: Amending Chapter 15 of the Code of Ordinances entitled "OFFENSES-MISCELLANEOUS" Article IV, Community Appearance and Maintenance, Section 15-120 Vice Mayor Ferguson noted that after reviewing the ordinance he could not support the new height from 10 feet to 14 feet. He commented that vehicles should have clearance without touching the trees. Fire Chief Bingham reported that they were experiencing a lot of damage to the trucks due to inadequate clearance. Commissioner McKoy requested clarification. Chief Bingham responded that oftentimes the ladders are damaged. This Ordinance would provide greater clearance that is needed for safety reasons. XII.D.1 Request for approval from City Commission to grant the CRA the ability to secure debt up to the amount of $19,575,000 secured by the CRA Tax Increment Revenues (YIF) Commissioner McCray reported that the Commissioners received a letter from Legal stating that the request was acceptable, but he would like to hear from Finance whether this would infringe on the City's bond ratings. Commissioner Ensler questioned whether there would be a surplus where the City could owe for the bond. If there is a surplus, what would happen to the millions that are mentioned on the last page of the memo. City Manager Bressner replied that it would pay off the debt service. City Manager Bressner also explained that the CRA is requesting that the City guarantee the payment of the bonds to be issued by the CRA. Discussion ensued regarding interest rates and insurance. Mr. Bressner commented that it is not expected that the guarantee by the City would have any effect on the ability of the City to proceed with any debt issuance that maybe undertaken by the City for the foreseeable future. XlI. D.2. Approval of PBA Memorandum of Understanding Mayor Taylor announced that this item is a walk on and the City Attorney would provide a memo to the Commission at the Commission meeting. Minutes Agenda Preview Conference Boynton Beach, Florida October 1, 2004 OTHER: Mayor Taylor announced that due to the proximity of the meeting date for December 21, 2004 to the holidays they were considering canceling the December 21, 2004 meeting. He pointed out that there would be no change for the first meeting in December that is scheduled for Tuesday, December 7th. There was general consensus for the December 21, 2004 meeting to be cancelled. Mr. Livergood provided an update on the schedule for the vegetation pickup after the storms. He explained that there were no more contractors in town; therefore, he and his staff have been working diligently and were getting close to a normal pickup schedule. Mr. Livergood said some people have been paying private entities to pick up their trash and vegetation because the piles have gotten big. City Manager Bressner pointed out that they would need to keep their receipts and submit them to FEMA. He said the Monthly Bulletin would go out Friday, October 1,2004. Mayor Taylor and City Manager Bressner expressed their gratitude to Mr. Livergood and his staff. They said he did a great job.
