MINUTES OF THE REGULAR CITY COMMISSION MEETING HELD IN
COMMISSION CHAMBERS, CITY HALL, BOYNTON BEACH, FLORIDA, ON

Mayor Taylor called the meeting to order at 6:30 p.m.
Dr. Marshall Cook offered the Invocation, followed by the Pledge of Allegiance to the Flag
led by Mayor Taylor.

Mayor Taylor opened the floor to nominations for Vice Mayor.
Commissioner Ensler nominated Commissioner McCray for Vice Mayor. Since there were
no other nominations, Commissioner McCray was named the Vice Mayor by acclamation.
Vice Mayor McCray accepted the honor with humility and thanks. Mayor Taylor praised
Vice Mayor McCray for his devotion to duty in his own district and to the entire City.
City Clerk Janet Prainito administered the Oath of Office to Vice Mayor McCray.
Plaques were presented to the Commissioners and Mayor in appreciation for their service
during 2003-2004. The plaques were received with thanks.

Mayor Taylor presented a gift to former Vice Mayor Ferguson in recognition of his
dedicated service to the City and for the many instances when he had filled in for the
Mayor when the Mayor was unable to attend certain ceremonies.

Commissioner Ferguson moved to approve the agenda as presented. Commissioner McKoy
seconded the motion that passed 5-0.
II. OTHER:
A. Informational Items by Members of the City Commission
Mayor Taylor invited Ms. Elizabeth Jenkins to the podium where Vice Mayor McCray
honored Ms. Jenkins for her tireless service in the northeast community for over forty
years. Vice Mayor McCray cited Ms. Jenkins' involvement in organizations such as the
Planned Approach to Community Health, the Boynton Hills Neighborhood Association, the
Women's Circle, the City of Boynton Beach Senior Advisory Board, and the Martin Luther
King Wellness Center. Vice Mayor McCray thanked Ms. Jenkins on behalf of the City and
the entire community for her hard work over the years.
Commissioner McKoy announced that the Palm Beach County Caucus of Black Elected
Officials would be giving away more than a thousand turkeys to those in need on
Thursday, November 18, at the old Jai Alai building on 45th Street in Riviera Beach
beginning at 3:00 p.m.

Beverly Agee, 832 S.W. 33rd Place, Boynton Beach, came forward to announce the
Principal for a Day program that was to be held on Thursday, November 18, and invited all
interested persons to attend. Ms. Agee explained that this was a program whereby area
businesses and community leaders partner with the local schools to give them support of
various kinds on an ongoing basis.

regarding the Wilson Project Master Plan
Wilfred Hawkins, Assistant City Manager, introduced Recreation & Parks Director Wally
Majors, Sr. Recreation Manager Mary DeGraffenreidt, and Parks Superintendent Jody
Rivers, who participated in this presentation. Mr. Hawkins stated that staff had put
together what they believed was a very good Master Concept Plan for the new Wilson
Center and hoped to receive the Commission's approval to proceed to the engineering and
final design stages. Much time had been spent obtaining the input of the neighborhood
residents and this input was incorporated into the Plan.
Wally Majors, Recreation & Parks Director, thanked staff for their efforts to bring the
project to its current state. He was confident that this project, when completed, would
become the focal point of the entire Heart of Boynton project. It was hoped that
construction could begin after the school year in 2005.
Angelina Fairchild and Michael Spruce of Kimley-Horn and Associates, Inc. gave
a PowerPoint presentation of the Master Plan concept for the Wilson Center. A copy of the
presentation is available in the City Clerk's office.

