O95-39ORDINANCE NO. O95-,.~?' AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 17. PEDDLERS AND SOLICITORS, SECTION 17-38(d). AMENDING DURATION OF PERMITS: SECTION t7-39(C), DELETING FEE REQUIREMENTS FOR AMENDMENTS OF APPROVED PERMITS; AMENDING SECTION 17-42.(B), PROVIDING FOR THE LIMITATION OF DURATION OF TERMS FOR SOLICITATION PERMITS; AMENDING SECTION 17-43. PROVIDING FOR CONSISTENCY IN DURATION OF PERMITS: PROVIDING FOR CONFLICTS,: SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. WHEREAS, upon review of Chapter 17. of the City Code of Ordinances, the City Commission deems it to be in the best interests of the citizens and residents of the City to limit the duration of solicitation permits to thirty (30) days, as well as abolishing the payment of a fee for amending an approved application; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA THAT: Section 1. Chapter 17., Section 17-38.(d) of the Code of Ordinances of the City of Boynton Beach is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: Sec. 17-38. Application for permit. (d) A list of all fund raising events to be held during the thirty_ (30) day period ~at, which thirty_ (30) day period year shall run for the twe;ve-~-,~o,-~;-, thirty (30) day period from the date of the application. Section 2. Chapter 17., Section 17-39.(c) of the Code of Ordinances of the City of Boynton Beach is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: Sec. 17-39. Fees (c) There will be a ,-,o,-,-e;u,-,ciabie ;ee o; Eve doiia~-~ 1'$5:OO)- no fee required for amending an approved application. Section 3. That Chapter 17. Section 17-42(b) of the Code of Ordinances of the City of Boynton Beach is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: Sec. 17-42. Contents of permits; terms; expiration; nontransferable. (b) No permit shall have a term in excess of o~-,e yea~- thirty (30) days from the date of issuance by the city clerk. This term shall run from the date of the application for a ~weive-rr, o,-,~h thirty. (30) day period. Section 4. Chapter 17., Section 17-43 of the Code of Ordinances of the City of Boynton Beach is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: Sec. 17-43. Amendments to application; additional solicitation. When an applicant has previously received a permit for all planned solicitation during the-year thirty (30) day period and desires to schedule an additional solicitation which has not been considered, he has two (2) alternatives: ~ All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 6. Should any section or provision of this ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this ordinance. Section 7. Authority is hereby given to codify this Ordinance. Section 8. This ordinance shall become effective immediately upon passage.
