R05-209 1 RESOLUTION NO. ~o1 2 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF 4 BOYNTON BEACH, FLORIDA SUPPORTING THE ENACTMENT OF 5 GENERAL STATE LEGISLATION PROPOSING AN ENTIRELY NEW 6 SEC.163.08, FLORIDA STATUTES, RELATED TO THE 7 REQUIREMENT FOR A DUAL REFERENDUM VOTE OF THE 8 ELECTORS IF A COUNTY EXTENDS COUNTYWIDE LEVEL OF 9 SERVICE STANDARDS FOR THE PROVISION OF ANY MUNICIPAL 10 SERVICES WITHIN ANY MUNICIPALITY; PROVIDING SUPPORT 11 FOR A PROPOSED LOCAL BILL LIMITING PALM BEACH 12 COUNTY'S AUTHORITY TO ADOPT ANY COUNTYWIDE 13 LEGISLATION WHICH WOULD HAVE THE EFFECT OF 14 PREVENTING MUNCIP ALITIES FROM PROVIDING FIRE-RESCUE 15 DISPATCH SERVICES OR WHICH WOULD AUTHORIZE THE USE 16 OF COUNTYWIDE REVENUES TO FUND THE COUNTY'S FIRE- 17 RESCUE DISPATCH SYSTEM; FURTHER PROVIDING SUPPORT 18 FOR ANY RELATED GENERAL OR LOCAL BILL WITH SIMILAR 19 INTENT AND OBJECTIVES WHICH FURTHERS THE INTERESTS OF 20 MUNICIPALITIES IN MAINTAINING THEIR HOME RULE POWERS 21 AND ABILITY TO DELIVER TRADTIONAL MUNICIPAL SERVICES; 22 PROVIDING FOR DISTRIBUTION; AND PROVIDING AN 23 EFFECTIVE DATE. 24 25 WHEREAS, the City Commission supports the enactment of general state legislation 26 which would provide that the establishment of countywide level of service standards for the 27 provision of municipal services within any municipality in the county is considered a transfer of 28 power requiring approval by vote of the electors of the transferor, and approval by vote of the 29 electors of the transferee; and 30 WHEREAS, the City Commission also supports a proposed local bill for adoption by 31 the State Legislature which would limit Palm Beach County's authority as a charter county to 32 enact any legislation which would prevent municipalities from providing fire-rescue dispatch 33 services to their residents or which would allow the County to utilize countywide tax revenues 34 to fund the County's fire-rescue dispatch system; and 35 WHEREAS, the Palm Beach County's Legislative Delegation will be reviewing the 36 proposed local bill at its hearing to be held on December 13,2005, to consider endorsement of 37 this or similar legislation during the coming legislative session; and C:\Documents and Settings\costelloj.CITY\Local Settings\Temporary Internet Files\OLKE9\Support Local Fire Rescue Gen Legis.doc 1 WHEREAS, the City Commission desires to take official action evidencing its support 2 for both the special act and the proposed general legislation relating to these matters. 3 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF 4 THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS: 5 Section 1: The "Whereas" clauses set forth hereinabove related to proposed 6 legislative enactments are incorporated herein by reference and the City Commission ofthe City 7 of Boynton Beach hereby appeals to the Florida Legislature to enact the proposed state 8 legislation or enact similar legislation which will have the same effect of protecting the home 9 rule powers of the municipalities of the state related to the provision of traditional municipal 10 services such as fire-rescue services. 11 Section 2: The City Clerk is directed to send copies of this Resolution to the Palm 12 Beach County League of Cities, Inc., the Florida League of Cities, Inc.; the Palm Beach County 13 Legislative Delegation; the Governor and members of the Florida Cabinet. 14 Section 3: This Resolution shall take effect immediately upon passage. 15 PASSED AND ADOPTED this Jz.- day of December, 2005. 16 CITY OF BOYNTON BEACH 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 C:\Documents and Settings\costelloj.CITY\Local Settings\Temporary Internet Files\OLKE9\Support Local Fire Rescue Gen Legis.doc