Commissioner Ensler inquired about the cost of the interactive pool and the linear park.
Mr. Majors responded that the interactive pool would cost about $800K (not currently in
the budget) and the linear park would cost $444K and would probably be funded by
monies expected from the Florida Department of Transportation as part of an ongoing
grant program.
The challenge to having the interactive pool was the necessity of staffing since it would be
like a regular pool and would require lifeguards. Also, the existing pool building would
have to be upgraded to handle the increased load on the building. Mr. Majors suggested
that a splash playground type of facility would be an attractive alternative to the full
interactive pool, but he would aggressively pursue funding for the interactive pool if the
Commission so desired. Mr. Bressner offered to get more information about the cost
impacts of the interactive pool including the upgrading of the building. Vice Mayor McCray
commented that during the Heart of Boynton meetings, a splash type pool was one of the
features that the residents really wanted.
Mayor Taylor commented on the large amount of glass in the main building and inquired
about the availability of storm shutters. Ms. Fairchild responded that they planned to use
impact glazing on the windows, eliminating the need for shutters. Mr. Hawkins added that
the impact-glazed windows had been tested to withstand winds of 140 mph.
Commissioner McCray asked if the fac;ade of the pool building would be the same as the
main building and Ms. Fairchild commented that it would be separate but harmonious. Ms.
Fairchild responded affirmatively that there would be a pool heater of the geothermal
type.
Commissioner Ferguson recommended that John Spannuth, a member of the Recreation &
Parks Board, be called on for his expertise in the area of pools and water recreation.
IV. PUBLIC AUDIENCE:

before the City Commission>
Alice Warren, 1719 Woodfern Drive, Boynton Beach, said she had changed the
name of her neighborhood association organization from COBACK to Community
Association of Boynton Beach (CAB) at the request of COBWRA, the coalition of West
Boynton Beach neighborhood associations. Ms. Warren praised the City for using Federal
grant money to help the neediest people find appropriate housing, in reference to an
article that had appeared in the paper. She was also pleased with the City's Citizen's

Action System where citizens could call and have their concerns addressed. She suggested
that the City of Boynton Beach copy the practice of Delray Beach and E-mail meeting
agendas, newsletters and other notices to people who subscribed to the service. She
suggested putting a request on the water bill asking people to submit their E-mail
addresses if they wished to participate in such a system. She believed this would facilitate
communication between the City and its residents.
Mike Fitzpatrick, 175 S.W. 2nd Street, Boynton Beach, asked for clarification on the
Jaycee Park item on the current County Commission agenda.
Mayor Taylor responded that this was an item approving a grant to Boynton Beach in the
amount of $lM for the purchase of Jaycee Park.
Sunny Garcia, 1631 N.W. 3rd Lane, Boynton Beach, spoke in favor of granting the
Union negotiation requests of the Police such as: 1) a Step Plan for pay, 2) the City
helping pay for insurance for married Officers, and 3) provisions for take-home cars. Also,
during the hurricane emergency, surrounding Cities such as Boca Raton, West Palm
Beach, and Lake Worth had Police Officers present at intersections where lights were not
working and he asked why this did not happen in Boynton Beach. He felt that the Officers
put their lives on the line for the City every day and that their requests should be granted.
Herb Suss, 1711 Woodfern Drive, Boynton Beach, agreed with Mr. Garcia's
comments in relation to the requests of the Police. He also suggested that the City
consider training its Citizens on Patrol force in the art of traffic control so they could step
in and assist, freeing the Police up for more urgent activities. Mr. Suss mentioned that he
went out in the City to do property assessments as part of his CERT responsibilities. He
did not think that was any different than having the Citizens on Patrol force out at traffic
lights, with proper instruction beforehand. Mr. Suss was happy with the progress of the
Wilson Center. He also praised the City Manager and said that when the time came to
renegotiate his contract, he hoped the Commissioners would realize that he was the best
City Manger the City had ever had.
Since no one else wished to come forward to speak, Mayor Taylor closed the Public
Audience.

Vice Mayor McCray approved the Consent Agenda as amended. Commissioner McKoy
seconded the motion that passed 5-0.
Consent Agenda Item VJ.E1, Edward Medical Office (NWSP 04-012) - 3908 North
Federal Highway - Request for a new site plan approval for an 11,796 square foot medical
office building in the C-3 zoning district
Commissioner Ensler stated that he had been to the CRA meeting where this item had
been denied. The two concerns he recalled were that there did not appear to be a
landscape plan that was mutually agreed upon. Also, there was a concern about the color
of the building, "Orange Blast." He asked the applicant to address these two concerns.
Also, he asked Mr. Rumpf whether a sign had been submitted for approval with the
application.
Michael Rumpf, Planning & Zoning Director, stated that a sign had been submitted and it
was in the existing package.
Attorney Cherof swore in all those who wished to give additional testimony on this item.
He also gave general directions pertaining to all Public Hearing items.
Hany Edwards, 2657 N.W. 29th Avenue, Boca Raton, asked Mr. Rumpf if there were
any restrictions in regard to proceeding with the site plan. Mr. Rumpf responded that
there were no time restriction limitations on resubmitting projects that had been denied.

