AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING CHAPTER 2.5 ALARM SYSTEMS,
SECTION 2.5-12. EXCESSIVE FALSE ALARMS
DECLARED A PUBLIC NUISANCE TO PROVIDE
FOR SPECIFIC EXCEPTIONS; PROVIDING THAT
EACH AND EVERY OTHER PROVISION OF
CHAPTER 2.5 ALARM SYSTEMS. SHALL REMAIN
IN FULL FORCE AND EFFECT AS PREVIOUSLY
ENACTED; PROVIDING A CONFLICTS CLAUSE;
PROVIDING A SEVERABILITY CLAUSE;
PROVIDING AUTHORITY TO CODIFY; PROVIDING
AN EFFECTIVE DATE; AND FOR OTHER
PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1.
That Chapter 2.5 Alarm Systems. Section
2.5-12. Excessive false alarms declared a public nuisance.
is hereby amended by adding the words and figures in
underlined type, and by deleting the words and figures in
struck-through type, as follows:
Sec. 2.5-12. Excessive false alarms
declared a public nuisance= 1
exceDtions.
(a) The emission of more than three (3)
false alarms within any twelve-month
period of time is excessive and
constitutes a serious nuisance, and is
hereby declared to be unlawful and a
violation of this section. No person
shall allow, permit, cause or fail to
prevent the emission, for any reason, by
any alarm used by such person, or any
alarm serving a premises or a building
occupied and controlled by such person,
of more than three (3) false alarms
within any twelve-month period of time.
(b) Health care facilities where
patients are housed overnight shall be
specifically exempt from the application
of this Section.
(c) Ail new fire alarm systems shall be
exempt from the application of this
section for the first six months from
the date of initial installation.
Section 2. Each and every other provision of
Chapter 2.5 Alarm Systems. of the Code of Ordinances of the
City of Boynton Beach, Florida, shall remain in full force
and effect as previously enacted.
Section 3. That all ordinances or parts of
ordinances in conflict herewith be and the same are hereby
repealed.
Section 4.
Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or
word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
this ordinance.

immediately upon passage.
