Minutes 06-02-87MINUTES OF THE REGULAR CITY COMMISSION MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, TUESDAY, JUNE 2, 1987 AT 7:30 P. M. PRESENT Ralph Marchese, Vice Mayor Ezell Hester, Commissioner Leonard Mann, Commissioner Dee Zibelli, Commissioner ABSENT Nick Cassandra, Mayor (Excused) Peter L. Cheney, City Manager Betty S. Boroni, City Clerk Raymond S. Rea, City Attorney Vice Mayor Marchese called the meeting to order at 7:30 P. M. The invocation was given by Reverend Ben Tidwell, Westside Baptist Church, followed by the Pledge of Allegiance to the Flag led by City Attorney Rea. AGENDA APPROVAL ~ommissioner Zibelli added "4. Community Redevelopment Agency," under Announcements. Under "B. Bids", "CONSENT A~ENDA", she removed item 6 for discussion, and City Manager Cheney deleted item 4 and placed it on the regular agenda as "C" under "BIDS". City Attorney Rea added "5. Codes Enforcement Board Foreclosure Settlement" under "LEGAL, D, Other." lommissioner Hester moved to approve the agenda with the 'orrections, seconded by Commissioner Mann. Motion carried --0o ANNOUNCEMENTS The City of Boynton Beach will hold an Auction Sale at the Civic Center on Friday, June 5, 1987, at 2:30 P. M. Vice Mayor Marchese read the announcement. 2. (See page 3.) 3. Proclamation - Flag Day - June 14, 1987 Vice Mayor M~rchese read the Proclamation. Community Redevelopment Agency (CRA) - requested by Commissioner Zibelli ~ommissioner Zibelli read a statement into the record, which is attached to these minutes as "Addendum A". MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 CITY MANAGER'S REPORT Summer Job Program Sometime ago, the City had discussed with the Community Relations Board (CRB) the summer job program. With the CRB's assistance, City Manager Cheney said the City put together a package and mailed it out to a lot of agencies and schools. On the 28th of May, the City called the agencies and schools. As of that time, the City has not had any responses. Since that time, two or three people picked up applications. The cut off date was extended to June 5th, but City Manager Cheney guessed they would extend it for another two or three weeks, or as long as there is some summer left, because they can hire some kids for any amount of time. Most of the agencies they talked to said they were working through the private job corps programs and referring people there. Commissioner Zibelli asked if the kids are provided with transportation or if they must provide their own. In the County program, City Manager Cheney said they get their own transportation. Individual employers might provide trans- portation if they have a group of kids in one area. The City was hoping their kids would come from Boynton Beach. If there was a bunch of kids in one place, the City would try to provide transportation. The City vans are tied up with recreation programs in the summer and the food program at noon time. However, if two or three kids were in one p~ace and wanted to work, City Manager Cheney said the City would send someone to get them. Coast Guard The last time the Commission talked about the Coast Guard, City Manager Cheney said they were talking about the desira- bility of building an addition to the existing facility at Boat Ramp Park. He reported that the City cannot do that because they would have to build it about three feet higher tQ get out of the flood zone. City Manager Cheney alluded tO the restrooms being on a high mound. City Manager Cheney said the City was recommending that the southeast corner of the building be blocked off and a window and door put in the east wall. He elaborated and then informed Commissioner Zibelli that the room will probably be 10'x12', and that is the area the Coast Guard first suggested might be workable. - 2 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 Over the next year or so, the City will see whether they want to add another building in that area. At least, this will give the Coast Guard something. Commissioner Zibelli asked whether the Coast Guard was happy with it. City Manager Cheney replied that the City has not talked to them about it, but they will talk to them. He thought it was consistent with what the Coast Guard had suggested at one time. City Manager Cheney continued by saying the City just concluded today about the flood zone problem, and there is no way around it. The City tried to get a variance when the restroom building was built, and they could not get it. Estimate of Taxable Value for the Tax Roils for the Coming Year ity Manager Cheney said this is the first year this has appened, and it was $76,000,000 above last year. He thought t was a very early estimate, low, and probably a safe stimate, on the low side. In comparison, the increase in ax base for the last taxable year was about $200,000,000. t seemed to City Manager Cheney that it was a low figure or the certificates of occupancy given in the calendar year f 1986. ity Manager Cheney stated that the City usually gets the igure on July 1, and that is when they will get the final igure, so he is not paying much attention to this estimate. City Manager Chene¥ - Out of City ity Manager Cheney announced that he will be out of the ity from June 14th to July 3rd, but George Hunt, Assistant ity Manager, will be here during that time. City Manager heney will miss one Council meeting, but Mayor Cassandra ill be back by that time. M. ity Manager Cheney made this announcement, and he informed ommissioner Zibelli that one firm will come at 7:30 P. M. and the other will come at 8:30 P. M. - 3 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 PUBLIC AUDIENCE V~ce Mayor Marchese informed the audience that if any item did not appear on the agenda and they wished to speak, they should fill out one of the slips at the back of the room, and he would ask each individual to speak in the order in which he receives the slips. If an item is on the agenda and anyone wishes to speak, they should also fill out a slip. When that item comes up, Vice Mayor Marchese said they would be asked to speak. Ten Smith & Wesson Model 60 Revolvers - Police Department Commissioner Zibelli had wished this removed from the Consent Agenda for discussion. She asked if this was the replacement of 60 revolvers. City Manager Cheney explained it was Model 960. Commissioner Zibelli realized there were only ten revolvers, reread the item, and was satisfied that this item should remain on the Consent Agenda. The Tabulation Committee recommended awarding the bid to S.E.R. Dist. Inc., Miami, Florida, in the amount of $1,944. C. Resolutions 1. Motion carried --0. PUBLIC AUDIENCE Joint Meetinq of City Commission and CRA Held May 21, 1987 ee Wische, 1302 S. W. 18th Street, a resident of Boynton each for 14 years, felt everyone may have read yesterday's ditorial of the Palm Beach Post regarding the scenario that took place between Commissioner Mann and CRA Chairman Hank Thompson during the joint meeting on May 21st. Mr. Wische r~~erS present at the meeting. . Wische wished to express his views so they would be on cord and in the minutes. Re said Commissioner Mann quested information from the CRA Chairman as to how monies given to the CRA by the City have been