Mr. Edwards then asked Mr. Rumpf to tell the Commissioners about setbacks for the C-3
zoning district in which the proposed project resided. He asked that Mr. Rumpf include
what the setbacks were and who could use them. Mr. Rumpf replied that the City's zoning
regulations allowed some flexibility in side setbacks. It did not specify a minimum side
setback; however, if there was no rear access to the property, one side was allowed to be
"zero" and the other is not allowed to be "zero." Otherwise, two zero setbacks on the side
could be allowed.
Mr. Edwards asked when and where an applicant could put a property flush with the
property line in the City of Boynton Beach. Could he put property on the zero setback in
the proposed location? Mr. Rumpf replied that he could do so in a C-3 zoning district.
Since Mr. Edwards' building did not have rear access, the building could be placed at the
property line on one side, as long as there were no encroachments across that property
line with above or below ground structures.
Mr. Edwards noted that the Planning & Zoning Department had approved this project. He
addressed the CRA's objections, saying that they had asked him to increase the top of the
building two feet in order to cover the air conditioning units and they had done so. The
CRA asked that they connect the first and second floors with some columns, and they had
done so. The CRA asked them to add five feet on the side of the property for landscaping
and they were unable to do this because of the size of the property in relation to the
design of the building. In an attempt to accommodate this request, they had provided two
cutout atriums for landscaping in the south-facing rear of the building. This placement also
accommodated the last CRA objection, which was that the length of the building was
unrelieved by landscaping. Mr. Edwards had shown the corrections and revisions to Mr.
Hutchinson, the CRA Director, and Mr. Hutchinson had approved them.
Vice Mayor McCray asked Mr. Edwards where the alluded-to Police report was, and Mr.
Edwards responded that he could provide it if requested.
It appeared to Mayor Taylor that the project met the City's Codes.
Commissioner Ensler noted that there had been no response on the Condition of Approval
for preserving the existing live oaks on the property. Also, he requested more information
about the paint color. He asked Mr. Rumpf if the Planning & Zoning Department had
approved the paint color, and Mr. Rumpf responded that they had approved the current
color, which was a much lighter hue than the original submission.
Commissioner Ensler asked the applicant if he agreed with the Conditions of Approval Nos.
30 through 34.

Dan Carter, 74 N.E. 5th Avenue, Delray Beach, landscape architect for the project,
responded that they agreed with and had addressed all the mentioned conditions except
Condition #31 concerning the existing live oaks. Unfortunately, the hurricane destroyed
all the previously existing live oaks and damaged the banyan tree extensively. They would
mitigate this according to the City's requirements.
Mayor Taylor asked whether the applicant agreed with all of the Conditions of Approval.
Mr. Carter responded that they agreed with all the conditions except the request from the
CRA for a five-foot landscape strip on the south property line, i.e. setting the building
back. A five-foot landscape strip on that side would not create a meaningful, large-scale
landscape strip. The only thing that could go there would be a hedge. Mayor Taylor
understood that this would be above and beyond the Code and Mr. Rumpf assented.
Vice Mayor McCray asked if there were any problems with the sign for the project. Mr.
Rumpf responded that the sign was required to be located at least ten feet from the front
property line. If it were not located or cited on the site plan or no dimension were
included, it would be noted in the Conditions of Approval as a reminder of what the Code
requires.

Vice Mayor McCray moved to approve Consent Agenda Item VI.E.1, Edward Medical
Office (NWSP 04-012) - 3908 North Federal Highway - Request for a new site plan
approval for an 11,796 square foot medical office building in the C-3 zoning district,
subject to all Conditions of Approval. Commissioner McKoy seconded the motion.
Commissioner Ferguson noted that the CRA's objection to the southern view had been
ameliorated to some extent.
The motion passed 5-0.

