AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA AMENDING
CHAPTER 2 ZONING CODE OF THE LAND
DEVELOPMENT REGULATIONS (PART III OF THE
CODE OF ORDINANCES), BY AMENDING SECTION
8. A. 1 .C. STORAGE, DISTRIBUTION AND
WHOLESALE USE; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND AN EFFECTIVE
DATE.

WHEREAS, the City Commission of the City of Boynton Beach, Florida has
reviewed Chapter 2, of the Zoning Code of the land Development Regulations (Part
III of the Code of Ordinances) and have determined that it is in the best interests
of the citizens of the City to amend the code to allow wholesale of live fish in the M-
1 zoning district and that this determination is consistent with the comprehensive
plan; of the Code of Ordinances of the City of Boynton Beach; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. That Chapter 2, Section 8.A. 1.c. of the Land Development
Regulations (Part III of the Code of Ordinances) is hereby amended by adding the
words and figures in underlined type, as follows:
8.A. 1 .c.
(17) Live fish,
Section 3, All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
Section 4. Should any section or provision of this ordinance or any portion
thereof be declared by a court of competent jurisdiction to be invalid, such decision
shall not affect the remainder of this ordinance.
Authority is hereby given to codify this Ordinance.
This ordinance shall become effective immediately upon
