O95-02ORDINANCE NO. 095-~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, CREATING THROUGH REPEAL, REVISION, AND RENUMBERING, COMPREHENSIVE LAND DEVELOPMENT REGULATIONS; PROVIDING FOR THE REPEAL IN ITS ENTIRETY OF CHAPTERS 5, 7.5, 8, 19, 21, AND 22 OF PART II OF THE CODE OF ORDINANCES AND ESTABLISHING IN THEIR PLACE NEW SECTIONS TO PART III ENTITLED LAND DEVELOPMENT REGULATIONS OF THE CODE OF ORDINANCES; PROVIDING FOR GENERAL PROVISIONS FOR DESIGNATION AND CITATION, RULES OF CONSTRUCTION, DiEFINITIONS, JURISDICTION, PURPOSE, AND FEESi AND DEDICATIONS; PROVIDING FOR PLANNING AND DEVELOPMENT, ESTABLISHMENT AND COMPOSITION OF THE PLANNING AND DEVELOPMENT BOARD, ADMINISTRATIVE FEES FOR LAND DEVELOPMENT RELATED ACTIVITY, AND CONCURRENCY REQUIREMENTS; PROVIDING FOR ZONING, INCLUDING DEFINITIONS, SCOPE AND AUTHORITY, REGULATIONS AND MAPS, ZONING D] AND ADMINISTRATION AND ENFORCEMENT; FOR A BOARD OF ADJUSTMENT; PROVIDING FOR NON-CONFORMING AND CONDITIONAL USES; PROVIDING FOR AN ENVIRONMENTAL REVIEW; PROVIDING FOR PLANNED UNIT DEVELOPMENTS; PROVIDING FOR MASTER PLAN REVIEW; PROVIDING FOR PLAN REVIEW; PROVIDING FOR PLATTING; PROV : FOR REQUIRED IMPROVEMENTS; PROVIDING FOR SURETY; PROVIDING FOR ENVIRONMENTAL REGULATION; PROVIDING FOR EXCAVATION AND FILL REGULATIONS!; pROVIDING FOR BUILDINGS, HOUSING AND CONSTRUCTION REG]~LATIONS; PROVIDING FOR SIGN REGULATION; PROVIDING FOR STREETS AND SIDEWALKS; PROVIDING FOR PARKING LOTS; PROVIDING FOR REPEAL OF CONFLICTING LAND DEVELOPMENT~ REGULATIONS AND PROVISIONS OF THE CODE OF ORDINANCES; PROVIDING FOR SEVERABILIT~; PROVIDING FOR CODIFICATION AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission and the City Administration have been engaged in a two (2) year project for the review and revision of the Plan Development Regulations of the City; and WHEREAS, the City Commission has determined that it is in the best interest of the City, its residents, property owners, and visitors to revise and consolidate the regulations of the City which govern or impact the use and development of land and property within the City; and WHEREAS, the City Commission believes it to be in the best interest of the City, its residents, property owners and visitors CODING: a:\ldr. Page 1 of 4 to consolidate the City's land development regulations into one comprehensive section of the City Code for ease of use and reference. NOW, THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH AS FOLLOWS: Section 1. There is hereby created a new Part III of the Code of Ordinances of the City of Boynton Beach, Florida, to be entitled Land Development Regulations. Section 2: The Land Development Regulations of the City of Boynton Beach, Florida shall consist of twenty-six (26) Chapters of Part III of the Code of Ordinances as follows: CHAPTER Chapter 1 Chapter 1.5 Chapter 2 Chapter 2.5 Chapter 3 Chapter 4 Chapter 5 Chapter 6 Chapter 7 Chapter 7.5 Chapter 8 Chapter 9 Chapter 20 Chapter 21 Chapter 22 Chapter 23 Chapter 24 19 26 TITLE General Provisions Planning & Development Generally Zoning (formerly Appendix A) Planned Unit Developments Appendix B) Master Plan Review Site Plan Review Platting Required Improvements Surety Environmental Regulations Excavation and fill regulations Reserved Building, Housing & regulations Signs Streets and Sidewalks Parking Lots Reserved (formerly Construction Section 3: The current Part III of the Code of Ordinances is hereby repealed in its entirety and a new Part III of the Code of CODING: Words in sL£1ke Li~£uugh type are deletions from existing law; Words in underscored type are additions. a: \ldr. ORD 2-17-95 Page 2 of 4 Ordinances is hereby created which shall be as set forth on Exhibit "A" attached hereto and incorporated for all purposes. Section 4: The following Chapters of Part II of the Code of Ordinances of the City of Boynton Beach are hereby repealed in their entirety. CHAPTER Chapter 5 Chapter 7.5 Chapter 8 Chapter 19 Chapter 21 Chapter 22 TITLE Building Housing and Construction Regulations Environmental Regulation Excavation and Fill Regulations Planning and Development Generally Signs Streets and Sidewalks Appendix A and Appendix B have been redesignated as Chapters 2 and 2.5 respectively. Appendix C has been redesignated and is now found in Chapters 1-23. Section 5: Ail land development regulation fees as referenced or described in the new Land Development Regulations are subject to amendment by Resolution by the City Commission. Current fee schedules for all land development regulations shall be maintained on file in the office of the City Clerk and shall be available, without charge, to the public. Section 6: This Ordinance shall not be codified. The Land Development Regulations created in Section 3 hereof and attached hereto as Exhibit "A" shall be codified in the numbering sequence set forth therein, The Land Development Regulations may, from time to time, be renumbered without the necessity of Ordinance or Resolution, when such renumbering will assist in the organization or clarity of the Regulations. Section 7: All ordinances or parts of ordinances in conflict herewith shall be and the same are hereby repealed. Section 8. Should any section or provision of this ordinance or portion hereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision CODING: a:~ldr. Page 3 of 4 shall not affect the remainder of this ordinance and shall act to revive that repealed ordinance or provision of an ordinance which dealt with the same subject matter and which is repealed be reference in this ordinance.
