R98-057RESOLUTION NO. R98-,~' A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, URGING THE FLORIDA LEGISLATURE TO PASS AND ENACT SENATE BILL 1478 AND HOUSE OF REPRESENTATIVES BILL 3827, OTHERWISE KNOWN AS THE HOMEOWNERS PROTECTION ACT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, in August 1992, Hurricane Andrew descended upon South Florida and became the costliest catastrophe in the history of the United States, causing $30 billion in property damages, including $16 billion of insured losses; and WHEREAS, an estimated 80,000 single-family homes, mobile homes and apartments and condominium units were severely damaged or destroyed, and that at, least 180,000 people were left homeless; and WHEREAS, many residents subsequently lost the private-market insurance coverage they need to fully protect their homes and personal belongings in the event of another storm; and WHEREAS, six years later, many homeowners throughout Florida still do not have access to affordable, private insurance coverage, despite the numerous measures enacted by the State of Florida since Hurricane Andrew to aid in reducing the industry's exposure to bankrupting losses, including the creation of the Florida Hurricane Catastrophe Fund; .and WHEREAS, the continuing lack of competition in the insurance marketplace in certain parts of the state is wreaking havoc on many of South Florida's communities; and WHEREAS, the insurance industry continues to use the Hurricane Andrew catastrophe to push for higher and higher premiums; and WHEREAS, the Homeowners Protection Act, SB 1478 and HB 3827, is proposed in the Florida Legislature to asSist homeowners and Florida residents in obtaining insurance at reasonable premium rates; and WHEREAS, the City Commission of the City of Boynton Beach believes passage of SB 1478 and HB 3827 by the Florida Legislature will greatly benefit residents of the city and the state. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The City Commission of the City of Boynton Beach, Florida does hereby encourage the Florida Legislature to pass and enact Senate Bill 1478 and House .Bill 3827, otherwise known as the Homeowners' Protection Act Section 2. The City Clerk is hereby directed to forward a copy of this Resolution to each Florida State Senator and Representative for Palm Beach County, and the Palm Beach County Legislative Delegation, the Board of County Commissioners of Palm Beach County; and Governor Lawton Chiles.
