AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
CHAPTER 26.9 OF THE CODE OF ORDINANCES,
PROVIDING FOR AN AMENDED FEE STRUCTURE FOR
MONTHLY BILLINGS FOR WATER AND WASTEWATER;
PROVIDING FOR CONFLICTS, SEVERABILITY,
CODIFICATION AND AN EFFECTIVE DATE.
WHEREAS, on September 18, 1990, the City Commission of the City of
Boynton Beach established a five year schedule for Water and Wastewater rates and
charges, by Ordinance No. 90-35; and
WHEREAS, due to increased efficiendes in staff operations, greater usage than
originally estimated and the ability to not increase expenditures to the amounts
originally anticipated, the rate schedule increase set forth in Section 26.9, for fiscal
year 1994-95 is hereby deleted, and the current rate being charged for fiscal year
1993-94 shall continue to be in effect for fiscal year 1994-95..
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
· CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. That Section 26-9 of the Code of Ordinances of the City of Boynton
Beach, shall be amended to reflect that the increase set forth for fiscal year 1994-95
is hereby deleted and the current rate being charged for fiscal year 1993-94 shall
continue to be in effect throughout fiscal year 1994-95.
Section 2. Each and every other Section of Chapter 26 not herein specifically
amended shall remain in full force and effect as previously enacted.
Section 3. That all ordinances or parts of ordinances in conflict herewith be
and the same are hereby repealed.
Section 4. Should any section or provision of this ordinance or portion hereof,
any paragraph, sentence or word be declared by a court of competent jurisdiction to
be invalid, such decision shall not affect the remainder of this ordinance.
Section 5. Authority is hereby granted to codify said ordinance.
Section 6. This ordinance shall become effective October 1, 1994.