XI. NEW BUSINESS:
A. Discussion of Suspended Animation, Inc. (proposed use for zoning
verification) (TABLED ON NOVEMBER 3, 2004)
Commissioner Ferguson suggested removing item XI.A from the table. Commissioner
Ensler asked Attorney Cherof if the City was ready to discuss this, and the response was
negative. The decision was to leave it on the table.
B. Review of Possible Changes to Compensation for the City Commission
Mayor Taylor invited public comment on this item.
Alice Warren, 1719 Woodfern Drive, Boynton Beach, spoke against the proposed
changes to compensation for the City Commission. She stated that the Commission had
doubled its compensation the previous year and gave themselves "presents" each year.
Ms. Warren cited tough financial conditions, downsizings, companies closing, and the fact
that the Delta Airlines pilots had just accepted a third cut in salary in five years. Also, she
believed this issue belonged on the ballot so the people could decide. She felt that if the
Commissioners were not happy with the compensation, they could finish out their terms
and return to private life.
Mayor Taylor stated that last year's raise in compensation had been the first in twenty
years and it was not done every year.
Herb Suss, 1711 Woodfern Drive, Boynton Beach, was not in favor of the proposed
changes to compensation, although he had supported the previous year's increase. He
believed that it was too soon to come back for more money. He recommended that the
$30K saved by not having an election for the two unopposed Commissioners be spent to
support the Boynton Beach Vetsville or to hire another fireman or policeman. He expected
the Commission to exercise its fiduciary responsibility to the citizens and not increase its

compensation. He would be in favor of life and disability insurance, however. Mr. Suss felt
that if the Commissioner's compensation were increased, they would be making more
money than some people who work 35-40 hours each week. Mr. Suss believed that the
Commissioners had agreed to serve the public and he felt they should do so. If they were
unhappy with the compensation provided, they should resign.
Mike Fitzpatrick, 175 S.W. 2nd Street, Boynton Beach, spoke in favor of the
proposed increase to compensation. He believed that Boynton Beach had grown to "big
city" proportions and that the salaries should be commensurate. Also, even if the
compensation were doubled, doubling a small amount still did not amount to very much.
There were a lot of retirees and young people who would not be able to run for office on
the existing salaries, especially since it seemed to be a nearly full-time job now. He felt
there should be youthful representation on the Commission and that increasing the
salaries would help to attract them. The overall amount of the change was small and
would be a good thing for the City.
Sunny Garcia, Rolling Green, expressed agreement with the sentiments of Mr. Herb
Suss earlier. He thought it was ridiculous that the Commission got a raise the previous
year and was coming back for another one this year.
Brian Edwards, 629 N.E. 9th Avenue, Boynton Beach, spoke in favor of the increase.
He recommended that this action be taken before the elections the previous year and he
did so for a number of reasons. One of them was that an increased salary would attract
some young, worthy, brilliant people who could not otherwise have afforded to run for
office in Boynton Beach. He thought that the Commissioners should have asked for more
last year, especially since they had not increased their salaries in 20 years. Still, their
salaries were not doubled.
Mr. Edwards also commented about the newspaper articles about the Union negotiations
and stated that he hoped the City was doing all it could for its employees and not just at
negotiation time.
Beverly Agee, 832 S.W. 33rd Place, Boynton Beach, spoke in favor of the proposed
increase. She watched what the Commissioners did every day and felt she could speak to
them and get her point across at any time. There was no other way for the people to
show their appreciation for all their hard work except to grant this increase. The current
amount was not sufficient. In regard to the Union negotiations, she hoped that it would
all work out well since the City had a fine set of Police officers.