spent and what the - 7 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 CRA had to show for it. Mr. Wische said it was a simple question that called for an answer. Instead of an answer, Chairman Thompson took exception to the inquiry, making a personal issue of it, and cleverly gave no response. Instead, some days later, Chairman Thompson stated to the Palm Beach Post Reporter, Bill Cooper, that Commissioner Mann's remarks were "blatant slurs, uncalled for, and undeserved." Mr. Wische continued that Chairman Thompson concluded this, knowing full well that part of a Commissioner's responsibili- ties is to protect the taxpayers money, as well as looking Qut for the good and welfare of the community. Despite Chairman Thompson's pending resignation, Mr. Wische felt Commissioner Mann's question was in order. Since .Commissioner Zibelli was kind enough to furnish documents supporting how monies were spent, Mr. Wische said he would not pursue the question. What puzzled him was why ~ommiSsioner Zibelli was doing Hank Thompson's work or that f the CRA. Mr. Wische asked if the CRA should not come forth. ~n conclusion, Mr. Wische suggested that the Commission do away with the CRA, consider the advice of the Post editorial, set itself up as the Agency, and then be in the position to administer the expenditure of tax dollars generated by down- town construction. Commissioner Zibelli responded that she did not do Hank Thompson's work. She has been following the CRA for 4½ years ~nd, as a Commissioner, has been keeping on top of what has peen going on in the CRA and how the monies have been spent. Commissioner Zibelli felt every Commissioner should do that job. Mr. Wische stated he may agree with Commissioner Zibelli on that, but the CRA was asked a question, and they should have come up with the answer. Commissioner Zibelli felt it would be difficult for them to have the answer in hand at that particular time. If someone had asked her a question, she would have asked them to come o her office the next morning, and she would give them a copy of what the expenditures had been since 1982. Commis- sioner Zibelli had a copy in her hand. Mr. Wische said the RA had from May 21st until now to do the researching and present it, if they so wished. Qommissioner Hester felt something was about to happen about the CRA. He also felt Commissioner Mann's question should - 8 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 have been answered but, at the same time, he did not think it could be answered at the moment. All of the CRA's material is public record, and Commissioner Hester did not think it was hidden from anybody. Anybody wanting to find out what is going on could go to the CRA office. Commissioner Hester thought maybe that was what they should do. ommissioner Hester thought it was going to take time for hat type of Agency to accomplish things. They cannot accomplish what they want to accomplish overnight. Commissioner Hester did not know whether the expenditures were right or not. He heard $500,000, but he read-where it was two hundred and some thousand dollars. The CRA has been orking five years now, and it will take longer than that or what the City wants. People have to be patient, and ommissioner Hester expressed that he does not want to be a part of the Agency while he is a City Commissioner. ommissioner Hester felt the CRA should be given the benefit f the doubt. He was not talking about just Chairman Thompson but the whole Agency. As far as Commissioner Hester was concerned, he thought they had done a good job. As it is public record, he advised Mr. Wische to go to the CRA office to see how the money is being spent. amuel Scheiner, Vice Chairman of the CRA, said that for ver five years, the CRA has had two meetings a month, and e has never seen Mr. Wische at a meeting. He did not see how Mr. Wische could criticize the work of the CRA. When CRA Members took the job, Vice Chairman Scheiner said it ~he year to get a plan approved by the City ook them over a ~ommission at that time. It took another year to get the Ordinances in place. If he knew how it worked, Mr. Wische ould not be critizing a group of men who have been working or five years. There were protests from Mr. Wische and the audience. ~ice Chairman Scheiner continued that he had not seen any ~ommissioners at the CRA meetings until recently. The ~ecords and minutes are there. The Commissioners get copies Of the minutes and know what is going on. Vice Chairman ~cheiner did not know why it even had to come up. The ~ommissioners get copies of the minutes of every City Board, ~nd the other Boards are never questioned about what they ~ave accomPlished. - 9 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 Discrimination Wilda Searcy, 402 N. E. 13th Avenue, appreciated what Commissioner Zibelli said, but she was here because her sister was looking for a house she could buy west of 1-95. A Caucasian real estate office related to her sister that they could not sell her a house west of 1-95. Canal C-16 Mrs. Searcy said Canal C-16 is across the street from her house. Pioneer Park has everything (fishing, etc.). In her neighborhood, when people go fishing from the railroad, they get arrested. Mrs. Searcy talked to Charles Frederick, Director of Recreation and Park, about C-16, Pioneer Park, and the development of the railroad. She had three letters dated March and April of 1985 from the County Commission, Community Development, and the City of Boynton Beach about a proposal which was to go through the Planning Department. Thi~ is 1987, and nothing has been done. geglect of Properties rs. Searcy was looking at the neglect in her area from Seacrest to Federal Highway 1, Canal C-16 to 8th Avenue. A City lot on 9th Avenue needs to be cleaned up. Mrs. Searcy asked where the monies were for her neighborhood. In October of 1986, a fire burned a house down in her neighborhood, and the abandoned house is still standing. ~here are no sidewalks, and the City has not spent one nickle in her neighborhood. Three houses on her street have unsanitary conditions, and nothing has been done. Mrs. Searcy expounded and stated that they are being treated as if they are animals. She made other statements. Responses to Mrs. Searc¥'s Concerns: 1. Discrimination CQmmissioner Hester asked for the name of the real estate office. After some comments, Mrs. Searcy informed him it was Century 21. Commissioner Hester did not see that p~oblem in Boynton Beach because all types of people are in the neighborhoods. Mrs. Searcy alluded to west of 1-95. Commissioner Hester responded that blacks are in Mahogany Bay, and Burg & DiVosta's subdivision (Sandalwood). He thought Golfview Harbour was the first one that integrated, and blacks moved in a long time ago. Commissioner Hester stated that blacks do not have any problems in Boynton Beach at all. He thought the agent that said something like that - 10 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 to Mrs. Searcy was subject to having his license revoked. There were further comments. 