3 A RESOLUTION OF THE CITY COMMISSION OF
4 THE CITY OF BOYNTON BEACH, FLORIDA
5 ASSESSING THE COSTS OF ABATEMENT OF
6 CERT AIN NUISANCES AGAINST THE OWNERS
7 OF THE PROPERTIES INVOLVED, AND
8 PROVIDING FOR AN EFFECTIVE DATE.

10 WHEREAS, the City Manager or his designated representative of the City of Boynton
11 Beach, Florida, acting on and on behalf of the City, has pursuant to Section 10-5 of the Code of
12 Ordinances of the City of Boynton Beach, found and determined that the condition of certain
13 property or parcels of land as hereinafter described violate Section 10-2 and 10-3 of said Code
14 by reason of the existence of excessive growth of weeds, grass, vegetation or other noxious
15 plants or other offensive substance detrimental to the health and welfare of the residents of the
16 City, thereby constituting a nuisance; and
17 WHEREAS, the owners of the parcel(s) of property hereinafter described were duly
18 notified in accordance with Section 10-5 of the City Code of Ordinances and were required to
19 abate the nuisance, as described in the Notice to Owners within the prescribed period of time;
20 and
21 WHEREAS, said nuisance was not abated as required; and
22 WHEREAS, pursuant to and in accordance with the procedure set forth in Chapter 10
23 of the Code of Ordinances of the City of Boynton Beach, the City abated said nuisance; and
24 WHEREAS, the City Manager or his authorized representative has made a report of
25 costs actually incurred by the City and abatement of said nuisance as to the property(s)
26 involved, which is hereinafter described.
27 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
28 THE CITY OF BOYNTON BEACH, FLORIDA AS FOLLOWS:

Section 1:
Each Whereas clause set forth above is true and correct and incorporated
2 herein by this reference.

Section 2:
That the amount of costs incurred by the City and the abatement of the
4
above-described nuisance as to the parcels of land, owned and indicated to-wit:

Subject amount is hereby assessed as liens against said parcels of land as
indicated, said liens as to said parcels of land shall be of equal dignity with
the taxes there from for the year 2004, depending on invoice date, and
shall be enforced and collected in like manner pursuant to applicable
provisions of law. In the event collection proceedings are necessary, the
property owner shall pay all costs of the proceedings, including reasonable
attorney fees.
Section 3. This Resolution shall become effective immediately upon passage.
