AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
APPENDIX A - ZONING, SECTION 4. GENERAL
PROVISIONS, BY DELETING SUBSECTION M.
SATELLITE DISH ANTENNAE IN ITS ENTIRETY AND
CREATING A NEW SUBSECTION M; PROVIDING
FOR REGULATION OF SATELLITE DISH ANTENNAE;
ISSUANCE OF PERMITS; STANDARDS FOR
INSTALLATION AND LOCATION; COMPLIANCE
WITH STANDARD BUILDING CODE;
GRANDFATHERING EXISTING ANTENNAE;
PROVIDING FOR CONFLICTS, SEVERABILITY,
CODIFICATION AND AN EFFECTIVE DATE.
WHEREAS, the City Commission has reviewed the recommendation of staff
with respect to updating certain provisions of Section 4., Appendix A - Zoning, and
more particularly Subsection M. Satellite Dish Antennae;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. That Appendix A - Zoning, Section 4. Subsection M. is hereby
deleted in its entirety, and a new subsection M. is hereby created, as follows:
M. SATELLITE DISH ANTENNAE
Satellite Dish Antennae shall be allowed in all zoning
districts, provided the following criteria are met:
a. General Provisions;
(1) No Satellite Dish Antenna shall be installed or modified
without first obtaining a permit from the Building Division.
(2) All applications for the' installation of Satellite Dish
Antennae shall be accompanied by proper certification that
the installation will withstand a Category 2 hurricane and is
adequately grounded for protection from a direct lightning
strike.
(3) Satellite Dish Antennae shall not be located forward of
the front of any building, in any required side yard, or within
8' of rear property line.
(4) All satellite dish antennae shall be screened on three
(3) sides with landscape materials or walls with
landscaping which are of a height equivalent to the total
height of the mounted satellite dish.
(5) Lot size must comply with zoning regulations.
(6) Portable Satellite Dish Antennae are not allowed.
(7) No exterior Satellite Dish Antennae may be used for
display or advertising purposes, and none shall have
writing thereon which is visible from a public right-of-way or
residential district.
(8) Satellite Dish Antennae shall conform with provisions
of Chapter 5, Buildings, Housing and Construction
Regulations, of the Boynton Beach Code of Ordinances,
the Standard Building Code and the Amendments thereto
as adopted by the City provided such provisions do not
conflict with any standards set forth in this Section, in
which case this section shall control.
b. Special provisions:
(1) Satellite Dish Antennae installed to serve single family
or duplex homes must also comply with the following
requirements:
(a) Only one non-commercial Satellite Dish
Antenna will be permitted for each residential
dwelling unit.
(b) Satellite Dish Antennae shall be free-
standing, ground mounted, and self
supporting without structural connections to
any other structure or building.
(c) No part of any Satellite Dish Antenna
installation may extend beyond the height of
the horizontal eave line of the first floor of
any single family or duplex home.
(2) Satellite Dish Antennae installed to serve any use
other than single family or duplex homes must also comply
with the following requirements:
(a) Part III, Land Development Regulations,
Chapter 4, Site Plan Review, of the Boynton
Beach Code of Ordinances.
(b) Only one Satellite Dish Antenna may be
located in a multi-family complex and it may
not be located on a roof. Nothing in this
provision shall be construed to alter or impair
any rights, authority, or restrictions imposed
by deed or under the rightful authority of any
homeowner's association.
(c) A Satellite Dish Antenna installed in
commercial and industrial zoning districts
may not be located on a roof so that the dish
is visible from a public right-of-way or
residential district, except as stipulated in
1 .a.(4) hereinbefore.
(d) Satellite Dish Antennae which are
mounted on a tower and used for
communication in connection with the
operation of a business shall provide
reasonable screening and shall be subject to
Conditional Use approval.
(3) Satellite Dish Antennae properly permitted prior to
the date of publication of this section may remain in place
notwithstanding provisions stipulated herein. No antennae
grandfathered under this paragraph may be replaced,
reconstructed, or modified, however, without bringing the
entire installation into full compliance with this section.
That all other provisions of Appendix A - Zoning, not herein
specifically amended shall remain in full force and effect as previously enacted.
All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
Should any section or provision of this ordinance or any portion
thereof be declared by a court of competent jurisdiction to be invalid, such decision
shall not affect the remainder of this ordinance.
Authority is hereby given to codify this Ordinance.
This ordinance shall become effective immediately upon passage.
