AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING SECTION 9-24(a) OF THE CODE OF
ORDINANCES CONCERNING FIRE FIGHTER AIR
SYSTEMS IN HIGH RISE BULDINGS; LIMITING
APPLICATION OF REGULATIONS TO HIGH RISE
BUILDINGS, AS DEFINED BY THE NATIONAL FIRE
PROTECTION ASSOCIATION; PROVIDING FOR
CONFLICTS, SEVERABILITY, CODIFICATION AND
AN EFFECTIVE DATE.

WHEREAS, the City Commission heretofore adopted Ordinance 04-005, codified as

Section 9-24 of the Code of Ordinances, requiring fire safety improvements for high rise
15
buildings; and
16
WHEREAS, Section 9-24a applies the regulations to buildings 75 feet or higher, in
17
all buildings of six or more stories used for human occupancy; and
18
WHEREAS, a high-rise building is defined by the National Fire Protection
19
Association (NFP A) as "a building greater than 75 ft (23m) in height where the building
20
height is measured from the lowest level of fire department vehicle access to the floor of the
21
highest occupiable story. (Life Safety Code 101 :3.3.25.6).

WHEREAS, the City Commission has determined that the regulations should only
23
apply to high-rise buildings-.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
25
THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS:

Section 1. The foregoing "Whereas" clauses are true and correct and incorporated
27
herein by reference.

Section 2.
Section 9-24(a) of the City of Boynton Beach Code of Ordinances is
29 hereby amended as follows:

(a)
Enforcement of application. The high-rise regulations set forth in this
section shall be enforced by the Fire Marshal. These regulations shall
apply to all high-rise buildings as defined by the National Fire
Protection Association (Life Safety Code 101:3.3.25.6)., which have
floors used for human occupancy located seventy five (75) feet or more
above grade, and all buildings of six (6) or more stories used for human
occupancy.

Section 3. Each and every other provision of the Land Development Regulations
not herein specifically amended, shall remain in full force and effect as originally adopted.
Section 4. All laws and ordinances applying to the City of Boynton Beach in
conflict with any provisions of this ordinance are hereby repealed.
Section 5. Should any section or provision of this Ordinance or any portion
thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not
affect the remainder of this Ordinance.