Commissioner Remarks
Commissioner Ferguson stated that all of the Commissioners were putting in no less than
30 hours a week. The figure of $6K was chosen after examining the benefits of employees
in the surrounding cities for Iifejdisability/healthjdental insurance and pension benefits.
He felt that the Commission had been engaging in public sacrifice, not public service, and
the enactment of this change would put things back into the proper perspective.
Motion
Commissioner Ferguson moved to amend the Code to increase Commissioner
compensation by $6K each, to start April 1, 2005 and be indexed annually for inflation.
Vice Mayor McCray seconded the motion for discussion.
In regard to the Union negotiations for Fire and Police, Vice Mayor McCray stated that the
citizens were saying, "Give them what they want - do the right thing." However, it
seemed that the Commissioners did not get the same consideration. He did not feel that
the Commissioners were being compensated for the amount of work they do.
Commissioner McKoy stated that he puts in about 50 hours a week on Commission
business. He felt that this was big business and should be treated as such. Staff members
had yearly reviews and increases on a regular basis. They receive these increases because
they take care of the City. The Commissioners take care of the City also.
Commissioner Ensler referred back to the decision the Commission faced about how long
the term should be for Commissioners and the Mayor. When they made a decision, they
decided not to have it take effect during the terms of the Commissioners who made the
decision. He would personally prefer that this increase also not take place during the
terms of the current Commissioners. He did believe that the amount was reasonable. He
observed that of nine area cities, Boynton Beach was in the bottom third on Commissioner
compensation.
Mayor Taylor stated that all the members of the City Commission worked hard. He did not,
however, consider himself an employee of the City and could not agree with the
comparison between the Commissioners and the City employees. The City could not hire
or fire them, only the people who elected them. When this Commission was elected, no
one ran for office for the money or to supplement or generate income. The issue of
whether the amount they were currently receiving was equal to the amount of time they
put in was debatable. Mayor Taylor could not support the motion.
The motion passed 3-2, Mayor Taylor and Commissioner Ensler dissenting.

Unfortunately, the CRA board denied my site plan twice, Because of 4 different
issue, I have made the changes they required except one which is to provide 5
feet wide as a landscaping on the south border of the property.
The property zoned as C. 3, Which is allow me to put a building on the property
line ( Please see the attached set back's requirements )
I'm not asking for varying and to change any law in City of Boynton Planning and
Zoning, But I am asking you to honor your law and requirements.
In C.3 zoning you allow ( 0 -15 feet) on the side of the property, Who, Where
and when? this law apply, and If can be used, Why not in this property?
I have been already denied with the C.RA board twice, Which put me behind
the construction 3 months, Plus the additional expenses to update all my drawing
and plans. Beside the increasing of the construction coast 30-40% last 6 month.
Currently, the property is vacant and has a little building, which has been broken
in three times by the Homeless and drug users causing the community lots of
trouble and risk.
I am trying to put a nice beautiful medical office Building in the property, Which
will help the community in all there medical need ( Even with a building right on
the border line) shall be better than another business such as night club or X
rated Video store.
I hope this issue shall be solved tonight with your fair Judgment and caring to
City of Boynton Beach.

1. Show sight triangles on the Landscape plans (Chapter 7.5, Article II, Section X
5.H.). Reference FDOT Standard Index 546 for the sight triangles along
Federal Highway.
2. Paving, Drainage and site details will not be reviewed for construction X
acceptability at this time. All engineering construction details shall be in
accordance with the applicable City of Boynton Beach Standard Drawings
and the "Engineering Design Handbook and Construction Standards" and
will be reviewed at the time of construction permit application. Full drainage
plans, including drainage calculations, in accordance with the LDR, Chapter
6, Article IV, Section 5 will be required at the time of permitting.
UTILITIES
Comments:
3. At the time of permitting, please provide a timeline that clearly illustrates X
when water and sewer services will be required to serve the proposed project.
Your starting date for the time line should be the date of City Commission
approval. Also provide milestone dates for permit application, the start of
construction, and the setting of the first water meter. This timeline will be
used to determine the adequacy of water and wastewater treatment capacity
for your project upon the project's completion, so please be as accurate as
possible.
4. All utility easements shall be shown on the site plan and landscape plans (as X
well as the Water and Sewer Plans) so that we may determine which
appurtenances, trees or shrubbery may interfere with utilities. In general,
palm trees will be the only tree species allowed within utility easements.
Canopy trees may be planted outside of the easement so that roots and
branches will not impact those utilities within the easement in the foreseeable