2. Pier and Recreation ity Manager Cheney said the pier Mrs. Searcy built was uilt on land that the City does not own and Mrs. Searcy oes not own. The land is owned by the South Florida Water anagement District (SFWMD). City Manager Cheney assumed it as in 1985 when the City had conversations with the SFWMD. hey periodically have recreation funds where they do things, ut recreation is not a high priority in SFWMD's program. he City cannot do things on SFWMD's land. 3. Money Not Spent By City ity Manager Cheney asked the Commissioners to recall that hen they went through Mrs. Searcy's neighborhood on their aturday morning trip, they saw vacant lot after vacant lot, hich are vacant because over the last several years, the ity has taken steps to tear down dilapidated homes. The rea of 10th, llth, 12th and 13th (10th, llth, and 12th articularly) had many homes on them. A lot of improvements ave been done. 4. Sidewalks ity Manager Cheney said they have gone over this time and ime again. He emphasized that there is no place to put idewalks. 5. Unsanitary Houses ity Manager Cheney said there may be three unsanitary houses, ut Mrs. Searcy had not told him what the addresses are. He as sure Mrs. Searcy knew whether or not the houses were nder Codes Enforcement review because she talks to the nspectors on a regular basis. If they are not, the City eeds the addresses so they can go after them. The City oes have continuing problems sometimes of letting people ive in an unsanitary home because there is no place else to ove them. Three Minute Presentations Vice Mayor M~rchese emphasized that, in all fairness, he wQuld like to limit what people had to say to three minutes, s~ the meetings would not drag out past Midnight. After - 11 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 three minutes, he said he would ask the City Manager to get the information, and the person could get with the City Manager later. Community Redevelopment Agency Robert Walshak, 3566 Lake Drive South, said that before the eeting, Commissioner Zibelli gave him a copy of what he resumed was a financial statement of the CRA. Mr. Walshak kas been following the situation in the newspapers, and he totally agreed with the article in the Palm Beach Post which said the City better take the Agency over. If that was a Copy of a financial statement for an expenditure of $288,748.89, he said the City better take the Agency over very quickly. According to the statement, there were six or seven expenditures, which told Mr. Walshak absolutely nothing. None of the items were broken down, and he said it was no~ a financial statement by any stretch of anybody's i~agination. r. Walshak stated it was a poor example of bookkeeping for n Agency that spends over a quarter of a million dollars. ommissioner Zibelli interjected that the statement had been uickly put together. As far as Mr. Walshak was aware, ommissioner Mann asked for a simple explanation as to where he Agency spent the money. If that was the answer to ommissioner Mann's question, Mr. Walshak reiterated that the ity better get ahold of that Agency very quickly. Police Elizabeth Jenkins, 711 N. W. 1st Street, thanked the Police Department for the work they have done on 10th Avenue, and she explained. N. W. 1st Street and Signs Ms. Jenkins said 1st Street is a speed trap. Cars go in there and try to make a circle. It is very dangerous. The City did put signs there, but Ms. Jenkins thought maybe it w~uld help the area if stop signs were put at 6th Avenue, and she explained. Ms. Jenkins felt perhaps there could be a yield right-of-way sign on N. W. 1st Street because some- thing has to be done. Two weeks ago, Ms. Jenkins said a bus and car had a bad accident there. Some people had to go to the hospital, and kids were on the bus. - 12 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 N. W. 7th Avenue Ms. Jenkins continued by saying 7th Avenue is another ~angerous situation. They come around the corner and do not know whether to go right or left. Children are playing in the street, and they run from one side to the other. Ms. Jenkins wondered if something could be done. N. W. 1st Street and N. W. 6th Avenue if you go out of 1st Street onto 6th Avenue south, and make a left or right turn, Ms. Jenkins said the street is so blind, you cannot see a car until you pull out onto the street. She also thought that should be looked into. 717 N. W. 1st Street Ms. Jenkins reported that people are living here. There are no lights, and a lot of traffic is there. The house needs to be checked out. City Property ahrS. Jenkins wished the Commission would consider doing some- ing to make the City property look nice. She knew she was obably in the slum area, but they should do something to ke it look better. The property is in a circle, but she did not know what it was called. Three Minute Presentations ice Mayor Marchese asked that people put it in writing, if ey had something to say that would take more than three inutes. As no one else wished to speak, THE PUBLIC AUDIENCE WAS CLOSED. BIDS A. City Hall Furniture City Manager Cheney knew there were people in the audience who would want to speak. Sometime ago, the Commissioners ere given a recommendation for furniture designed to be sed in Pineland Plaza and also in the new facility when the ity moves back. The City made an analysis on the furniture at that time and proposed to select the furniture off of a pricing list. - 13 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 City Manager Cheney said a representative from a company the City did not recommend raised some questions about the City's procedure, the furniture the City is recommending, and some questions about whether they were properly treated. The City staff met with them, came back to the Commission, and said they would continue to meet, and the City staff met fOr several times to try and resolve it. The City kept getting a lot of conflicting information and advice about furniture. City Manager Cheney said furniture bidding on these large scales is an extremely competitive, possibly cut throat business, and the companies are ~aggressive. The City then decided the best way to do it would be to put the package out to a conventional bid because, up until that time, they were finding that every furniture company, when they deal with large amounts over $75,000, ~has all kinds of discount rates that sometimes include installation, and it is a very flexible pricing business. The City made a list of equipment it wanted to buy, made sure a number of companies could provide the equipment, and put it out to bid. City Manager Cheney said all of the companies knew it was going out to bid. The bid closing date was yesterday, and th~ City spent yesterday analyzing and doing it. en the bids were opened, City Manager Cheney said the City de it very clear what the total bid price was and was assured by one bidder that was their bid price. Another bidder, as soon as everybody had left, said they made a ~istake and left out $21,000, in spite of the fact that in emeeting, they said that the One bid looked was price. very low, so the City called up the bidder. The bidder said t~e bid was right, but they forgot to extend the bid and did n~t multiply properly. That company called again today to give the City a new price, which ended up getting them from third to second place. City