R98-108RESOLUTION R98-/¢¢ A RESOLUTION OF THE CITY COMMISSION OF THE CiTY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AN INTERLOCAL AGREEMENT BETWEEN PALM BEACH COUNTY (COUNTY) AND THE CITY OF BOYNTON BEACH (CITY) PROVIDING AUTHORITY TO THE COUNTY TO ENFORCE COUNTY ORDINANCE 97-56 WITHIN THE' CITY LIMITS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on November 18, 1997, the Board of County Commissioners approved an °rdinance regulating locally licensed contractors and unlicensed construction activity; and WHEREAS, County Ordinance 97-56 is applicable to the unincorporated area of the County pursuant to Section 489.127, Florida Statutes and provides for the issuance of citations, civil fines, cease and desist orders, and notices to appear with respect to work performed by unlicensed construction activity and locally licensed contractors; and WHEREAS, Chapter 489, Florida Statutes permits the enforcement of County Ordinance 97-56 within a municipality's corporate limits, provided the municipality and county enter into an Intedocal agreement; and WHEREAS, Section 163.01, Florida Statutes permits public agencies to enter into Interlocal agreements with each other to jointly exercise any power, privilege, or authority Which such agencies share in common and which each might exercise separately; and WHEREAS, it is mutually advantageous to enter into this agreement for the purpose of permitting the County to enforce County Ordinance 97-56 within the corporate limits of the City of Boynton Beach; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. This Commission does hereby authorize and direct the Mayor and City Clerk to execute an Interlocal Agreement between Palm Beach County and the City of Boynton Beach providing authority to the County pursuant to Chapter 489, Florida Statutes, ,to enforce the terms and provisions of Palm Beach County Ordinance 97- 56 within the corporate limits of the City of Boynton Beach.
