AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING APPENDIX A - ZONING. SECTION 1.
DEFINITION OF TERMS, GRADE, FINISHED;
AMENDING SECTION 4.J.1. AND 2. GENERAL
PROVISIONS, OTHER STRUCTURES, TO FURTHER
CLARIFY HEIGHT RESTRICTIONS ON FENCING,
HEDGES, AND WALLS; PROVIDING THAT EVERY
OTHER PROVISION OF APPENDIX A - ZONING,
NOT SPECIFICALLY AMENDED HEREIN SHALL
REMAIN IN FULL FORCE AND EFFECT AS
PREVIOUSLY ENACTED; PROVIDING A
CONFLICTS CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING AUTHORITY
TO CODIFY; PROVIDING AN EFFECTIVE DATE;
AND FOR OTHER PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Appendix A - Zoning, Section 1.
Definitions of terms, is hereby amended by adding the words
and figures in underlined type and by deleting the words and
figures in struck-through type, as follows:
GRADE, FINISHED. The average level of
the finish surface of the ground
adjacent to the exterior walls of the
~~ structure.
Section 2.
Appendix A - Zoning, Section 4. General
provisions, subsection J. Other Structures. sub-subsection
1. and 2. are hereby amended by adding the words and figures
in underlined type and by deleting the words and figures in
struck-through type, as follows:
1. Fences, hedges and walls shall not
exceed six (6) feet in height, above
finish grade, in residential zones,
except that from the building line to
the front line the maximum height shall
be four (4) feet. When walls or fences
are constructed as a part of a
subdivision or site plan approval
adjacent to a public right-of-way,
consistent with this section, a setback
of a minimum of eighteen (18) inches
must be maintained for landscaping
purposes.
2. Fences, hedges and walls in other
zones shall not exceed six (6) feet in
height , above finish grade except in
e-P PID and M-1 zones, chainlink fences
shall be allowed to eight (8) feet
height and may be topped by not more
than three (3) strands of barbed wire.
Section 3. Each and every other provision of Appendix
A - Zoning. of the Code of Ordinances of the City of Boynton
Beach, Florida, not specifically amended herein shall remain
in full force and effect as previously enacted.
Section 4. That all ordinances or parts of
ordinances in conflict herewith be and the same are hereby
repealed.
Section 5. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or
word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
this ordinance.
