3 A RESOLUTION OF THE CITY OF BOYNTON
4 BEACH, FLORIDA, REAFFIRMING THE
5 APPOINTMENT OF KURT BRESSNER AS CITY
6 MANAGER OF THE CITY OF BOYNTON BEACH,
7 FLORIDA AND AUTHORIZING THE MAYOR AND
8 CITY CLERK TO EXECUTE AN AMENDMENT TO
9 THE EMPLOYMENT AGREEMENT ON BEHALF
10 OF THE CITY WITH KURT BRESSNER, AND
11 PROVIDING AN EFFECTIVE DATE.

13 WHEREAS, on the 7th day of December, 2004, the City Commission conducted
14 a performance evaluation of the City Manager; and
15 WHEREAS, the City Commission has determined that salary and benefit
16 modifications are to be made to the employment agreement between the City of Boynton
17 Beach and Kurt Bressner, City Manager, as set forth in the Amendment attached hereto as
18 Exhibit "A".
19 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
20 OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
21 Section l. The City Commission of the City of Boynton Beach, Florida
22 authorizes the Mayor and City Clerk to execute an Amendment to the Employment
23 Agreement between the City of Boynton Beach and Kurt Bressner, City Manager, a copy
24 of the Amendment being attached hereto as Exhibit "A".
25 Section 3. This Resolution shall become effective immediately upon passage.

AMENDMENT TO EMPLOYMENT AGREEMENT
WHEREAS, the City Commission conducted a performance review of the City Manager
on December 7, 2004, and unanimously reaffirmed the appointment of Kurt Bressner as City
Manager of the City of Boynton Beach; and
WHEREAS, it is the desire of the City Commissioners, hereinafter called "Commission"
to provide certain benefit enhancements to the Employment Agreement entered into between the
City and Kurt Bressner, dated March 7, 2000;
NOW, THEREFORE, the Commission and City Manager agree as follows:
l. That paragraph 2.0 Salary. Sub-section§. 2.1 and 2.2 , ffi--are hereby I
amended by adding the words and figures in underlined type and by
deleting the words and figures in struck-through type, as follows:
2.l. City agrees to pay City Manager for his services an annual salary of
ONE HUNDRED TWENTY THREE THOUSf.l'm ($123,000) ONE I
HUNDRED FORTY THOUSAND ($140,000) DOLLARS payable in
equal periodic installments, paid at the same time that other managerial
employees of the City are paid. Said salary adjustment shall be retro-
active to .^.pril I, 20030ctober 1,2004. I
2.2 The City Commission will periodically review City Manager's
performance. The first evaluation shall occur approximately six (6)
months from date of employment. The City Commission shall also
provide the City Manager with an annual performance evaluation which
shall occur on or about October I st commencing October I, 2005 and each
vear thereafter.
2. That 10.0 Vacation, Sick Leave, Disability, Dental, Health, Life Insurance,
Retirement, Memberships and ProfessionalÆducation Development
subsection 10.4, is hereby amended by adding the words and figures in
underlined type and by deleting the words and figures in struck-through
type, as follows:
10.4B. In addition to the salary paid by the City to City Manager, the City
agrees to pay aH aHl0HHt eqHal to ten (10%,) of the City Manager's base I
salary or, $11,8 I 0 $ 14,8 I 0 annually, '.vhiehever is less, ~a retirement
account on behalf of the City Manager. The City Manager, shall annually
direct distribution of the funds into either the ICMA-RC Fund or the City's
General Employee Pension Fund.
3. That 9.0, Automobile is hereby amended by adding the words and figures
in underlined type and by deleting the words and figures in struck-through
type, as follows:
9.1 City Manager shall be pro'lided with a late model HHmarlced
veITiele for business and unrestricted persoBal use. The Citv Manager shall
be provided a monthly car allowance of $450.00.
9.2. City shall maintaiB the vehicle aBd sA.all previde property damage,
persenalliability and comprehensive insurance in accerdanee with ClHTent
insuranee coverage pslieies ofthe City.
3. Each and every other paragraph of said Employment Agreement dated March 7, 2000, not
specifically herein amended shall remain in full force and effect.
IN WITNESS WHEREOF, the City of Boynton Beach, Florida has caused this
Agreement to be signed and executed in its behalf by its Mayor and duly attested to by its City
