AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON .BEACH, FLORIDA,
REGARDING THE NE 8TH AVENUE REZONING-LOT
#i0 (SOUTH SIDE OF NE 8TH AVENUE,-
APPROXIMATELY t00 FEET WEST OF NE 1ST
STREET) AMENDING ORDINANCE 91-70 OF SAID
CITY BY REZONING A CERTAIN TRACT OF LAND
MORE PARTICULARLY DESCRIBED HEREIN, FROM
PUBLIC USAGE TO R-2 (SINGLE & TWO FAMILY
DISTRICT); AMENDING THE REVISED ZONING
MAP ACCORDINGLY; PROVIDING FOR CONFLICTS,
SEVERABILiTY AND AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
Beach, Florida has adopted Ordinance No. 91-70, in which a
Revised Zoning Map was adopted for said City; and
WHEREAS, The City of Boynton Beach implements an Infill
Housing Program intended to promote the construction of single
family homes on eligible parcels within said City; and
WHEREAS, The City of Boynton Beach must amend the Revised
Zoning Map 5o allow for said property to be used for the
construction of a single family home in connection with the
City's Infiil Housing Program; and
WHEREAS, The City of Boynton Beach, owners of the
property more particularly described hereinafter, has
heretofore filed a Petition, pursuant to Section 9 of Appendix
A-Zoning, of the Code of Ordinances, City of Boynton Beach,
Fiorida~ for the purpose of rezoning a certain tract of land
consisning of 0.13 acre, said land being more particularly
described hereinafter, from Public Usage to R-2 (Single & Two
Family District), which requests that the 0.13-acre tract be
removed from the boundaries of the Public Usage zone to allow
for the processing of the rezoning application; and
WHEREAS, the City Commission deems it in the best
interests of the inhabitants of said City to amend the
aforesaid Revised Zoning Map as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY ~HE CItY CO~ISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, TF~AT:

City of Boynton Beach, Florida, to-wit:
Lot 10, Block 2 of the ~Palm Beach
Country Club Estates Subdivision,
according to Plat thereof on file in the
office of the Clerk of the Circuit Court
in and for Palm Beach County, Florida as
recorded in Plat Book 11, Page 43.
Containing 0.13 acre more or less, and
subject to easements, reservations or R/W
of record.
be and the same is hereby rezoned from Public Usage to R-2
Single & Two Family District. A location map is attached
hereto as Exhibit "A" and made a part of this Ordinance by
reference.
Section 2: That the aforesaid Revised Zoning Map of the
City shall be amended accordingly.
~_e_ctiQn Si All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Secti%n ~ Should any section or provision of this
Ordinance or any portion thereof be declared by a court of
competent jurisdiction to be invalid, such decision shall not
affect %he remainder of this Ordinance.
~ection 5: This ordinance shall become effective
immediately upon passage.