Manager Cheney remarked that may be the way some people do bidding, but he did not like it. City Manager Cheney said the company the City was recommend- ing happened to be the first company they recommended. He s~id that is the kind of process the City had gone through, even up to 4:50 P. M. this afternoon, when they got a lower price from the same company. He read his memo, dated June 2, Which was addressed to the Mayor and Commission and is · · attached to these minutes as "Addendum B". - 14 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 City Manager Cheney gave the Commissioners a comparison chart and showed the one the City staff recommended. He said Steelcase has a lifetime guarantee, and Corporate Designs is from West Palm Beach. City Manager Cheney informed Commissioner Zibelli that the furniture was designed for the new City Hall. Then the spacing and design were worked to fit it in at Pineland Plaza. In some cases, it may look odd at Pineland Plaza, but it will do the job. Richard Weimer, who resides at 1940 Sharon Street, Boca aton, said he is the GSA Specialist with Herman Miller. In he amount of time given to present a bid offering, Mr. Weimer said Herman Miller submitted everything to the City on time for the meeting yesterday and for the bid opening. 5e stated that it was ~n error only in the reading of the material. Everything for their bid was submitted and was there for examination. r. Weimer said they went up afterwards only to question y the apportionment of the bid that they included was not read and included in the total price, since their price at the bid opening was read to be $98,000. He pointed this out because they wondered why it was not included. Mr. Weimer wanted it to be a part of the record that they came forward tO point this out. Secondly, Mr. Weimer said the portion of the Phoenix is all new material. It is not recovered or reworked material, but is manufactured for the City of Boynton Beach. Mr. Weimer said at no place in the specifications, 1 through 10, was a~y indication of steel mentioned. As far as size, design, looks, and color, Herman Miller felt it could meet that. When they consider that, Mr. Weimer said they were looking at approximately $119,000, which, if he understood what was just said, is approximately $10,000 less than the offer of ~orporate Designs (Steelcase). Mr. Weimer wanted that to be considered. hen their bid was submitted, City Manager Cheney questioned hether they submitted color swatches to go with it. Mr. eimer replied that they did. City Manager Cheney asked if 11 of the color swatches and material Herman Miller was oing to provide the City were submitted, or if Mr. Weimer ad to bring back a separate set of color swatches. At the conclusion of the meeting yesterday, Mr. Weimer said he had the packet, and he asked the City's purchasing people if they would like it at that time. They said, "No." If they wanted it, they said they would request it later. Mr. Weimer brought it today. - 15 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 City Manager Cheney said that particular one was not included in the bid they submitted. Mr. Weimer stressed that it was there. All of the colors were there. City Manager Cheney stated that they were not in the bid package. Mr. Weimer advised that they were with him, and he was there. He said the packet is very large. William Sullivan, Purchasing Director, came forward and informed the Commission that the Phoenix line is a recon- ditioned line of furniture, and it is a subsidiary line owned by Herman Miller. As far as he knew, everything through their line is reconditioned. City Manager Cheney recalled that was what they told the City at a Herman Miller display in the Planning Department six months ago. r. Weimer wanted to come forward because he put this bid ogether, and this question was never asked before now. He assured the Commission that the products 1 through 10 are ~ot anything of a reconditioned or refurbished nature. It is a completely new, manufactured product, to the City's specifications. They do have that ability in their Phoenix line, and it is part of the Herman Miller company. Vice Mayor Marchese thought one vendor's products were particularly well built and designed, and he believed he was looking at Steelcase. City Manager Cheney asked if it was the second one in the room, on t~e left, when he went in. Vice Mayor Marchese replied that it was. City Manager Cheney said that was Steelcase. Jim Gonda, who resides at 1831 N. W. 97th Terrace, Coral Springs, Florida, and is District Manager for Steelcase, Incorporated in Florida, thanked the Tabulation Committee for being thorough in taking a look at the office furnish- ings for the new City Hall and Pineland Plaza. He told of the history of his company and said they got where they are because of their credibility and the products they make. Mr. Gonda said Mr. Weimer sat in the room with him and other r~presentatives from other manufacturers when the bids were opened. Every bid was read by Bill Sullivan. The amount was read, what department it was for, and everything about it. Mr. Gonda said different ~ssues were brought up. Some m~nufacturers mentioned that they forgot something, and he e~plained. When the bid was read for Herman Miller, Mr. Gonda recalled that it specifically stated the total dollar amount of that - 16 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 bid. He recollected that Mr. Weimer stood up and said that was for all three of the areas. Mr. Gonda said Mr. Weimer knew the amount, and so did the other gentleman with him, and they neglected to mention it before anybody that was there. Mr. Gonda felt that was in total violation of the bid process that was being handled. Everyone tried to be above- board and protect their own credibility. It was a cut throat business, and Mr. Gonda stated that they did not want to have that kind of reputation in this industry. He explained and said he wanted the Commission to understand exactly what happened. Commissioner Zibelli asked if this had the cloth or steel casing on top. City Manager Cheney replied that it had steel, but many of them are interchangable. Some of them are limited. Commissioner Hester understood that at the bid opening, everybody heard the bids, and then a company came back and lowered its bid. City Manager Cheney replied that all of the companies heard the bids. After it was over, it looked like one of Westinghouse's prices was wrong. They were called up, and they said they did not extend it properly. They asked that the City add approximately $21,000, so the City did. Westinghouse called this afternoon and wanted to lower their bid a little bit. The City did that, and it put them in second place. City Manager Cheney emphasized that the price given at the bid opening ~s the price, and they have to live by it. Admittedly, mistakes are made, and sometimes they are very clear, but if the City lets the prices change after the bid openings, they will have problems. ~Cathy Barbour, who resides at 2000 N. W. 59th Court, Fort Lauderdale, was here because she never saw a bid come out to various manufacturers that was based on a particular manufacturer's specifications like