AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
BOYNTON BEACH, FLORIDA, AMENDING PART III, LAND
DEVELOPMENT REGULATIONS, CHAPTER2 ZONING, SECTION?-6~A.1
TO CREATE A NEW SUBSECTION t ALLOWING DENTAL LABORATORIES
IN THE C-1 ZONING DISTRICT AS A CONDITIONAL USE;
PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE
DATE.
WHEREAS, the City Commission of the City of Boynton Beach,
Florida, has considered a staff recommendation to permit dental
laboratories in C-1 zoning districts; and
WHEREAS, the City Commission has determined that dental
laboratories are an approved use in the C-1 District provided~they
are treated as a conditional use and that such use, whe~
appropriately reviewed and approved, will not interfere with the
health, safety and welfare of the residents, property owners and
visitors to the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA that:
Section 1. Part III, Land Development Regulations, Chapter
2-Zoning, Section 6.A.1 is hereby amended to create a new section
t, listing dental laboratories as a conditional-use in the C-1
zoning district. This new section of the Code shall read as
follows:
t__ Dental Laboratories.*
Section 2. Ail other provisions of Part III, Land
Development Regulations, Chapter 2-Zoning, section 6.A.1 shall
remain as currently enacted.
Section 3. That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 4. In the event any portion of this Ordinance is
deemed in valid, illegal or unconstitutional by any court of
competent jurisdiction, such decision shall in no manner effect the
remaining portions or sections of this Ordinance and shall remain
in full force and effect.