future. The LDR, Chapter 7.5, Article I, Section 18.1 gives public utilities
the authority to remove any trees that interfere with utility services, either in
utilitv easements or nublic ri"hts-of-wav.
5. Palm Beach County Health Department permits will be required for the water X
and sewer svstems servin" this nroiect (CODE, Section 26-12).
6. Fire flow calculations will be required demonstrating the City Code X
requirement of 1,500 g.p.m. (500 g.p.m. some residential developments) with
20 p.s.i. residual pressure as stated in the LDR, Chapter 6, Article N, Section
16, or the requirement imposed by insurance underwriters, whichever is
QTeater (CODE, Section 26-16!h)).
7. The CODE, Section 26-34(E) requires that a capacity reservation fee be paid X
for this project either upon the request for the Department's signature on the
Health Department application forms or within seven (7) days of site plan
approval, whichever occurs first. This fee will be determined based upon
final meter size, or exnected demand.
8. Comprehensive Plan Policy 3.C.3.4. requires the conservation of X
potable water. As other sources are readily available City water shall
not be allowed for irri"ation.
9. A building permit for this project shall not be issued until this X
Department has approved the plans for the water and/or sewer
improvements required to service this project, in accordance with the
CODE, Section 26-15.
10. Utility construction details will not be reviewed for construction X
acceptability at this time. All utility construction details shall be in
accordance with the Utilities Department's "Utilities Engineering
Design Handbook and Construction Standards" manual (including any
updates); they will be reviewed at the time of construction permit

14. At time of permit review, submit signed and sealed working drawings of the X
orooosed construction.
15. Add to the building that is depicted on the drawing titled site plan and floor X
plan a labeled symbol that identifies the location of the handicap accessible
entrance doors to the building. 2001 FBC, Sections 11-4.1.2, 11-4.1.3, and
11-4.3.
16. Add to the drawing the calculations that were used to identify the minimum X
number of required handicap accessible parking space/so Also, state the code
section that is annlicable to the comnutations.
17. Identify within the site data the finish floor elevation (lowest floor elevation) X
that is proposed for the building. Verify that the proposed elevation is in
compliance with regulations of the code by adding specifications to the site
data that address the following issues:
The design professional-of-record for the project shall add the following text
to the site data. "The proposed finish floor elevation _. _ NGVD is
above the highest 100-year base flood elevation applicable to the building
site, as determined by the SFWMD's surface water management construction
develonment rel!ulations."
18. As required by the CBBCO, Part III titled "Land Development Regulations", X
submit a site plan that clearly depicts the setback dimensions from each
property line to the leading edge of the building/s. The leading edge of the
building/s begins at the closest point of the overhang or canopy to the
property line. In addition, show the distance between all the buildings on all
sides.
19. Every exterior wall within 15 feet of a property line shall be equipped with X
annroved oneninl! nrotectives ner 2001 FBC, Section 705.1.1.2.
20. Buildings, structures and parts thereof shall be designed to withstand the X
minimum wind loads of 140 mph. Wind forces on every building or structure

21. Every building and structure shall be of sufficient strength to support the X
loads and forces encountered per the 2001 FBC, Section 1601.2.1 and Table
1604.1. Indicate the live load (pst) on the plans for the building design.
22. Add to all plan view drawings of the site a labeled symbol that represents the X
location and perimeter of the limits of construction proposed with the subject
request.
23. At time of permit review, submit signed and sealed working drawings of the X
proposed construction.
24. CBBCPP 3.C.3.4 requires the conservation of potable water. City water may X
not, therefore, be used for landscape irrigation where other sources are readily
available.
25. A water-use permit from SFWMD is required for an irrigation system that X
utilizes water from a well or body of water as its source. A copy of the permit
shall be submitted at the time of permit application, F.S. 373.216.
26. If capital facility fees (water and sewer) are paid in advance to the City of X
Boynton Beach Utilities Department, the following information shall be
provided at the time of building permit application:
a. The full name of the project as it appears on the Development Order and
the Commission-approved site plan.
b. The total amount paid and itemized into how much is for water and how
much is for sewer.
(CBBCO, Chapter 26, Article II, Sections 26-34)
27. At time of permit review, submit a signed and sealed survey as required by X
CBB LDR, Chapter 2, Section 9.
28. Pursuant to approval by the City Commission and all other outside agencies, X
the plans for this project must be submitted to the Building Division for
review at the time of permit application submittal. The plans must incOlporate
all the conditions of approval as listed in the development order and approved
bv the City Commission.
29. The full address of the project shall be submitted with the construction X
documents at the time of permit application submittal. The name of the
project as it appears on the Development Order must be noted on the building
permit application at the time of application submittal.