that manufacturer already had equipment or products in the City. Haworth completed that bid, and they did not give the most cost effective bid they could have because they were trying to meet another manufacturer's specifications. When you put a manufacturer in that kind of situation, Ms. Barbour said they have to make a judgment as to whether to go to cost effectiveness or meet specifications. - 17 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 Ms. Barbour said Haworth felt the City may have done a great injustice to themselves in getting the best dollar and using the taxpayers money because they did not give the most cost effective solution. The second thing Ms. Barbour wanted to say was that they had four working days to complete the bid, and she told of how they had to work on a weekend to prepare it. She never saw a manufacturer being asked to provide a a bid in this dollar amount in four working days. Ms. Barbour could certainly understand why mistakes were made. Ms. Barbour told the Commissioners to ask themselves if all of the vendors received a fair opportunity to bid their most cost effective solution, while meeting the City's needs, and she told how she believed that could be done. In response to Ms. ~Barbour, City Manager Cheney said if ~veryone came in and told the City they were cost effective, %hey would spend hours arguing as to whether one manufacturer's particular product is more cost effective than the other manufacturer's particular product. Each product has some aspect that is a little different. City Manager Cheney expounded and then informed Ms. Barbour that although she never had heard of this type of bidding being done before, it is done all of the time. ~s. Barbour appreciated City Manager Cheney saying there has to be some basis for a bid, and she thought that was a~ approved, business statement. She explained, then said when they get a bid that says the City wants FP1 Steelcase, etc., that is not a specification. Ms. Barbour asked if ity Manager Cheney called that a specification. If speci- ications were issued, she believed the specific Steelcase roduct was designated in that bid. From the time it was aken until layout, particular features that were important the City, dimensions and things like that could have been pecified. Ms. Barbour found it hard to accept that it ould not be done, and she elaborated. S. Barbour asked how the Commissioners could feel they were ~tting the most cost effective answers to specify a product number from a manufacturer. She stated that was the issue. Mr. Weimer wished to have a rebuttal. Vice Mayor Marchese s~id the Commission could go on with this all night; Mr. Weimer had his say, and that was sufficient. - 18 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 Commissioner Mann moved to award the bid to Corporate Designs (Steelcase), West Palm Beach, Florida, in the amount of $129,798. Commissioner Hester seconded the motion, and the motion carried 4-0. B. Selection of Moving Company for Relocation of City Hall City Manager Cheney said practically every piece of furniture was listed, and the City indicated to all of the moving ~ompanies where the pieces of property are now and where ~hey will go in the new building. It has been indicated that the City wants the moving to be done on the weekend, so the City will be in business on Monday morning. City Manager Cheney commended Sharon Randolph of his office for doing all of this. As reflected in City Manager Cheney's memo of June 2, 1987, Bekins Moving and Storage Company, 1041 South Rogers Circle, Boca Raton, was recommended, and he asked the Commission to authorize awarding of the bid to them in the amount of $5,875, if the City buys the cartons from them. The City ~ay buy cartons cheaper somewhere else, but Bekins would still end up being the most competitive. City Manager Cheney elaborated. The second company was also a Bekins company and the one the Mayor talked about There Was dlscusslon. C~mmissioner Hester moved to approve the selection of Bekins M~vlng and Storage Company, seconded by Commissioner Mann. Motion carried 4-0. C. Uninterrupted Power Supply (UPS) - Data Processing (This item was moved from the Consent Agenda.) City Manager Cheney explained that this is plugged in between Florida Power and Light and the computers. When FP&L flickers, it will not affect the computers, and the system will stay on. The City has never had it. City Manager Cheney expounded and then said the City would like to put the UPS system in when they move into the new building. City Manager Cheney said the City had originally estimated $10,000 in this budget year. At a cost of a couple hundred dollars, the City hired an Electrical Consultant, who has t~ne a lot of work on UPS systems, to look at it and be sure e specifications were correct for the City's computer. The city put it out to bid and had 15 bidders. The bid is for $11,336. - 19 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 The City will be about $3,766 over the $10,000 that is in the budget, but City Manager Cheney recommended that the Commission authorize the purchase, installation, and the two year maintenance contract. The City had hoped to buy other hardware in the data processing account, but they will not be buying it, so there is enough money in data processing in the capital account for the equipment. City Manager Cheney explained why he thought it was a good price. If it is authorized tonight, City Manager Cheney said the C~ty will get it a week before the City moves the computer from that area into the new building. ~ommissioner Zibelli moved, seconded by Commissioner Hester, t° approve the bid of R. B. Grove, Inc., 261 S. W. 6th Street, Miami, Florida 33130. Motion carried 4-0. THE COMMISSION TOOK A BREAK AT 8:55 P. M. RESUMED AT 9:05 P. M. THE MEETING PUBLIC HEARING None. DEVELOPMENT PLANS A. Request for approval to construct dry models - Costain Development City Manager Cheney said the City has some real concerns about approving dry models. He explained that the dry model is the building that would be put up without utilities, pending the construction of utilities. City Manager Cheney suspected it would be put up for the purpose of making sales ahead of time out of the models instead of from a sales trailer. Bob Burnett, Vice President of Planning and Development for Coscan, explained that Costain is no longer the major share- holder of the company, and that as of June 1, 1987, "Coscan" became the new name of the company. Mr. Burnett elaborated. Mr. Burnett said they purchased the property in January of 1987, have submitted their plans, worked with their Engineer, p~ogressed through site plan approval, are moving alon ~ g very ell, and are looking forward to a preliminary Dlat the middle of this month and an approval by the Commission the 1st meeting in July. - 20 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 Mr. Burnett said some of the things they have been discussing with staff would affect very positively the development of their project. He said they met with the Legal Department the beginning of May and started discussing two types of agreements that would help them in the process of their development. The