AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING CHAPTER 26. WATER, SEWERS AND
CITY UTILITIES, DIVISION 4. INDUSTRIAL AND
COMMERCIAL WASTE. SECTION 26-157.
PERIODIC COMPLIANCE REPORT, PROVIDING
FOR NOTIFICATION AND RESAMPLING
PROCEDURES FOR VIOLATIONS; PROVIDING
FOR CONFLICTS, SEVERABILITY, CODIFICATION
AND AN EFFECTIVE DATE.
WHEREAS, the State of Florida is now delegated by the E.P.A. to administer
the National Pollutant Discharge Elimination System (N.P.D.E.S.) permit program;
and
WHEREAS, as part of this delegation the Florida Department of
Environmental Protection (D.E.P.) is now the approval authority for all pretreatment
program related activities; and
WHEREAS, the D.E.P. has directed that specific language be incorporated in
our Code to provide for notification and resampling procedures for violations;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. That Chapter 26, Section 26-157 of the Code of Ordinances of
the City of Boynton Beach is hereby amended by adding the words and figures in
underlined type, as follows:
Sec.26-157. Periodic compliance report.
(A) Each significant user and/or permittee shall...

Section 3. Should any section or provision of this ordinance or any portion
thereof be declared by a court of competent jurisdiction to be invalid, such decision
shall not affect the remainder of this ordinance.
Authority is hereby given to codify this Ordinance.
This ordinance shall become effective immediately upon