13 total Existing Tree species; Live Oak (5), Palm (6), Almond tree (1),
and Rubber tree (1).
30. The landscape plan does not indicate the trees that will be preserved, X
relocated, or removed / mitigate on-site. Therefore, at the time of permitting,
the landscape plan (sheet Ll of 2) shall indicate those trees that would be
preserved, relocated, and removed / mitigated on the site. Also, the landscape
plan tabular data should indicate the total caliper inches of existing trees
proposed to be removed and show all caliper inches of replacement trees on
the landscape plan. A separate symbol should be used on the landscape plan
to identify the mitigation trees. Staff recommends preserving any Live Oak or
Palm trees that are in good health. This determination will be made at the
time of permitting.
31. The landscape plans should include a details sheet indicating by a line where X
the height, caliper @ DBH, clear trunk, and gray wood area of the shade and
palm trees will be measured at time of planting and inspection.
32. At the time of permitting, all shrubs specifications should indicate the height X
and spread dimensions.
33. At the time of permitting, the applicant should show on Sheet L-l an X
elevation cross-section detail of the actual heights of the proposed landscape
trees and vegetation at the time of planting that will (proper scale) visually
buffer the proposed buildings from the Federal Highwav right-of-wav.
34. At the time of permitting, the proposed trees should be installed at a X
minimum height that will provide for tree canopies at the 25'-35' height level
along Federal Highway. These trees should be installed in an effort to break
up the expanse of the buildings. This design should visually obscure portions
of the second story level of the buildings. The applicant should evaluate the
trees design along the North, South, and West elevations shown on landscape
sheet.
PLANNING AND ZONING

35. On the site plan tabular data (sheet S-I), correctly indicate the proposed X
building setbacks. Also, indicate that the Land Use is "Local Retail

I have submit a site plane to City Of Boynton Beach, twice and has been
approved by city planning and zoning, My site plan has meet and exceed all city
requirements and guide line.
Unfortunately, the CRA board denied my site plan twice, Because of 4 different
issue, I have made the changes they required except one which is to provide 5
feet wide as a landscaping on the south border of the property.
The property zoned as C. 3, Which is allow me to put a building on the property
line ( Please see the attached set back's requirements )
I'm not asking for varying and to change any law in City of Boynton Planning and
Zoning, But I am asking you to honor your law and requirements.
In C.3 zoning you allow ( 0 -15 feet) on the side of the property, Who, Where
and when? this law apply, and If can be used, Why not in this property?
I have been already denied with the C.R.A. board twice, Which put me behind
the construction 3 months, Plus the additional expenses to update all my drawing
and plans. Beside the increasing of the construction coast 30-40% last 6 month.
Currently, the property is vacant and has a little building, which has been broken
in three times by the Homeless and drug users causing the community lots of
trouble and risk.
I am trying to put a nice beautiful medical office Building in the property, Which
will help the community in all there medical need ( Even with a building right on
the border line) shall be better than another business such as night club or X
rated Video store.
I hope this issue shall be solved tonight with your fair Judgment and caring to
City of Boynton Beach.

5. Repair and service of merchandise: The repair and service of merchandise for household

6. Exterior display and storage of merchandise. Exterior display of retail merchandise shall
be permitted, provided that such merchandise is owned by the operator of the business occupying the
building, and is the same type of merchandise that is typically sold within the building. Exterior
storage of merchandise shall be for a length of time which, on a daily basis, shall not exceed eighteen
(18) hours. Exterior storage or display of motor vehicles and boats, eJCcluding wrecked motor
vehicles, shall also be permitted to the extent that same is integral to the operation of a confonning
use or a legal nonconforming ':Ise. and without limitation on length of time. Exterior display of
merchandise sban be completely contained within property lines, and shall not completely block
walkways or otherwise create a hazard to the public. Parking areas shan not be used for such
displays except for a period or periods of time which shall not exceed seven (7) days within anyone
(1) calendar year. . Permission from the development director ot his authorized representative shall be
required for any use,j)f parking areas for display of merchandise. The exterior display or storage of
growing plants shan be permitted in connection with a lawful priucipal use, without limitation on
length of time
7. Sidewalk sales. Sidewalk sales in rights-of-way shall require approval by the city
manager or such person as may be designated by the city manager.