first one is welcomed by Palm Beach County as an at risk development agreement, which would allow an early start of underground utilities. The second thing they asked for was a dry model agreement to start early construc- tion of model buildings, both of which would start only after they receive the preliminary plat. Mr. Burnett said the individuals reviewing the documents recommended that the Commission not grant their proposals. Bud Howell, Building Official, in his outline, suggested that this had been done ~efore, and he suggested only that it had not been done in the degree they were asking. That did not really say it should not be granted. Mr. Burnett said Mr. Annunziato addressed the very relatively short period of time they would have between the preliminary plat and final plat approval and suggested that he did not see that they were at any particular disadvantage. They asked for an appearance before the Commission, which was why they were here tonight. Mr. Burnett presented the Commissioners with charts, and he ekplained an overview of the property. He said they were ging for a plat approval for 96 condominium type homes. very home will have a garage. There is a plat for a condo- minium upstairs that has a downstairs garage. In getting the agreement to build Phase I, Mr. Burnett said they have committed an entire sewer and water underground utility system from Silver Lake back to a road they will build through the project, called 26th Avenue, to a point of W0olbright Road, that is not yet in place, to a point where Woolbright Road now ends. They are also committed to build the underground utility system and Woolbright extension to Quail Ridge property. Mr. Burnett said they are to make the road improvements and widening of the lanes in Golf Road and pave the area to the limits of their first phase, including a major lift station. Mr. Burnett said those improvements total approximately $900,000. They are committed to do them and will bond the improvements, which will be completed by the end of the 21 month period. - 21 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 Mr. Burnett explained the charts and said they expect the Commission to approve their plat about the first week in July. At that point, they will already be at a point where, under the County at risk agreement process, they could start a~ underground utility system in place. When they got their site plan approval, Mr. Burnett recalled that the Mayor said the City definitely needs the infrastructure development that they are going to build. If they had the opportunity to start an at risk agreement with the City, Mr. Burnett said they could start in the mid-point of June. Mr. Burnett said it will take 140 days for them to build their dry model or complete eight units of a model building. It will take six months to build the entire utility system, a~d he showed where it would go. Mr. Burnett explained and said if it takes that long, they would like a dry model agreement with the City, which would allow them to begin the dry model early and occupy it early, on the basis that the City would give them a sales occupancy permit. That would give them a 90 day advantage. Mr. Burnett repeated prior statements. ~r. Burnett drew attention to the utility work and said it takes an extra amount of time to get that type of develop- ~nt tested and approved. He said the dry model agreement has been granted in previous cases by the City to other d~velopers in single family and apartment building types of construction, and he asked the Commission to consider grant- ing this type of agreement that would give them approxi- mately a 90 day advantage to start selling this model building on or by the 1st of January when the sales season bDgins in this area. If they do not have the agreement, they will not be able to get occupancy of the building until sometime in late January or February. Mr. Burnett explained. Mr. Burnett said they would totally bond the facilities and p~t up a bond for the demolition of the buildings if, for a~y reason, the development would not move forward. He r~collected that, at one point, Mr. Annunziato said the time frame in the beginning was so close, there did not seem to be a need for the agreement, but Mr. Burnett said the time ame on the end (the additional 60 days or whatever they uld have to get into the building) could put them in a 90 y disadvantage. M r. Burnett stated they felt it was important, and they Duld not be putting the City at any risk, at the point of stting a preliminary plat approval. - 22 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 Commissioner Zibelli asked what a dry model is. Mr. Burnett replied that it is a building that cannot be connected to the utility system until such time as the entire utility system being built has been tested, approved, and okayed by the Health Department or incorporated into the rest of the City program. He said they are creating an additional loop system, which will increase the City's capabilities, Mr. Burnett further explained and said it was a major commitment they took for the development of the property. It was not as if they were doing a little system to attach 96 homes to. Mr. Burnett said they plan to come back very quickly and start their second phase, which will be a total of 315 homes. If they are not ready to hook up when it is time to bring sales customers to their facility, he agreed with Commissioner Zibelli that they would have to have temporary facilities. City Manager Cheney noticed that construction is to begin about the time their final plat is approved. They are starting construction in July, and their final plat will be apprOved the end of July. If the final plat is approved in July, City Manager Cheney said they were talking about 21 days. As Mr. Annunziato looked at the chart, the difference related to the period between which the final plat would be approved and recorded. It appeared there was a slippage of pproximately 30 days. Mr. Burnett confirmed that was orrect. If they fall back from mid-June, based on an at isk agreement, Mr. Annunziato said you could add another 15 ays. He thought that was the 45 days to commence the nderground installation prior to recording the final plat. e stated that the City has not done that. City Manager Cheney asked if they were asking for the at risk agreement now. Mr. Burnett replied that their request ~as for both (the dry model and the at risk agreement). City Manager Cheney's letter to the Commission just talked about a dry model, but they were assuming both were included. City Manager Cheney pointed out that the dry model situation ~as not a problem for them because, if they start the dry ~odel at the end of final plat recording, which would be the end of July, they will still have 140 days. If they do not have some kind of agreement going in, when ~hey finish the building the 1st of December, and say to the Gity that they would like a certificate of occupancy (C. O.) - 23 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 to occupy the building for sales purposes, Mr. Burnett said the normal answer will be that they cannot have any kind of an occupancy in the building until their underground utili- ties are totally completed and approved. City Manager Cheney did not think the City requires underground utilities tO be totally completed in a subdivision, but said they should be adequate to serve the units asked for in the C. O. process. Mr. Howell advised that it would be up to the Director of Utilities, and it would have to be approved by the Health Department for them to utilize it. He stated City Manager Cheney was correct in saying the whole project would not have to be finished. City Manager Cheney said when other developers in town get their plats recorded, they start building uti%ities and roads. The City sees building after building, they are still c~mpleting their utility syStems, and there is no special c~mmitment. City Manager Cheney was having trouble under- standing the problem. Mr. Burnett said the basis of the discussion they had during the beginning of the month was that the City had some standard ways of working. First would be that they finish their utilities. Mr. Burnett stressed that they are building spch a major system that it is not easy to run through 3/4 of a mile of system without having some interim approval points, and they need the loop before they can get connec- tions. Mr. Burnett wanted the at risk agreement, that they identi- fied in their documents, or some other type of agreement that could assure them that when they complete their dry m~dels, they can get an occupancy permit. City Manager Cheney responded that this was what the City did not like. There were some things Mr. Howell wanted to make the Commission aware of. He stated in his letter, "a cash bond for demolition," and explained that he did that for a pprpose. The City had dry models in Bass Creek, and they had a bond on those. Mr. Howell's first point was that it iS very difficult to call a bond to get demolition. The City had problems with those models when the company went down. Mr. Howell apprised the Commission that the reason he m~ntioned a cash bond was because he thought those funds should be made available to the City so that in the instance that happened, the City would have access to the funds to have something like that demolished and to keep problems down. Mr. Howell explained. - 24 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 Mr. Howell's second point was that he would have to have a recorded plat prior to issuing a permit because of the City's computer. The land files are on a computer, and he said he would need those numbers, according to the plat. City Manager Cheney did not like for the City to say they cannot do something because of a computer. Mr. Howell guessed what he meant to say was they have to get it out of "the system" to keep the records on the inspections. There was discussion about other dry models at Burg & DiVosta and the Meadows. Mr. Burnett said they also have this build- ing under construction at Boca Golf and Tennis, so the ~ommission could see exactly what is being built in the County. They could make any immediate changes the City might require. Vice Mayor Marchese wanted to see the project move, but not at the risk of the City. He asked what could be done to give the people what they are looking for without putting the City in jeopardy. City Manager Cheney asked Mr. Burnett if the applicant was willing to give a cash bond. Mr. Burnett could not commit for his company. Because the County does something, City Manager Cheney said it is not a reason for the City to do it. He asked City Attorney Rea if he had read the at risk agree- ment and whether he thought the City was at much risk on it. With regard to the at risk construction, City Attorney Rea thought the City could protect themselves to a substantial point by entering into an at risk agreement. However, he thought they had problems in that their subdivision platting regulations may require an amendment to permit this type of procedure. City Attorney Rea thought the most preferable way to go would be to amend the City's Ordinances to permit this. The benefits the City will gain from this were now cut an additional month. City Attorney Rea felt an Ordinance amendment would certainly be the most beneficial way to go. ~ity Manager Cheney asked if that was because of the dry  odel or the utilities. City Attorney Rea answered that it as because of the utilities. He continued that it was a olicy decision in many respects, as far as what type of ~isk the City is willing to take. If they have to submit ? subdivisions regulation, City Manager Cheney pointed out that they would have two more ~ommission meetings. He asked if City Attorney Rea was saying the City cannot do an at risk agreement without amending the subdivision regulations. - 25 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 City Attorney Rea thought the preferable way to do it would be by amending the Ordinance to specifically permit that technique, which would set them back a month. Vice Mayor Marchese questioned whether it would take the City off the hook and be following the recommendations of the Building and Planning Departments, if they put up a cash bond, in the event the building has to be demolished. Attorney Rea replied that the cash bond would resolve a lot of problems with regard to calling in a bond if, for some reason, they needed to demolish the building. He explained. From a precedent point of view, if they use that technique as far as the construction of the utilities is concerned, City Attorney Rea said he had not looked at the County Ordinances. He thought if~ the City establishs this tech- nique now, without Ordinance approval, they will find them- selves in a hlighly new discretionary area. The City can still protect itself. It was what the Commission's wishes were. City Manager Cheney asked if it was still the Commission's desire to make the project go ahead, if at all possible. If that was what they would say, he suggested that within a day or two, City Attorney Rea; John Guidry, Director of Utilities; Bud Howell, Building Official; Carmen Annunziato, irector of Planning; and he should sit down with Coscan and ee what they can work out in light of the Commission's statement that as long as the City is protected, Coscan can Fo ahead. City Manager Cheney said they would just report back to the Commission when they work out something. City Attorney Rea clarified that this would not be the qontract. As far as the at risk agreement, they would have to tailor it. City Manager Cheney thought there should be & meeting to see what they can work out. ~ity Attorney Rea suspected that City Manager Cheney was probably recommending that the Commission direct him (Cheney) to meet with the appropriate staff members and the developer, do what is possible administratively, and, if required, come back to the Commission at the next Commission meeting. The Commissioners were in favor of the recommenda- tion. - 26 - MINUTES - REGULAR CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA JUNE 2, 1987 B. Master Plan Modification - Meadows 300 - Tract D Mr. Annunziato thought this was a process the Commission had not been previously exposed to (amendments to a previously approved master plan). He read the second paragraph of his memo of May 22nd and made the Commission aware of the location of the development. Not too long ago, the applicant requested a master plan amendment to take a center island of lots out of the land development category of houses and put them in a recreation category. Mr. Annunziato said that request was found to be onsubstantive by the City Commission and approved by the lanning and Zoning (P&Z) Board. The applicant was now requesting that that decision be reversed and that the land ~se be put back into a form where houses could be sold on the land. Mr. Annunziato said there was a recommendation that the City Commission make a finding of no substantial change. The evaluation was that the impact of seven lots was not substantive in nature. Master Plan Modification - Meadows 300 - Tract E Mr. Annunziato informed the Commission of the location of Tract E, which was a master plan for a cluster of approxi- mately five units per acre. The applicant was requesting hat the density be reduced at a net reduction of 25 units and that he be permitted to construct single family units on zero lot lines. Mr. Annunziato said the applicant was Ed Schwab of Wilshire orporation, West Palm Beach. Wilshire Corporation is the eveloper of the Planned Unit Development (PUD), not the eveloper of the individual tracts. In this instance, Wilshire will be the developer of Tract E. City Manager Cheney clarified that it is a piece of land that, if it had been developed by the original owner before 1973, could have have been developed with two houses on the two lots. He believed it came from an estate and was sold to settle the estate. City Manager Cheney said the City understood~ that were attempts, and it was so testified b~fore the BOA, to buy some additional vacant land, and it could not be done. If it had been in the original family, City Manager Cheney r~iterated that the original owner could have developed it. Motion carried 4-0. 5. Codes Enforcement Board - Foreclosure Settlement City Attorney Rea said this pertained to the City of Boynton ~each vs. Fernandez. At one of the prior Codes Enforcement Board meetings, he said the Board voted to foreclose on a Code~lien against Fernandez for a Code violation that came from a fence that was put up and at some time removed. Attorney Rea said his office received a letter from ~ernandez s Attorney, dated May 29th, offering to settle the matter for approximately 75¢ on the $1.00. ittorney Rea said the City had the option of going through ith its foreclosure action, which could ultimately increase lot of legal fees for everybody. The ultimate effect uld be that if they continue the foreclosure procedures d take it to the entire length of the proceedings, they uld probably increase the cost to Fernandez. ADDENDI1M ~1 'AGENDA · lune 2, I987 TO: FROM: SUBJECT: Mayor aN City Con~nission Peter I:..Cheney, City Manager City Hq11 Furniture On Monday, June. 1, 1987, the City of Boynton'Beach-opened competitive bids for specification for Steelcase 9000 Panel Systems or equal and movable partitions and walls for City Ha11/P1neland Plaza, 211 South Federal Highway; COC Building, 120 East Boynton Beach Boulevard;* and Planning Oepartment, 200 North Seacrest Boulevard. There was a total of six responsive bids. The three apparent low bidders were Designs Service Bureau, Fort Lauderdale, Florida {Westinghouse) - $109,463; Herman Miller, Hollywood, Florida - $119,616; and Corporate Designs,.West Palm Beach, Florida, (Steelcase) - $129,798. After reviewing bids the Tabulation Con~nittee contacted all Of the above three vendors. It was determined that Oesigns Service Bureau made a gross error in their calculations. This error totaled $21,281 in additional charges. This error was made as a result of not extending the unit prices of the fullwall systems at City Hall and the CDC Building. This err°r recomputed the bid to $130,744 and installed Westinghouse from the low bid position to the number three spot. Westinghouse contacted the City again on Tuesday, June 2nd in an attempt to further modify their bid. This time the charges were changed to reflect a new bid of $129,275, or second place. Designs Service Bureau's inability to live with the first bid made and the repeated attempts to modify the bid have disqualified them, in our estimation, due to their apparent inability to accurately develop a single, correct quotable bid which can be compared in a timely manner with their competitors. As a result, staff has technically analyzed the bids submitted by Herman Miller and Steelcase on a comparative basis for adherence to the published specifica- tions. Based on this analysis a severe discrepancy arises within the Herman Miller bid. It has been determined that what was bid by Herman Miller is, in fact, particle board frame with corrugated cores. This does not meet the steel frame with. steel core specifications which were outlined in the original bid. Also, the PhOenix line of modular furniture andpanels, which was included as part of theHerman Miller bid, is, in part, reconditioned as_opposed to the 9000 series furniture specified within the bid request. The 9000 series bid by Steelcase is, in fact, all new furniture and panels and, as such, reconditioned materials with a lesser warranty can not be considered an equal. Staff believes the Herman Miller bid also contains amounts of gypsum board constructedwalls as -opposed to the standards outlined in the specifications. ADDENDUM -2- Considering Herman Miller bid particle board panels with reconditioned furniture, the $10,000 approximate difference between Herman Miller and Corporate Design should indeed be significantly greater in our estimation. That fact not w~thstand~ng, ~t ~s not staff s recommendation to invest a significant amount of money in second line, high maintenance cost, low warranty, Iow life- span type material. Panels and modular units are, by their nature,'a significant investment and as Such, it is prudent to analyze the life-cycle costs of the materials involved. Because of all the aforementioned reasons, staff recommends that the bid be Warded to Corporate Designs of West Palm Beach, which includes the Steelcase ineof materials. This total is directly comparable with the GSA bid total originally explored with Steelcase, and the amount that we would pay if we decided to award the project under a GSA contract. In fact, Corporate. Design also bid a reduced alternate with a quality of movable wall inferior to bid spe- ification.~ Using this alternate would reduce their bid by approximately 24,000 into the number one position, while still holding the quality standards on the panels and furniture. However, staff does not recommend reducing the standards set forth in the original bid specification In addition, Corporate Design has currently donea significant amount of advanced planning, related to the GSA bid proposal, consequently there is a greater degree of confidence in meeting shipping deadlines and set up deadlines which will be integral in the smooth opening of Pineland Plaza as the temporary City Hall. It appears that there may be serious doubts as to the ability of any of the companies to-make opening day deadlines if award of the bid is delayed further. Peter L.
